The following represents the actions taken by City Council in the order they occurred during the meeting. All motions are made by Council in consecutive order, as determined by the Mayor. I. CALL TO ORDER Mayor J. Kevin Cole called the meeting to order at 6:33 p.m. II. INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF AMERICA FLAG AND TEXAS FLAG Mayor Pro-Tem Byrom gave the Invocation and Councilmember Fernandez led the Pledge of Allegiance to the United States of America Flag and the Texas Flag. III. ROLL CALL AND CERTIFICATION OF QUORUM Mayor J. IV. CITIZEN COMMENTS Dina Abdelhalim expressed concern regarding conflict in Palestine and spoke in favor of a ceasefire resolution. V. CONSENT AGENDA A. Consideration and Possible Action - Excuse the absence of Councilmember Joseph Koza from the September 8, 2025 City Council Meeting. B. Consideration and Possible Action - Resolution No. R2025-151 - A Resolution of the City Council of the City of Pearland, Texas, expressing support for the Phase II, Lower Clear Creek and Dickinson Bayou Watershed 203 Feasibility Study, to culminate with the creation of a list of projects and funding options to address flooding and its devastating impacts. D. Consideration and Possible Action - Resolution No. R2025-148 - A Resolution of the City Council of the City of Pearland, Texas, amending the City's Comprehensive Financial Management Policy Statement. THIS ITEM HAS BEEN PULLED FROM THE AGENDA. E. Consideration and Possible Action - Resolution No. R2025-147 - A Resolution of the City Council of the City of Pearland, Texas, adopting an Amended Investment Policy, Investment Strategy, and approved Brokers in accordance with Chapter 2256 of the Government Code ("Public Funds Investment Act"). THIS ITEM HAS BEEN PULLED FROM THE AGENDA. F. Consideration and Possible Action - Resolution No. R2025-157 - A Resolution of the City Council of the City of Pearland, Texas, awarding a unit supply contract for pavement marking services to Lone Star Pavement Services, Inc., in the estimated amount of $310,000.00, for the period of September 23, 2025 through September 22, 2026. G. Consideration and Possible Action - Resolution No. R2025-132 - A Resolution of the City Council of the City of Pearland, Texas, amending a interlocal cooperative purchase contract with Siddons Martin Emergency Group, for fire apparatus preventative maintenance and repair services, in the additional amount of $250,100.00 (total contract of $800,000.00). H. Consideration and Possible Action - Resolution No. R2025-152 - A Resolution of the City Council of the City of Pearland, Texas, renewing a Software Maintenance Contract with Central Square Technologies, in the amount of $343,363.62, for the period of October 1, 2025 through September 30, 2026. Councilmember Koza made the motion, seconded by Councilmember Cade to approve the Consent Agenda items A - H, except for D and E. AYES: Byrom, Koza, Chavarria, Cade, Fernandez, and Patel. NAYS: None. The motion carried. VI. MATTERS REMOVED FROM CONSENT AGENDA There were no items removed from Consent Agenda. VII. PUBLIC HEARING NO. 1 1. Public Hearing on the FY26 Proposed City Property Tax Rate. Mayor Cole opened the Public Hearing. Jonette Sheridan spoke in opposition of the proposed tax rate increase. Mayor Cole closed the Public Hearing. VIII. NEW BUSINESS 1. Consideration and Possible Action - Second and Final Reading of Ordinance No. 1650 - An appropriation Ordinance adopting a budget for the fiscal year beginning October 1, 2025, and ending September 30, 2026; pay plans for fiscal year 2025-2026; and, pursuant to Local Government Code, Section 102.007, providing for a separate ratification vote of the property tax revenue increase reflected in the budget. Councilmember Chavarria made the motion, seconded by Mayor Pro-Tem Byrom to approve the second and final reading of Ordinance No. 1650. Veronica Longoria spoke in opposition to the proposed tax rate increase. AYES: Byrom, Koza, Chavarria, and Fernandez. NAYS: Cade and Patel. The motion carried. Councilmember Chavarria made the motion, seconded by Mayor Pro-Tem Byrom to approve second and final reading of Ordinance No. 1650 and stated, "providing for a separate ratification vote of the property tax revenue increase reflected in the budget." AYES: Byrom, Koza, Chavarria, and Fernandez. NAYS: Cade and Patel. The motion carried. 2. Consideration and Possible Action - Second and Final Reading of Ordinance No. 1651 - An Ordinance adopting a tax rate of $0.6300 and levying taxes for the use and support of the Municipal Government of the City of Pearland, Texas, and providing for the interest and sinking fund of the taxable year 2025. Councilmember Chavarria made the motion, seconded by Mayor Pro-Tem Byrom to approve the second and final reading of Ordinance No. 1651. AYES: Byrom, Koza, Chavarria, and Fernandez. NAYS: Cade and Patel. The motion carried. AYES: Byrom, Koza, Chavarria, Cade, and Fernandez. NAYS: Patel. The motion carried. IX. PUBLIC HEARING NO. 2 2. Public Hearing: A request by Genesis Property Development, applicant, on behalf of Endress Hauser, Inc., owner, for approval of a Conditional Use Permit (CUP) for an expansion to an existing development for a Warehouse & Light Assembly use within the Beltway District of the Clear Creek Spectrum Planned Development, on approximately 16.921 acres, to wit: Legal Description: Lot 1, Block 1, Endress + Hauser Gulf Coast Regional Center Amending Plat No 1, a subdivision in Harris County, Texas, according to the map or plat recorded in County Clerk's File No. RP-2021- 21290 in the Plat Records of Harris County, Texas. General Location: 14525 Kirby Drive, Pearland, Texas. Mayor Cole opened the Public Hearing. Presentation was provided by Martin Griggs, Deputy Director of Community Development. Genesis Property Development, applicant, and Bill Polano with Endress & Hauser, owner, were present to answer questions from Council. There were no citizen comments. Mayor Cole closed the Public Hearing. X. NEW BUSINESS 3. Consideration and Possible Action - Resolution No. R2025-CUP2025-0366 - A Resolution of the City Council of the City of Pearland, Texas, approving a Conditional Use Permit (CUP) for an expansion to an existing development for a Warehouse & Light Assembly use within the Beltway District of the Clear Creek Spectrum Planned Development, on approximately 16.921 acres, being Lot 1, Block 1, Endress + Hauser Gulf Coast Regional Center Amending Plat No 1, a subdivision in Harris County, Texas, according to the map or plat recorded in County Clerk's File No. RP-2021-21290 in the Plat Records of Harris County, Texas (located at 14525 Kirby Drive, Pearland, Texas). Seq. of the Plat Records of Brazoria County, Texas. General Location: 3637 Wingtail Way, Pearland, Texas. Mayor Cole opened the Public Hearing. Presentation was provided by Martin Griggs, Deputy Director of Community Development. Michelle Castaneda, owner, was present to answer questions from Council. Bill Baldy spoke in favor of this item. NEW BUSINESS 5. Consideration and Possible Action - Resolution No. R2025-CUP2025-0318 - A Resolution of the City Council of the City of Pearland, Texas, approving a Conditional Use Permit (CUP) for a Recreation Center (Private, For Profit) use within the Garden -O'Day Mixed Use (G/O-MU) District, on approximately 9.506 acres of land, being Lot 1 & 2, Block 1, Minor Plat of Santos Estates, a subdivision in Brazoria County, Texas, according to the map or plat recorded in County Clerk's File No. 2013002487 in the Plat Records of Brazoria County, Texas (located at 1826 O'Day Road, Pearland, Texas). Conditional Use Permit No. CUP2025-0318, for a Recreation Center (Private, For Profit) use within the Garden -O'Day Mixed Use (G/O-MU) District at the request of Stephanie Vasquez, J. Councilmember Cade made the motion, seconded by Mayor Pro-Tem Byrom to reconsider Resolution No. R2025-CUP2025-03344. AYES: Byrom, Cade, Fernandez, and Patel. NAYS: Koza and Chavarria. The motion carried. Councilmember Cade made the motion, seconded by Mayor Pro-Tem Byrom to approve Resolution No. R2025-CUP2025-0334 with the following condition: 1. The Conditional Use Permit shall only allow for the accessory dwelling unit to be occupied by a person who is related to the person who occupies the primary dwelling unit on the subject property by first or second degree of consanguinity or affinity. Public Hearing: A request by Grand Development, LLC., applicant and owner, for approval of a Conditional Use Permit (CUP) for Dwelling - Two - Family use within the Old Town -Mixed Use (OT-MU) District, to accommodate four (4) two-family dwelling units on four separately platted lots totaling 0.424 acres of land, to wit: Legal Description: Being all of Lots 12-16 and the northern 23 feet of Lot 17, in Block 26 of Pearland Townsite, a subdivision in Brazoria County, Texas, according to the map or plat thereof recorded in volume 29, Page 41 of the Plat Records of Brazoria County, Texas. General Location: 2523, 2525, 2527, 2529, 2531 Grand Boulevard, Pearland, Texas. Mayor Cole opened the Public Hearing. Consideration and Possible Action - Resolution No. R2025-CUP2025-0343 - A Resolution of the City Council of the City of Pearland, Texas, approving a Conditional Use Permit (CUP) for Dwelling - Two -Family use within the Old Town -Mixed Use (OT-MU) District, to accommodate four (4) two-family dwelling units on four separately platted lots totaling 0.424 acres of land, being all of Lots 12-16 and the northern 23 feet of Lot 17, in Block 26 of Pearland Townsite, a subdivision in Brazoria County, Texas, according to the map or plat thereof recorded in volume 29, Page 41 of the Plat Records of Brazoria County, Texas (located at 2523, 2525, 2527, 2529, 2531 Grand Boulevard, Pearland, Texas). Conditional Use Permit No. CUP2025-0343, for Dwelling - Two -Family use within the Old Town - Mixed Use (OT-MU) District at the request of Grand Development, LLC., applicant and owner, containing a savings clause, a severability clause, and an effective date and other provisions related to the subject. Consideration and Possible Action - Resolution No. R2025-CUP2025-0285 - A Resolution of the City Council of the City of Pearland, Texas, approving a Conditional Use Permit (CUP) for a Chemical Packaging/Blending use within the Light Industrial (M-1) District, on approximately 25.1041 acres of land, being a Replat of Commercial Reserve, Block 1, minor plat of Packaging Service Company and 3.02 acres of land situated in the H.T.& B.R.R, Abstract 543, Section 4 City of Pearland, Brazoria County, Texas (located at 4902 Shank Road, Pearland, Texas). Conditional Use Permit No. CUP2025-0285, for a Chemical Packaging/Blending use within the Light Industrial (M-1) District at the request of Thomas R Uzick, VP, Mission Constructors, Inc. applicant, on behalf of Jean-Pierre Baizan, owner, containing a savings clause, a severability clause, and an effective date and other provisions related to the subject. Councilmember Patel made the motion, seconded by Councilmember Koza to approve Resolution No. R2025-CUP2025-0285. Presentation was provided by Vance Wyle, Director of Community Development. Mayor Pro-Tem Byrom made the motion, seconded by Councilmember Koza to approve Resolution No. R2025-CUP2025-0285 with the following conditions: 1. No outdoor storage, including that of trucks, and/or trailers be within the first 75' fronting the previous 4902 Shank Road Parcel (3.02 acres of land situated in the H.T.& B.R.R, Abstract 543, Section 4 City of Pearland, Brazoria County, Texas). This 75' storage restriction does not apply to the existing SolvChem property (22.08 acres) running east along Shank to Mykawa Road. Any existing outdoor storage of trucks and trailers within the first 75' of the front property line on the lot previous 4902 Shank Road Parcel shall be removed and adequate screening be provided along Shank Road and the west property line in accordance with UDC requirements. 2. The area within the 75' of the property, as identified in Condition #1, may be developed with landscaping, parking, retention/detention, or building; however, the minimum setback for all off-street parking, maneuvering and loading areas from the right-of-way line of the roadway shall be thirty feet (30'). A minimum of fifteen percent (15%) of the required setback area shall consist of landscaped open areas with a permeable surface. 3. The Oak Trees (3) at 4902 Shank Road shall be protected during development and remain on the property. An 8' tall landscape screen of ornamental trees with chain link fence inside the vegetation line be provided adjacent to the residential property to the west and along the southern property line adjacent to the Horseshoe Bend plat properties. AYES: Byrom, Koza, Chavarria, Cade, Fernandez, and Patel. NAYS: None. The motion carried. 8. Consideration and Possible Action - Resolution No. R2025-146 - A Resolution of the City Council of the City of Pearland, Texas, approving the Old Town Revitalization Plan. Councilmember Koza made the motion, seconded by Councilmember Fernandez to approve Resolution No. R2025-146. AYES: Byrom, Koza, Chavarria, Cade, and Fernandez. NAYS: None. The motion carried. 9. Consideration and Possible Action - Resolution No. R2025-154 - A Resolution of the City Council of the City of Pearland, Texas, awarding a construction services contract associated with the Traffic Signal Span - Wire Rebuilding for four intersections, to Florida Traffic Control Devices, Inc., in the amount of $200,248.62. Councilmember Chavarria made the motion, seconded by Councilmember Koza to approve Resolution No. R2025-154. AYES: Koza, Chavarria, Cade, and Fernandez. NAYS: None. The motion carried. 10. Consideration and Possible Action - Resolution No. R2025-150 - A Resolution of the City Council of the City of Pearland, Texas, awarding a construction services contract associated with the Shadow Creek Ranch Intersection Improvement Project, to Jerdon Enterprise, L.P., in the amount of $6,258,574.94. Mayor Pro-Tem Byrom made the motion, seconded by Councilmember Cade to approve Resolution No. R2025-150. AYES: Byrom, Koza, Chavarria, Cade, and Fernandez. NAYS: None. The motion carried. 11. Consideration and Possible Action - Resolution No. R2025-149 - A Resolution of the City Council of the City of Pearland, Texas, awarding a Page 10 of 13 Pearland City Council Minutes September 22, 2025 Docusign Envelope ID: 13C27D12-C62F-4959-8065-FE2303A115F2 construction services contract associated with the Dixie Farm North Regional Lift Station Rehabilitation Project, to McDonald Municipal and Industrial - A Division of C.F. McDonald Electric, Inc., in the amount of $1,786,469.00. Councilmember Cade made the motion, seconded by Councilmember Fernandez to approve Resolution No. R2025-149. AYES: Byrom, Koza, Chavarria, Cade, and Fernandez. NAYS: None. The motion carried. 12. Consideration and Possible Action - Resolution No. R2025-156 - A Resolution of the City Council of the City of Pearland, Texas, awarding a construction services contract associated with the Industrial Drive Reconstruction Project ("Project"), to Conrad Construction Co., in the amount of $5,425,538.50; and authorizing a Reimbursement Agreement between the City and the Pearland Economic Development Corporation ("PEDC") to fund the Project. Councilmember Fernandez made the motion, seconded by Councilmember Koza to approve Resolution No. R2025-156. Ron Conrad, with Conrad Construction Co., was available to answer questions from the Council. AYES: Byrom, Koza, Chavarria, Cade, and Fernandez. NAYS: None. The motion carried. 13. Consideration and Possible Action - Resolution No. R2025-155 - A Resolution of the City Council of the City of Pearland, Texas, authorizing participation in an interlocal cooperative pricing arrangement for road repair services (West Lea Subdivision) from Forde Construction, in the amount of $1,490,238.00. Councilmember Koza made the motion, seconded by Councilmember Cade to approve Resolution No. R2025-155. Bill Baldy spoke in favor of this item. AYES: Byrom, Koza, Chavarria, Cade, and Fernandez. NAYS: None. The motion carried. 14. Consideration and Possible Action - First Reading of Ordinance No. 1652 - An Ordinance of the City Council of the City of Pearland, Texas, establishing Seniority Pay -Lateral Entry for hiring police officers with prior full-time paid law enforcement experience; setting forth Page 11 of 13 Pearland City Council Minutes September 22, 2025 Docusign Envelope ID: 13C27D 12-C62F-4959-8065-FE2303A115F2 qualification criteria; providing a savings clause; providing for severability and an effective date. Councilmember Chavarria made the motion, seconded by Councilmember Fernandez to approve the first reading of Ordinance No. 1652. Scott McReynolds spoke in favor of this item. Consideration and Possible Action - Resolution No. R2025-153 - A Resolution of the City Council of the City of Pearland, Texas, authorizing participation in an interlocal cooperative pricing arrangement for the purchase of a 3-year Microsoft Enterprise Agreement through CDW-G, in the annual estimated amount of $505,181.80. Mayor Pro-Tem Byrom made the motion, seconded by Councilmember Fernandez to approve Resolution No. R2025-153. AYES: Byrom, Koza, Chavarria, Cade, and Fernandez. NAYS: None. The motion carried. XVII.
