1974-04-22 CITY COUNCIL REGULAR MEETING MINUTESMINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON APRIL 22, 1974, AT 7:35 P. M. IN THE CITY HALL, 2335 N. TEXAS AVENUE, PEARLAND, TEXAS. The meeting was called to order with the following present: Mayor Councilman Councilman Councilman Councilman Councilman City Manager City Attorney City Secretary INVOCATION AND PLEDGE OF ALLEGIANCE: Carlton McComb Cecil W. Griffin Harry E. Farley Gene E. Sanders Tom Reid Benny J. Frank William E. Wolff Bobby J. Williams Dorothy L. Cook The invocation was given by Rev. Joe David Saffle, minister of the Shadycrest Baptist Church. The Pledge of Allegiance was led by City Secretary Dorothy Cook. APPROVAL OF MINUTES: It was moved by Councilman Reid, seconded by Councilman Farley that the minutes -of the regular meeting held on April 8, 1974 be approved as submitted. Motion passed 5 to 0. It was moved by Councilman Sanders, seconded by Councilman Griffin that the minutes of a special meeting held on April 15, 1974, be approved as submitted, Motion passed 5 to 0. MAYOR'S ACTIVITY REPORT: Proclamation: Mayor McComb proclaimed May 1, 1974 as Loyalty Day in Pearland. Proclamation. was presented to Johnnie Hall, Commander of the V. F. W. here in Pearland. Action 13 - Marvin Zindler: Mayor McComb read a,letter from Marvin Zindler dated April 8, 1974 which enclosed a letter from Mrs. B. M. Jamison outlining several complaints against the City. Mayor McComb read his letter reply dated April 19, 1974 stating the City's position. Arden Hill's Application for Landfill: Mayor McComb advised that he received a Notice of Hearing on the Application of Arden Hill for a Class 3 Sanitary Landfill. This Hearing called by Maurice Davis, Hearing Examiner, for May 8, 1974. Mayor McComb advised that he had asked Mr. Wolff to find out exactly what a Class 3 Sanitary Landfill was. Mr. Wolff called Mr. John Watts of the Health Department in Rosenberg and he advised that r� a Class 3 Sanitary Landfill was not allowed in this area. The Council requested that the City Manager obtain a copy of the notice from the State to the County advising that a Crass 3 Landfill would not be permitted in this area. COUNCIL ACTIVITY REPORTS: Brazoria County Solid Waste Disposal Study: Councilman Griffin reported that Phase I of the Brazoria County Solid Waste Disposal Study has been completed. The Committee will meet Wednesday night, April 24, 1974, at the Court House and the Engineers will be present to answer any questions. Copy of Phase I of the Study presented for City records, Beautification: Councilman Reid requested that an Ordinance be prepared setting up a Beautification Committee and outlining the duties of the Committee. This Ordinance to be prepared by the City Attorney for submission to the City Council at the meeting to be held on May 13, 1974. Right -of -Way Coordinator: Councilman Sanders requested that an ordinance be prepared for submission to the City Council at the next regular meeting taking into consideration his recommendations and the Planning Commission's recommendations on building lines for various streets within the City of Pearland. DEPARTMENTAL REPORTS: None CITIZENS: Mr. Stephen C. Benckenstein, representing Frank Barringer presented a Petition for Annexation for 54.2755 acres of land in Brazoria County, Texas and described as part of Lot 9 and Lot 10, Section 5 of the H. T. & B. R. R. Company Survey, Abstract 237. It was moved by Councilman Farley, seconded by Councilman Frank that the City Council flay Fra k D. Barin er accept the petition for annexation into the records oY this meeting, Motion passed 5 to 0. Mayor McComb stated that he would call a short recess towards the end of the meeting so that the date-. for the Public Hearing could be worked out. DOCKETED PUBLIC HEARINGS: None REQUEST FOR RATE INCREASE - HOUSTON NATURAL GAS CORPORATION: Councilman Griffin reported that he and Councilman Farley met with representatives of the Houston Natural Gas Corporation on April 13, 1974, and reviewed their request and the rate making data with them. Additional information was requested from the Gas Company which has since been furnished. Councilman Griffin stated that he and Councilman Farley discussed the numbers today, reviewed them, and based on what was found that everything appears to be reasonable, the rate of return the Company is requesting, and the method used in establishing their rate base and requesting the increase as established by judicial decree.appears to be in order. (Rate of return requested 7.25%) Councilman Griffin advised the Council, that based on he and Councilman Farley's investigation, that the Houston Natural Gas Corporation be granted the rate increase requested. It was moved by Councilman Griffin, seconded by Councilman Farley that the necessary ordinance be drafted by the City Attorney for presentation at the next regular council meeting specifying the increase requested by the Houston Natural Gas Corporation. Motion passed 5 to 0. NEW BUSINESS: ELECTION OF A MAYOR PRO TEM: It was moved by Councilman Frank, seconded by Councilman Sanders that Cecil Griffin be elected Mayor Pro Tem. Motion passed 4 to 0. Councilman Griffin abstained. WN PLANNING COMMISSION MEMBERS: It was moved by Councilman Sanders, seconded by Councilman Reid that Dennis Frauenberger, Royce Bomar, and Richard Tetens�be reappointed to the Planning and Zoning Commission. Each to serve a three year term. Motion passed 5 to 0. Mayor McComb administered the Oath of Office to Dennis Frauenberger and Richard Tetens. Royce Bomar was out of town°on business and will be given the Oath at a later date. IMPERIAL ESTATES # 1 - MAINTENANCE COMMITTEE, ET AL VS HARRIS COUNTY, ET -AL -(CITY OF PEARLAND). Mayor McComb stated that he had received a Citation on a Suit styled Imperial Estates - #1 Maintenance Committee, et al vs Harris County, Texas, Galveston County, Texas, Brazoria County, Texas, The City of Pearland, and The City of Friendswood, Texas. The Plaintiffs in this suit contend that the various political subdivisions have diverted flood water;-. from its natural course into Clear Creek and authorized others to divert flood waters from its natural.course into Clear Creek causing flooding on the Plaintiffs' property -,or damaged it without paying just compensation. It was moved by Councilman Farley, seconded by Councilman Griffin that the City Attorney be instructed to file the appropriate answer to this petition. Motion passed 5 to 0. P. M. RECESS: - Recessed at 8:25 - Reconvened 8:30 P. M. PETITION FOR ANNEXATION - FRANK D. BARRINGER (CONTINUED): It was moved by Councilman Reid, seconded by Councilman Griffin that a public Rearing: be called under "Docketed Public Hearing" at the next regular Council meeting, May 13, 1974, at 7:30 P. M. to consider the annexation request by Frank D. Barringer, and that appropriate notices be published. Motion passed 5 to 0. ADJOURN: Meeting adjourned at 8:35 P. M.
