HomeMy WebLinkAbout20251006 Planning and Zoning Commission Regular Meeting MinutesMINUTES OF THE REGULAR MEETING HELD IN -PERSON BY THE PLANNNG AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, MONDAY, OCTOBER 6, 2025, AT 6:30 PM IN COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DR., SUITE 350 CALL TO ORDER Chairperson Derrell Isenberg opened the meeting for the Planning and Zoning Regular Meeting at 6:30 P.M. In attendance were: P&Z Chairperson Derrell Isenberg P&Z Vice Chairperson Jenifer Ordeneaux P&Z Commissioner Thomas Echols P&Z Commissioner Trey Haskins P&Z Commissioner Jennifer Henrichs Also, present were Deputy City Attorney Lawrence Provins, Assistant City Attorney Katie Leiniger, Assistant Engineer Francisco Reyes, Community Development Deputy Director Martin Griggs, Planning Manager Katya Copeland, Senior Planner Patrick Bauer, and Business Administrator Jennifer Danley. CONSENT AGENDA All items listed under the "Consent Agenda" are considered to be routine and require little or no deliberation by the Planning and Zoning Commission. These items will be enacted / approved by one motion unless a commissioner requests separate action on an item, in which event the item will be removed from the Consent Agenda and considered by separate action (ix. Matters removed from Consent Agenda). Approval of the Consent Agenda enacts the items of legislation. Consideration and Possible Action - Excused Absences - Excuse the absence of Commissioner John McDonald from the September 2, 2025, P&Z Regular Meeting. Consideration and Possible Action - Approval of Minutes - Approve the P&Z Regular Meeting minutes from September 2, 2025. Chairperson Isenberg asked for the motion to approve the Consent Agenda. Commissioner Echols made the motion to approve the Consent Agenda and Commissioner Henrichs seconded the motion. Motion passed 5-0. ITEMS REMOVED FROM THE CONSENT AGENDA None NEW BUSINESS Chairperson Isenberg read into the record the item on Consideration and Possible Action — Zone Change Application: ZON2025-0387. Consideration and Possible Action - Zone Change Application: ZON2025-0387 Public Hearing: A request by Julia Nguyen, applicant, on behalf of TJMA Revocable Living Trust and Chin -Yang Chou, owners, for approval of a zone change for approximately 9.2281 acres of land from Single -Family Residential -1 (R-1) District to Neighborhood Service (NS) District, to wit: Legal Description: Tract 1: A tract containing 2.7555 acres of land, more or less, out of the northeast 1/2 of Lot 17, of the George W. Jenkins Subdivision of the lower 1/4 of the W.D.C. Hall League, Abstract 70, Brazoria County, Texas; Tract 2: A tract containing 1.9026 acres of land, more or less, out of the northeast 1/2 of Lot 17, of the George W. Jenkins Subdivision of the lower 1/4 of the W.D.C. Hall League, Abstract 70, Brazoria County, Texas; Tract 3: A 4.57 -acre tract of land out of the southwest 1/2 of Lot 17 of the George W. Jenkins Subdivision of the W.D.C. Hall Survey, Abstract 70, Brazoria County, Texas, according to the recorded plat thereof in Volume 79, Page 616 of the Deed Records of Brazoria County, Texas. General Location: 3302 & 3306 Dixie Farm Road Pearland, Texas. Senior Planner Bauer presented the staff report with exhibits and explained that the request is for approval of a zone change from Single -Family Residential -1 (R-1) District to Neighborhood Services (NS) District. Mr. Bauer noted that staff received seven written comments in opposition to the request, briefly discussed the surrounding property uses and the history of the property and stated that the zone change met three of the four approval criteria outlined in the Unified Development Code (UDC). Staff recommended approval of the request. Applicant Julia Nguyen, 4714 Orchard Creek Lane, Manvel, Texas 77878, was present in person in Council Chambers to present to the Planning and Zoning Board. Ms. Nguyen discussed the commercial business benefits, property characteristics, and addressed concerns regarding traffic, noise, and environmental concerns. Landowner Alex Nguyen, 3302 Dixie Farm Road, Pearland, Texas 77581, was present in person in Council Chambers to present to the Planning and Zoning Board. Mr. Nguyen discussed the positive impacts of the zone change and the potential NS District business that could be developed on the property. Landowner Ching-Yan Chou, 5127 Lymbar Drive, Houston, Texas 77096, was present in person in Council Chambers to present to the Planning and Zoning Board. Mr. Chou discussed the original intent for the property and the concerns of surrounding residents. Chairperson Isenberg called for public input. Resident Greg Nelson, 1617 Pine Crest Drive, Pearland, Texas 77581, opposed the zone change, noting the numerous commercial businesses allowed in the Neighborhood Services District would negatively impact adjacent residential properties. Resident Randell Tackett, 3303 Windcrest Court, Pearland, Texas 77581, opposed the zone change, noting that the area is heavily established with commercial properties that contribute to traffic congestion. Resident Diane Leaverton, 2310 Buckholt Street, Pearland, Texas 77581, opposed the zone change, citing existing vacancies in nearby commercial strip centers along Broadway Street and ongoing residential development along Dixie Farm Road. Discussion amongst Planning and Zoning Commissioners focused on the development challenges of the parcel, the limitations and flexibility of uses within the NS District, and potential consideration for a Conditional Use Permit (CUP). Chairperson Isenberg noted that it would have been preferable to review a drainage plan and a site plan for the proposed commercial development. There was no further discussion from Staff, Planning and Zoning Commission, or public input. Chairperson Isenberg read into the record the item on Consideration and Possible Action — Zone Change Application: ZON2025-0387. Commissioner Haskins made a motion to approve the zone change, and Vice Chairperson Ordeneaux seconded the motion. Motion failed 1-4. DISCUSSION ITEMS 1. City Council Update Report: Deputy Director Griggs reported that at the September 22, 2025, City Council meeting, the Council approved CUP2025-0366 for the expansion of a warehouse located at 14525 Kirby Drive. Mr. Griggs also reported that Council approved CUP2025-0334 for an Accessory Dwelling Unit use located at 3637 Wingtail Way. He noted that the Council failed to approve CUP2025-0318 for a Recreation Center use within the Garden -O'Day Mixed Use District located on O'Day Road and postponed consideration of CUP2025-0343 for four two-family use dwelling units within the Old Town -Mixed Use District located on Grand Boulevard. Mr. Griggs further noted that Council approved, with conditions, CUP2025-0285 for a Chemical Packaging/Blending use within the Light Industrial District located at 4902 Shank Road. 2. 2026 Planning and Zoning Submittal Calendar: Planning Manager Copeland reviewed the 2026 Planning and Zoning Submittal Calendars and noted the dates that were adjusted for city observed holidays. 3. Next Planning and Zoning Regular Meeting: October 20, 2025 ADJOURNMENT Chairperson Isenberg adjourned the Planning and Zoning Regular meeting at 7:31 PM.
