IN THE CITY COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS The meeting was called to order at 7:30 p.m. with the following present: Presiding Chairman Board Member Board Member Board Member Board Member Chief Building Official Asst. to City Secretary CONDEMNATION HEARING Ronald Parker William Miller Lloyd Kern William T. McClelland Jerry Acosta Don Guynes Sharon Parks REQUEST OF MR. AND MRS. CLIFFORD KLIESING, OWNERS, FOR A CONDEMNATION HEARING ON PROPERTY LOCATED AT 2411 SOUTH HOUSTON, PEARLAND, TEXAS. Chief Building Official Don Guynes stated that Mr. and Mrs. Kliesing were not present, but the City received a letter from their lawyer stating that Mr. and Mrs. Kliesing agree to raze the house if they are given 90 days. Mr. Guynes stated he and the Fire Marshall agreed with the proposal. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST: NONE. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST: NONE A brief discussion followed regarding rebuilding the residence, maintaining the pool, fencing around the pool, and whether or not anyone is living in the house. Presiding Chairman read the following letter from Mr. and Mrs. Kliesing's attorney, Victor Sturm, into the record: 1 September 23, 1993 Don E. Guynes City of Pearland P.O. Box 2068 Pearland, Texas 77588-2068 Re: Clifford and Mary Kliesing, 2411 South Houston, Pearland, Texas Dear Mr. Guynes: This will confirm the agreement between Clifford Kliesing and Mary Kliesing and the City of Pearland with regards to the residential structure on the property described above. Mr. and Mrs. Kliesing will move the Bluebird motorhome and the dumptruck by Friday, September 24, 1993. They will demolish the entire house and remove all debris within 90 days. They will at all times keep the pool fenced and maintained as required by city ordinance. The City of Pearland will take no further enforcement action, regarding the razing of the residence at 2411 S. Houston Street, Pearland, Texas 77581 so long as Mr. and Mrs. Kliesing live up to the terms of this agreement. Please advise me if this letter does not accurately reflect the terms of the agreement. Very truly yours, Victor A. Sturm The Board inquired as to the recommendation of the City. Mr. Guynes stated that the City recommends acceptance of the letter as a binding agreement. Board member Bill Miller made the motion, seconded by Board member Lloyd Kern, to accept the City's recommendation on the proposed request. Motion passed 5 to 0.
