TEXAS AVENUE, PEARLAND, TEXAS, BY THE CITY COUNCIL OF THE C1''TX OF PEARLANDj\TEXAS, The meeting was called to order with the following present: Mayor Pro Tem Councilman Councilman Councilman Cecil W. Griffin Harry -E. Farley Gene E. Sanders Tom Reid Councilman Benny J. Frank City Manager William E. Wolff City Attorney Bobby J. Williams Assistant City Secretary Dorothy a. Thompson Absent: Mayor Carlton McComb - City Secretary Dorothy Cook Others present: City Engineer Malcolm Collins, Earle Maxwell, Lettie Lee Anderko, Mrs. R. E. Foshee, Mr. and Mrs. E. Ballard, Mr. and Mrs. E. J. Mikulunko, Mr, and Mrs. Guy N. Bittick, and Jack Cotton. INVOCATION AND PLEDGE OF ALLEGIANCE The invocation was -given by Tom Reid. The Pledge of Allegiance was led by Bobby Williams. PURPOSE OF THE HEARING: Street Assessment Hearing against abutting property owners of a portion of the cost of improvements to Halbert Drive, from -the north right of way line of F. M. 518 (West Broadwayl-approximately 1,'248,75 feet northerly along the center line of Halbert Drive to the southright of way line of Cherry Street. STREET IMPROVEMENT COST DISTRIBUTION: Total Footage 1,248.25 Cost Per Property Foot $3.22 Property Footage Abutting Improvement 2,256.05 Owners Assessment Rate $2.00 Property Ownerls Cost $4,512,70 City's Cost Above Assessment $3,521.65 TESTIMONY ON BEHALF OF THE CITY: Malcolm Collins,. City Engineer. Total Construction Cost $8,033,75 Mr. Collins testified that the improvements have been completed in accordance with the specifications. Also, that the property owner's are paying less than 90% of the total cost of the improvements. The City's cost represented 43.8% and the property owners, both sides, represented 56.2%. Mr. Collins recommended that the improvements on Halbert Drive be accepted by the City, as completed. C. Earle Maxwell, Realtor. Mr. Maxwell testified that the improvements made on Halbert Drive had enhanced the value of the abutting property. He testified that the property abutting Halbert Drive would VA W an increased have ./market value to a sum greater than $2.00 per front foot by the improvement made to Halbert Drive. PROPERTY OWNER'$ TESTIMONY: Questions were asked of the City Council by citizens in the audience, however, no formal testimony was presented by the property owners. ORDINANCE NO. 275 - CLOSING HEARING ON HALBERT DRIVE: Ordinance No. 275 read in full by Mayor Pro Tem Griffin. It was moved by Councilman Farley, seconded by Councilman Reid that Ordinance No. 275 and Ordinance No. 276 be passed and approved on the first of three readings. Caption of Ordinance No. 275 reads as follows: ORDINANCE NO. 275 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, CLOSING THE HEARING ON SPECIAL ASSESSMENT AGAINST THE OWNERS OF CERTAIN REAL PROPERTY ABUTTING CERTAIN PORTIONS OF HALBERT DRIVE WITHIN THE CITY OF PEARLAND, TEXAS; FINDING AND DETERMINING THE SPECIAL BENEFITS TO EACH PARCEL OF ABUTTING PROPERTY AND THE ENHANCEen MENT OF VALUE OF EACH PARCEL OF ABUTTING PROPERTY` BY REASON OF THE CONSTRUCTION OF IMPROVEMENTSTO SAID PUBLIC STREETS; DECLARING THE AMOUNT OF ASSESSMENT AGAINST SAID ABUTTING PROPERTIES AND LEVYING SAME AGAINST SAID PROPERTIES, AND DECLARING AN EFFECTIVE DATE.
