CALL TO ORDER
Chairperson Derrell Isenberg opened the meeting for the Planning and Zoning Regular Meeting at
6:32 P.M.
In attendance were:

CONSENT AGENDA
All items listed under the "Consent Agenda" are considered to be routine and require little or no
deliberation by the Planning and Zoning Commission. These items will be enacted /approved by
one motion unless a commissioner requests separate action on an item, in which event the item
will be removed from the Consent Agenda and considered by separate action (ix. Matters
removed from Consent Agenda). Approval of the Consent Agenda enacts the items of legislation.
Consideration and Possible Action - Excused Absences - Excuse the absence of
Commissioner Henry Fuertes and Commissioner John McDonald from October 6, 2025, P&Z
Regular Meeting.
Consideration and Possible Action -Approval of Minutes -Approve the P&Z Regular Meeting
minutes from October 6, 2025.
Consideration and Possible Action - CPL2025-0335: Replat of Sri Meenakashi Temple No 2
A request by Joyce Owens, of Owens Management Systems, LLC, the applicant; on behalf of the
SRI Meenakashi Temple Society, owner; for approval of the Replat of Sri Meenakashi Temple No
2, creating one lot on 23.46 acres of land.
Legal Description: A subdivision of 23.6035 acres of land being Lot 1, Block 1, Sri Meenakashi
Temple as recorded in Document No 2023039669 of the Official Public Records of Brazoria
County, Texas and being a 5.50-acre tract of land, as Lot 46 of the Allison-Richey Company's
Subdivision of Section 25 in the H.T.&B.R.R. Company Survey, Abstract 245, according to the
map or records in Volume 2, Page 10, Brazoria County, Texas.
General Location: West side of McLean Road, East side of Berry Road, south of Amie Lane
within the Pearland ETJ, Brazoria County Texas.
Consideration and Possible Action - CPL2025-0439: Final Plat of Levey Lane Street
Dedication
A request by Patrick Lane, of LJA, the applicant; on behalf of the City of Pearland, owner; for
approval of the Final Plat of Levey Lane Street Dedication, dedicating a generally 75 to 80-foot-
wide section of street right of way for Levey Lane on 0.606 acres of land from the Beltway 8
ending in a cul-de-sac.
Legal Description: A subdivision of 0.606 acres of land situated in the James Hamilton Survey,
Abstract 876, and the Richard T Blackburn Survey, Abstract 160, City of Pearland, Harris County,
Texas.
General Location: South of Beltway 8 and East of Almeda School Road, Pearland, Texas.
Commissioner Isenberg called for a motion to approve the Consent Agenda. Commissioner
Echols made a motion to approve the Consent Agenda with the removal of Item E, and
Commissioner Henrichs seconded the motion.
Motion passed 5-0.
ITEMS REMOVED FROM THE CONSENT AGENDA
Consideration and Possible Action - RPL2025-0471: Final Plat of Massey Oaks Section 4
A request by RG Miller Engineers Inc., applicant; on behalf of Castle Rock Communities, LLC and
Meritage Homes of Texas LLC, owners; for approval of the Final Plat of Massey Oaks Section 4,
creating 69 single-family lots, 2 reserves, and 3 blocks on 18.3863 acres of land located south of
Old Massey Ranch Road.
Legal Description: A subdivision of 18.3863 acres of land located in the H. Stevens survey, A-
593, City of Pearland, Brazoria County, Texas.
General Location: West of Harkey Road and South of Old Massey Ranch Road, Pearland,
Texas.
The final Plat of Massey Oaks Section 4 was removed from the consent agenda due to conflicts of
interest declared by two Planning and Zoning Commissioners.
Deputy City Attorney Provens advised tabling Item E to the end of the agenda to confirm the
conflicts of interest. Commissioner Echols made the motion to table item E to the end of the
agenda, and Commissioner Fuertes seconded the motion.
Motion passed 5-0.
NEW BUSINESS
Chairperson Isenberg read into the record the item on Consideration and Possible Action —
RPL2025-0393: Residential Replat of McGinnis Subdivision Lot 1 Block 2.

Subdivision Lot 1 Block 2
Public Hearing: A request by David Hernandez, Windrose Services, applicant, on behalf of Jesus
Enrique Morales & Marie Elizabeth Morales, owners, for approval of the McGinnis Subdivision Lot
1 Block 2 Replat, creating 2 lots on 1.025 acres of land, to wit:
Legal Description: A tract or parcel containing 1.025 acres of land being all of Lot 1, Block 2,
McGinnis Subdivision, according to the map or plat thereof recorded under Volume 8, Pages 7-8,
Brazoria County Map Records.
General Location: 2419 Creekridge Drive, Pearland, Texas.
Senior Planner Bauer presented the staff report with exhibits and explained that the request was
for approval of a residential replat to create two lots within the McGinnis Subdivision. Mr. Bauer
reviewed the Single Family Residential-1 (R-1) District minimum lot size regulations and noted that
staff received twenty-four written comments and one phone call in opposition, along with one
phone call requesting additional information. He stated that the replat meets the approval criteria
outlined in the Unified Development Code (UDC) and recommended approval.
Applicant Jesus Morales, 2419 Creekridge Drive, Pearland, Texas 77581, was present in person
in Council Chambers to present to the Planning and Zoning Commission. Mr. Nguyen discussed
the intended use of the property.
Chairperson Isenberg called for public input.
There were no persons wishing to speak for or against the proposed request.
Commission discussion focused on the Commission's role regarding public opposition to
residential replats.
There was no further discussion from Staff, Planning and Zoning Commission, or public input.
Chairperson Isenberg read into the record the item on Consideration and Possible Action —
RPL2025-0393: Residential Replat of McGinnis Subdivision Lot 1 Block 2. Vice Chairperson
Ordeneaux made a motion to approve the replat, and Commissioner Henrichs seconded the
motion.
Motion passed 5-0.

Conditional Use Permit Application: CUP2025-0432.

Public Hearing: A request by Hamad Elsaadi, applicant, on behalf of 2011 Property, Inc., owner,
for approval of a Conditional Use Permit (CUP)for Food Store/Supermarket use within
the Neighborhood Service (NS) District, on 0.8199 acres of land, to wit:
Legal Description: Being a tract or parcel containing 0.8199 acre (35,718 square feet) of land
situated in the W.D.C. Hall Leage, Abstract Number 70, Brazoria County, Texas; being all
of a called 0.613 acre tract of record in the name of 2011 Property, Inc., in Brazoria
County Clerk's File (B.C.C.F.) Number 2024035106 and all of a called 0.2673 acre tract of
record in the name of 2011 Property, Inc., in B.C.C.F. Number 2024045816; Saif 0.8199
acre tract also being out of and a part of Commercial Reserve in Vie Villa, a subdivision
duly of record in Volume 14, Page 60, in the Plat of Records of Brazoria County
(B.C.P.R.), Texas.
General Location: Northwest corner of Yost Boulevard and Broadway Street, Pearland, Texas.
Senior Planner Peterson presented the staff report with exhibits and explained that the request
was for approval of a Conditional Use Permit (CUP) to allow a proposed specialty grocery store
located in the Neighborhood Services (NS) District and the Corridor Overlay District (COD). She
noted that staff received nineteen public comments and one phone call in favor of the request,
reviewed the property history, and outlined the site plan. Ms. Peterson stated that the proposal
met the COD regulations and the criteria outlined in the Unified Development Code (UDC) and
recommended approval with the following condition:
1. The exterior lights shall be located so as not to produce any direct illumination across the
bounding property line. All outside lights shall be comprised of a light source and reflector
or shield so that, acting together, spillover is controlled and no light will be produced
across the property line.
Applicant, Janice Wagner, 22910 Wren Lane, Tomball, Texas 77377, was present in person in
Council Chambers to present the details of the proposed development, the site plan, and
surrounding commercial uses.
Chairperson Isenberg called for public input.
Resident Linda Fertitta, 2101 Roland Rue Street, Pearland, Texas 77581, spoke in opposition,
expressing concerns regarding trash, parking, flooding, and property values.
Resident William Schulze, 2113 Roland Rue Street, Pearland, Texas 77581, spoke in opposition,
citing safety issues, traffic impacts, and the availability of other suitable sites in Pearland.
Discussion among the Planning and Zoning Commissioners focused on the surrounding land
uses, site development requirements, and the location of trash containers.
There was no further discussion from Staff, Planning and Zoning Commission, or public input.
Chairperson Isenberg read into the record the item on Consideration and Possible Action —
Conditional Use Permit Application: CUP2025-0432. Commissioner Fuertes made the motion to
approve the CUP and Commissioner Henrichs seconded the motion.
Commissioner Echols made the motion to amend the approval to include staff's condition, and
Commissioner Henrichs seconded the motion.
The motion to amend passed 5-0.
Chairperson Isenberg called for a vote on the amended motion.

Chairperson Isenberg read into the record the item on Consideration and Possible Action —
CLU2025-0435— Cluster Development Plan to Propose 81 Single-family Detached Homes and 8
Restricted Reserves on 23.9 Acres of Land.

Public Hearing: A request by CE Engineers & Development Consultants, Inc., on behalf of the
owners, Tom Nguyen, Keith Byers and Sherri Byers, for approval of a Cluster Plan at
O'Day Road and Garden Road, creating 81 single-family lots and eight (8) restricted
reserves on 23.09 acres of land within the Single-Family Residential-1 (R-1) and
Garden/O'Day Mixed Use (G/O-MU)zoning districts.
Legal Description: Being 23.0984 acres of land (1,006,167 square feet), situated in the H.T. &
B. R.R. Co. Survey, Abstract No. 219, Brazoria County, Texas, and a portion of that
certain called Lots 6, 7 and 8, of Allison-Richey Gulf Coast Home Company's Part of
Suburban Gardens, Section 7, a subdivision according to the map or plat thereof recorded
in Volume 725, Page 93, of the Brazoria County Deed Records, same being comprised of
all of that certain called 0.8029 acre tract of land conveyed to Keith Byers, by deed

Senior Planner Peterson presented the staff report with exhibits and explained that the request
was for approval of a Cluster Development Plan to create eighty-one single-family lots and eight
restricted reserves. She noted that no public comments were received in favor of or opposition to
the request. Ms. Peterson reviewed the property history, outlined the proposed amenities, and
stated that the plan meets the criteria of the Unified Development Code (UDC). Staff
recommended approval.
Applicant Fazeel Lakhani, 14 Crown Grove Lane, Sugar Land, Texas 77498, was present in
person in Council Chambers to present the proposed development, noting that the homes would
be high quality and would enhance the image of the city.
Chairperson Isenberg called for public input.
There were no persons wishing to speak for or against the proposed request.
Commission discussion focused on the development layout and home pricing. Commissioner
Henrichs expressed concern about high home prices but acknowledged the need for additional
housing in Pearland. Commissioner Echols inquired whether the homes would be for sale or rent.
The applicant confirmed the homes would be for sale and that a Homeowners Association would
maintain the neighborhood amenities.
Chairperson Isenberg read into the record the item on Consideration and Possible Action —
CLU2025-0435—Cluster Development Plan to Propose 81 Single-family Detached Homes and 8
Restricted Reserves on 23.9 Acres of Land. Commissioner Henrichs made the motion to approve
the Cluster Development Plan, and Commissioner Fuertes seconded the motion.
Motion passed 5-0.
Vice Chairperson Ordeneaux recused herself and left the meeting at 7:57 pm.
Chairperson Isenberg called for a motion to approve Item E on the Consent Agenda.
Commissioner Echols made a motion to approve item E, and Commissioner Henrichs seconded
the motion.
Motion passed 4-0.
Vice Chairperson Ordeneaux returned to the meeting at 7:58 pm.
DISCUSSION ITEMS
1. City Council Update Report: Deputy Director Griggs reported that at the October 13,
2025, City Council meeting, there were no Planning and Zoning items for
consideration.
2. Next Planning and Zoning Regular Meeting: November 3, 2025
ADJOURNMENT
