HomeMy WebLinkAbout1992-06-23 ANIMAL CONTROL BOARD MEETING AGENDAMINUTES OF A PUBLIC HEARING OF THE ANIMAL CONTROL BOARD OF THE CITY OF PEARLAND, HELD ON JUNE 23, 1992, AT 6:30 P.M. IN THE MUNICIPAL COURTROOM OF THE PUBLIC SAFETY BUILDING, 2703 VETERANS DRIVE, PEARLAND, TEXAS. The heariny was called to order with the followiny present: Dr. Bobby Stevener Member Ben Pinales Member Bill Pratt Member Susan Elam Member Renee Monceaux Animal Control Officer Tommie Jean Vial Assistant City Secretary Absent trom the Hearing: Parris Curry, Member Others present: Ms. Pauline Duke, owner of the animal. PuiwuSE OF TrIE HEARING Dr. Stevener advised that the purpose ot the nearing tonight was to decide whether or not Ms. Duke's dog should be classified as a "danyerous aoy" . He requested that Renee Monceaux, Animal Control Otticer, give the history ot the animal. Ms. Monceaux produced records showiny where two citations were issued, one in December, 1991 (tor dog bite and aoy runniny at large) and the other issued on April 8, 1992 (tor dog running at larye). She advised that she issued a third citation on June 2, 1992 (tor dog bite and dog running at larye), but she was advised by the Police Department not to serve this citation because ot conflictiny with State law. Ms. Monceaux further advised that she had discussed this with Ms. Duke who has indicated she would remove the dog trom the City limits and pay the tine; however, Ms. Duke was advised that she would have to secure liability insurance in the amount ot $100,000, which is required by State law. Recently passed legislation requires that a person owniny a dog that is classified as a danyerous doy to register the dog, keep the dog restrained or in a secure enclosure, and obtain liability insurance coverage ot $100,000_ Also, that the aog must be reyistered within 3u days after being notified ot its being classified as a danyerous aoy, and the fee for reyistration is set at $50.00. Also, if the owner of a reyistered danyerous doy sells or moves the Cog to a new location, the new aactress and/or owner must be reported to the animal control authority in which the new address is located within 14 days after the date of the sale or move. Atter a briet discussion, the following motion was made. It was moved by Member Ben Finales, seconded by Member Susan Elam that the dog belonging to Ms. Jackie Duke be classitiet as a dangerous doy. Voting "Aye" - Members Stevener, Penales and Elam Votiny "No" - None Motion passed 3 to 0. Member Pratt abstaining. It was Pointed out that she could appeal this decision of she so wished. Also, it was reyuestea that Renee seek additional leyal yu=dance and so advise Ms. Duke, since she lett the hearing betore it was concluded.
