1974-05-13 CITY COUNCIL REGULAR MEETING MINUTESMINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON MAY 13, 1974, AT 7:40 P. M. IN THE CITY HALL, 2335 N. TEXAS AVENUE, PEARLAND, TEXAS. The meeting was called to order with the following present: Mayor Councilman Councilman Councilman Councilman Councilman City Manager City Attorney City Secretary INVOCATION AND PLEDGE OF ALLEGIANCE: Carlton McComb Cecil W. Griffin Harry E. Farley Gene E. Sanders Tom Reid Benny J. Frank William E. Wolff Bobby J. Williams Dorothy L. Cook The invocation was given by Rev. Louie White, pastor of the Church of Christ of Peaxland, The Pledge of Allegiance was led by Donald Stratton, a Star Scout in Troop 464. APPROVAL OF MINUTES: It was moved by Councilman Reid, seconded by Councilman Griffin that the minutes of the regular meeting held on April 22, 1974 be approved as submitted. Motion passed 5 to 0. COUNCIL ACTIVITY REPORTS: Mayor McComb made the following announcements: 1. City Secretary Doroth;Cook was elected President of the Salt Grass Chapter of the City Clerks and Secretaries Association of Texas. 2. The Texas Highway Department has approved funds for the installation of automatic grade crossing protection devices for the Knapp Road railroad crossing% An on-site preliminary inspection will be made on May 15, 1974 by officials of the Highway Department, Railway Company, City of Pearland, and City of Brookside. 30, Dr. Charles Lobb advised the Mayor, by letter, that he had not authorized his name to be used in the Suit - Imperial Estates # 1 Maintenance Committee, et al vs Harris County, Texas, et al and that he advised the Attorney for this group to remove his name as a Plaintiff immediately. Mr. Johnnie Hall, Post Commander of the V. F. W. presented the Mayor with a citation from his organization. A citation was also presented to the Chief of Police. These citations were for the assistance and support of the Veteran of Foreign Wars xn various civic activities and law enforcement by Mayor McComb and Chief Stanford, COUNCIL ACTIVITY REPORTS: Councilman Frank reported that he had met with the Park Board and anz!Inquiry, regarding a summer bowling recreation program for the youth of the community, was discussed, A representative will be at the City Hall on Saturday, May 18, 1974 between 10:30� A. M, and 12:30 P. M. to sign up any interested parties. Four free bowling lessons will be offered to those signing up for this program. The bowling lanes are in Alvin. Councilman Reid reported that Cub Pack #463 did a fine job at the esplanade 1rdwex beds. M on Grand Boulevard. Cub Pack # 464 cleaned the premises around the City Hall. DEPARTMENTAL REPORTS: Mr. Wolff reported that the Shadycrest and Longherridge street paving projects were completed and now ready for call of a Public Hearing. Mayor McComb advised that a time for the Hearings would be set as soon as a check was made on the time element needed to proceed with:: the hearings. CITIZENS: Mrs. M. L. Ritter appeared before the City Council with a request and petition .requesting the City Council to suspend, in this specific instance, its Resolution No. 73--5 pertaining to the paving of residential streets, and proceed to the paving of that portion of Shadybend between Shadycrest and Shadycrest Elementary School. Mrs. Ritter stated that the petition was signed by 72 families. Mrs. Ritter advised the City Council that the City now has enough signatures on Shadybend, along with the School,to pave this street.under the participation paving program, however, the petition was presented as an expression of interest the citizens have in this paving project. It was moved by Councilman Sanders, seconded by Councilman Griffin that the petition be received into the records of the City. Motion passed 5 to 0. DOCKETED PUBLIC HEARINGS: 8:00 P. M. 1. Petition for Annexation - Frank D. Barringer, owner. 54.2755 acres of land located in Abstract 237 Persons wishing to speak for the annexation. Mr. Stephen C. Benckenstein of the firm of Bath/Bentsen, Interest outlined the proposed use of this property if the annexation was accepted. All acreage would be subject to the Land Use Ordinance. Persons wishing to speak against the annexation. None Questions from the City Council. Mr, Benckenstein advised that after annexation and zoning have been decided,that his firm would be ready to start Phase 1 -of the project. This would be the proposed apartmeant project, Phase 2 would be commercial development (stores, etc.)/woudld begin within a year or eighteen months, and Phase 3, the balance of the acreage would likely be sold after streets were installed. Mr. Wolff advised the Council that water and sewer services were adequate to serve this area. Adjourn Hearing - Time 8:15 P. M. UNFINISHED BUSINESS: ORDINANCE NO, 275 - AN ORDINANCE CLOSING HEARING ON HALBERT DRIVE PAVING ASSESSMENT: Ordinance No. 275 read in full by Councilman Griffin. 8 It was moved by Councilman Griffin, seconded by Councilman Farley that Ordinance No. 275 be passed and approved on the second of three readings. Said Ordinance No. 275 reads in caption as follows: ORDINANCE NO. 275 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, CLOSING THE HEARING ON SPECIAL ASSESSMENT AGAINST THE OWNERS OF CERTAIN REAL PROPERTY ABUTTING CERTAIN PORTIONS OF HALBERT DRIVE, WITHIN THE CITY OF PEARLAND, TEXAS; FINDING AND DETERMINING THE SPECIAL BENEFITS TO EACH PARCEL OF ABUTTING PROPERTY AND THE ENHANCEMENT OF VALUE OF EACH PARCEL OF ABUTTING PROPERTY BY REASON OF THE CONSTRUCTION OF IMPROVEMENTS TO SAID PORTIONS OF SAID PUBLIC STREETS; DECLARING THE AMOUNT OF ASSESSMENT AGAINST SAID ABUTTING PROPERTIES AND LEVYING SAME AGAINST SAID PROPERTIES; AND DECLARING AN EFFECTIVE DATE. It was moved by Councilman Farley, seconded by Councilman Reid that Ordinance No. 277 be passed and approved on first of two readings. Said Ordinance No. 277 reads in caption as follows: ORDINANCE NO. 277 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS PRESCRIBING RATES TO BE CHARGED FOR DISTRIBUTION AND SALE OF NATURAL GAS WITHIN THE CITY OF PEARLAND, TEXAS, AND REPEALING ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. It was moved by Councilman Sanders that Section 4 be stricken from the Ordinance. Motion died for lack of a second. It was moved by Councilman Sanders,=seconded.by Councilman Frank that Ordinance No. 277 be tabled until such time as the City Council is provided with a copy of Ordinance No. 15 Motion failed 4 to 1. Mayor McComb called for a vote on the original motion for passage of Ordinance No. 277. Voting "aye" - Councilman Farley-, Councilman Reid, Councilman Griffin, and Councilman Frank. Voting "no" - Councilman Sanders. Motion passed 4 to 1. Councilman Sanders stated for the record that he felt that the City the size of Pearland in regulating the utilities the size of Houston Natural Gas is like sending a man out to fight a bear with a switch. ORDINANCE NO. 278 -- AN ORDINANCE ESTABLISHING CERTAIN BUILDING LINES'FOR CERTAIN PUBLIC ROADWAYS IN THE CITY OF PEARLAND. Ordinance No. 278 read in full by Councilman Sanders. It was moved by Councilman Sanders, seconded by Councilman Frank that Ordinance No, 278 be tabled for corrections and be returned to the agenda for first reading at the next regular council meeting. ORDINANCE NO. 280 - AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, ESTABLISHING CHARGES FOR GARBAGE COLLECTION AND REPEALING ORDINANCE NO. 182: Ordinance No. 280 read in full by Mayor McComb. It was moved by Councilman Farley, seconded by Councilman Reid that Ordinance No, 280 be passed and approved as corrected on first of two readings. CALL OF PUBLIC HEARING ON REVENUE SHARING BUDGET FOR THE ENTITLEMENT -PERIOD `JULY, 1, 1974 THROUGH JUNE 30, 197: It was moved by Councilman Sanders, seconded by Councilman Griffin that the next regular meeting be changed to May 28, 1974 and that a Public Hearing on the Revenue Sharing Budget be called for this date at 7:30 P. M. in the Council Chambers of the City Hall. Notification of the change in meeting date and of the Public Hearing to be published in the official newspaper of the City. Motion passed 5 to 0. CHANGE IN MEETING DATE - FIRST MEETING IN JUNE: regular It was moved by Councilman Griffin, seconded by Councilman Reid that the first/meeting of the City Council in June be changed from June 10, 1974 to June 12, 1974, at 7130 P.
