CITY COUNCIL REGULAR MEETING MINUTES
OCTOBER 13, 2025
The City Council of Pearland, Texas convened in a meeting on Monday, October 13, 2025 at
the Pearland City Hall Council Chambers, 3519 Liberty Drive, Pearland, Texas. The following
represents the actions taken by City Council in the order they occurred during the meeting. All
motions are made by Council in consecutive order, as determined by the Mayor.
I.CALL TO ORDER
Mayor J. Kevin Cole called the meeting to order at 6:37 p.m.
II.INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF
AMERICA FLAG AND TEXAS FLAG
Councilmember Cade gave the Invocation and Councilmember Koza led the Pledge of
Allegiance to the United States of America Flag and the Texas Flag.
III.ROLL CALL AND CERTIFICATION OF QUORUM

A.Consideration and Possible Action - Approval of the minutes of the
Pearland City Council and Planning and Zoning Joint Workshop held on
September 8, 2025, City Council Regular Meeting held on September 8,
2025, City Council and Planning and Zoning Joint Workshop held on
September 22, 2025, and City Council Regular Meeting held on
September 22, 2025.
B.Consideration and Possible Action - Excuse the absence of
Councilmember Tony Carbone from the September 22, 2025 City Council
Regular Meeting.
C.Consideration and Possible Action - Resolution No. R2025-167 - A

Resolution of the City Council of the City of Pearland, Texas, casting a
vote for a position on the Texas Municipal League (TML) Region 14 Board
of Directors.
D.Consideration and Possible Action - Second and Final Reading of
Ordinance No. 1652 - An Ordinance of the City Council of the City of
Pearland, Texas, establishing Seniority Pay-Lateral Entry for hiring police
officers with prior full-time paid law enforcement experience; setting
forth qualification criteria; providing a savings clause; providing for
severability and an effective date.
E.Consideration and Possible Action - Resolution No. R2025-169 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
a three-year contract (one (1) year initial term; two (2) one-year renewals)
with 65th North Group.,for professional services (internal control and
vulnerability assessment), in the estimated annual amount of
$149,800.00.
F.Consideration and Possible Action - Resolution No. R2025-168 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
participation in an interlocal cooperative pricing arrangement for the
purchase and installation of the Creekside Park Playground Replacement
Project, in the amount of $158,586.06, from Cunningham Recreation.
G.Consideration and Possible Action - Resolution No. R2025-163 - A
Resolution of the City Council of the City of Pearland, Texas, awarding a
3-year supply contract (1-year initial term; two 1-year renewals) for
Granular Activated Carbon Media Replacement to Calgon Carbon
Corporation, in the estimated amount of $213,600.00, for the period of
October 14, 2025 through October 13, 2026.
H.Consideration and Possible Action - Resolution No. R2025-162 - A
Resolution of the City Council of the City of Pearland, Texas, awarding a
construction services contract associated with the Wooten Road Lift
Station Decommissioning Project, to DVL Enterprises, LLC, in the
amount of $238,070.00.
Councilmember Koza made the motion, seconded by Councilmember Carbone
to approve the Consent Agenda items A-H.
AYES: Byrom, Koza, Carbone, Cade, and Fernandez.
NAYS: None.
The motion carried.
VI.MATTERS REMOVED FROM CONSENT AGENDA
There were no items removed from Consent Agenda.
VII.PUBLIC HEARING
1.Conduct a Public Hearing on the third public hearing for the FY 2026
Community Development Block Grant (CDBG) Annual Action Plan (HUD

Program Year 2025): CDBG Award No. B-25-MC-48-0400.
Mayor Cole opened the Public Hearing.
Presentation was provided by Joel Hardy, Head of External Affairs.
There were no citizen comments.
Mayor Cole closed the Public Hearing.
VIII.PUBLIC HEARING
2.Conduct a public hearing regarding an Ordinance of the City Council of
the City of Pearland, Texas, accepting and approving a Service and
Assessment Plan and Assessment Roll for the Smith Ranch Public
Improvement District No. 1; making a finding of special benefit to the
property in the District; levying special Assessments against property
within the District and establishing a lien on such property; providing for
the method of assessment and the payment of the Assessments in
accordance with Chapter 372, Texas Local Government Code, as
amended; providing penalties and interest on delinquent Assessments;
providing for severability; and providing an effective date.
Mayor Cole opened the Public Hearing.
Presentation was provided by Valerie Marvin, Vice President of Economic
Development Corporation.
Richard Atcheson spoke in support of the Public Improvement District.
Nick Motamedi, Owner with AIMAS Properties, LTD., spoke in support of the
Public Improvement District.
Timm Wooten, Associate with Rockefeller Group, spoke in support of the
Public Improvement District.
Mayor Cole closed the Public Hearing.
IX.NEW BUSINESS
1.Consideration and Possible Action - First Reading of Ordinance No. 1653
-An Ordinance of the City Council of the City of Pearland, Texas,
accepting and approving a Service and Assessment Plan and

2.Consideration and Possible Action - Resolution No. R2025-164 - A
Resolution of the City Council of the City of Pearland, Texas, nominating
candidate(s) for a position on the board of directors of the Brazoria
County Appraisal District.
Mayor Pro-Tem Byrom made the motion, seconded by Councilmember Cade
to approve Resolution No. R2025-164 and include Susan Spoor and Gail
Robinson as appointees to the Brazoria County Appraisal District Board of
Directors.
AYES: Byrom, Koza, Carbone, Cade, and Fernandez.
NAYS: None.
The motion carried.
3.Consideration and Possible Action - Resolution No. R2025-166 - A
Resolution of the City Council of the City of Pearland, Texas, nominating
a candidate for a position on the board of directors of the Fort Bend
County Appraisal District.
Councilmember Cade made the motion, seconded by Councilmember Koza to
approve Resolution No. R2025-166 and include Paul Stamatis Jr. and Pamiel
Gaskin as appointees to the Fort Bend County Appraisal District.
AYES: Byrom, Koza, Carbone, Cade, and Fernandez.
NAYS: None.
The motion carried.
4.Consideration and Possible Action - Resolution No. R2025-165 - A
Resolution of the City Council of the City of Pearland, Texas, nominating
a candidate for a position on the board of directors of the Harris Central
Appraisal District.
Councilmember Fernandez made the motion, seconded by Councilmember
Cade to approve Resolution No. R2025-165 and include Martina Lemond
Dixon and Melissa Noriega as appointees to the Harris Central Appraisal
District.
AYES: Byrom, Koza, Carbone, Cade, and Fernandez.
NAYS: None.

5.Consideration and Possible Action - First Reading of Ordinance No. 528-
11 - An Ordinance of the City Council of the City of Pearland, Texas
amending Chapter 6, Animals, of the City of Pearland Code of
Ordinances, as it may have been amended from time to time; having a
savings clause; severability clause; having a repealer clause; providing
for codification; and providing an effective date and for publication.
THIS ITEM HAS BEEN PULLED FROM THE AGENDA.
6.Consideration and Possible Action - Resolution No. R2025-178 - A
Resolution of the City Council of the City of Pearland, Texas, declaring
intention to reimburse project expenditures from proceeds of future tax-
exempt obligations.
Councilmember Koza made the motion, seconded by Councilmember
Fernandez to approve Resolution No. R2025-178.
AYES: Byrom, Koza, Carbone, Cade, and Fernandez.
NAYS: None.

7.Consideration and Possible Action - Resolution No. R2025-103 - A
Resolution of the City Council of the City of Pearland, Texas, awarding a
construction services contract associated with the Sherwood Street
Reconstruction and Waterline Replacement Project, to Environmental
Allies, LLC, in the amount of $ 9,546,938.00.
Councilmember Carbone made the motion, seconded by Councilmember Cade
to approve Resolution No. R2025-103.
Joe Bryant, Attorney representing Ballast Point Construction, spoke in
opposition to the bidding process for this item.
Stephen Ray, Principal with Cobb Fendley, spoke regarding the bidding
process of this item.
Steven Hamilton, Director of Purchasing with Environmental Allies, LLC. and
Rodolfo Serrano, Operations Manager with Environmental Allies, LLC., were
present, to answer questions from Council.
AYES: Byrom, Koza, Carbone, and Fernandez.
NAYS: Cade.

8.Consideration and Possible Action - Resolution No. R2025-160 - A
Resolution of the City Council of the City of Pearland, Texas, awarding a
construction services contract associated with Intersection
Improvements (Dixie Farm Road at Hastings Friendswood Road), to
MetroCity, LLP, in the amount of $612,147.00.

Fernandez to approve Resolution No. R2025-160.

9.Consideration and Possible Action - Resolution No. R2025-161 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
participation in an interlocal cooperative pricing arrangement for the
purchase of synthetic turf retrofitting services (Sports Complex at
Shadow Creek Ranch) from Paragon Sports Contractors, LLC, in the
amount of $2,263,183.00.
Councilmember Cade made the motion, seconded by Councilmember Koza to
approve Resolution No. R2025-161.
AYES: Byrom, Koza, Carbone, Cade, and Fernandez.
NAYS: None.

10.Consideration and Possible Action - Resolution No. R2025-170 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to participate in an interlocal
cooperative pricing arrangement for the purchase of personal fire
protection equipment (self-contained breathing apparatus), in the amount
of $910,932.00, from Metro Fire Apparatus Specialists, Inc.
Councilmember Fernandez made the motion, seconded by Councilmember
Koza to approve Resolution No. R2025-170.
AYES: Byrom, Koza, Carbone, Cade, and Fernandez.
NAYS: None.
The motion carried.
11.Consideration and Possible Action - Resolution No. R2025-176 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to enter into a Reimbursement
Agreement between the City and the Pearland Economic Development
Corporation and authorizing a Letter Finance Agreement with the Lower
Kirby Pearland Management District associated with the Kirby North Lift
Station Expansion Project.
Councilmember Koza made the motion, seconded by Councilmember Cade to
approve Resolution No. R2025-176.
AYES: Byrom, Koza, Carbone, Cade, and Fernandez.
NAYS: None.

2.Council Discussion - Regarding Short Term Rental regulations; including
an update on current regulations; and potential regulatory amendments.
