HomeMy WebLinkAbout1992-11-17 ANIMAL CONTROL BOARD MEETING AGENDAMINUTES OF THE MEETING OF THE ANIMAL CONTROL BOARD IN THE CITY OF PEARLAND, HELD ON NOVEMBER 17, 1992, AT 6:00 P.M. IN THE MUNICIPAL COURTROOM OF THE PUBLIC SAFETY BUILDING, 27u3 vETERANS DR1vE, PEARLAND, TEXAS_ The meetiny was called to order with the following present: Dr. Bobby Stevener Board Chairman Parris Curry Board Member Ben Finales Board Member Susan Elam Board Member Renee Monceaux Animal Control Officer Tommie Jean Vial Assistant City Secretary Absent from tne Meeting: Board Member Bill Pratt Others present: City Attorney Lester Rur.iuk and Eddie Boudreaux, Animal control otticer. APPROVAL OF MINUTES It was moved by Member Curry, seconded by Member Finales that the Minutes of the October 20, 1992 meetiny be approved as presented. Motion passed 3 to 0, with Member Elam abstaining. REVIEW OF ANIMAL CONTROL ORDINANCE Chairman Stevener explained there was a need for the board to review the sections of the Animal Control Ordinance concerning it and when a cloy shall be tattooed and the definition of "at large". Chairman Stevener said tnat under the present ordinance it states that a dog shall be considered "at large" it it on a chain or on a leash, but not enclosed in an enclosure on the owner's property. However, the ordinance doesn't make a statement about being loose on the owner's property_ Chairman Stevener turther stated that aIsu under the present ordinance, any animal that bites, scratches or otherwise attacks any person or other annual while off the premises of the owner shall be marked with a tattoo, containiny an identificatiull number corresponding to records maintained by the department of such animal_ He said the Board would like the ordinance to include an anima on tne premises, but at large on the premises, to be tattooed in a serious bite case. City Attorney Rorick advised the Board of their options. Thereafter, a lenythy discussion ensued, covering such areas as amendiny Section 6-6 to include an annual at larye but on the owner's premises; redefine "at large" and "direct physical control"; research the question of enforcing State law versus the City ordinance; and research the issue on liability insurance when the animal is moved out of the county. In conclusion, it was determined that the city Attorney would research the requested ordinance changes and forward the proposed amendments to the Board tor their perusal. Thereafter, a meetiny of the Board and Police chief, would be held to review and approve the amendments prior to submittal to the City Council tor their approval. ADJOURN It was moved by Member Pinales, seconded by Member Curry to adjourn. Motion passed 4 to 0. Meeting adjourned at 7:05 p.m. Minutes approved and/or corrected this day of A. D., 1992.
