HomeMy WebLinkAbout20250908 City Council Regular Meeting MinutesPage 1 of 7 Pearland City Council Minutes September 08, 2025 CITY OF PEARLAND, TEXAS CITY COUNCIL REGULAR MEETING MINUTES SEPTEMBER 8, 2025 The City Council of Pearland, Texas convened in a meeting on Monday, September 8, 2025 at the Pearland City Hall Council Chambers, 3519 Liberty Drive, Pearland, Texas. The following represents the actions taken by City Council in the order they occurred during the meeting. All motions are made by Council in consecutive order, as determined by the Mayor. I.CALL TO ORDER Mayor J. Kevin Cole called the meeting to order at 6:32 p.m. II.INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF AMERICA FLAG AND TEXAS FLAG Councilmember Carbone gave the Invocation and Councilmember Chavarria led the Pledge of Allegiance to the United States of America Flag and the Texas Flag. III.ROLL CALL AND CERTIFICATION OF QUORUM Mayor J. Kevin Cole Mayor Pro-Tem Clint Byrom Councilmember Tony Carbone Councilmember Mona Chavarria Councilmember Layni Cade Councilmember Rick Fernandez Councilmember Rushi Patel City Manager Trent Epperson Deputy City Attorney Lawrence Provins City Secretary Frances Aguilar All members were present except Councilmember Joseph Koza. IV.CITIZEN COMMENTS Victoria Forsberg expressed concern regarding the Pearland Municipal Management District No. 2 process. V.CONSENT AGENDA A.Consideration and Possible Action - Approval of the minutes of the Pearland City Council Special Meeting held on August 11, 2025, City Council Regular Meeting held on August 11, 2025, City Council and Planning and Zoning Joint Workshop held on August 18, 2025, and City Council Special Meeting held on August 18, 2025. B.Consideration and Possible Action - Resolution No. R2025-140 - A Resolution of the City Council of the City of Pearland, Texas, establishing the Council Meeting times and dates for 2026. Phillips to Position No. 3, with a term expiring September 30, 2026; reappointing Henry Fuertes to Position No. 4 with a term expiring September 30, 2026. D.Pulled for discussion. E.Consideration and Possible Action - Resolution No. R2025-83 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to enter into an Interlocal Agreement, for the cooperative purchase of goods and services, with the City of La Porte, Texas. Councilmember Carbone made the motion, seconded by Councilmember Cade to approve the Consent Agenda items A-E, except D. AYES: Byrom, Carbone, Chavarria, Cade, Fernandez, and Patel. NAYS: None. The motion carried. VI.MATTERS REMOVED FROM CONSENT AGENDA D.Consideration and Possible Action - Resolution No. R2025-142 - A Resolution of the City Council of the City of Pearland, Texas appointing a director to the Board of Directors of the Pearland Municipal Management District No. 2. Councilmember Carbone made the motion, Seconded by Mayor Pro-Tem Byrom to approve Resolution No. R2025-142. Councilmember Chavarria made the motion, seconded by Councilmember Cade to table this item for discussion in Executive Session. AYES: Byrom, Carbone, Chavarria, Cade, Fernandez, and Patel. NAYS: None. The motion carried. VII.PUBLIC HEARING NO. 1 1.Public Hearing: A request by Thomas R Uzick, VP, Mission Constructors, Inc. applicant, on behalf of Jean-Pierre Baizan, owner, for approval of a Conditional Use Permit (CUP) for Chemical Packaging/Blending use within the Light Industrial (M-1) District, on approximately 25.1041 acres of land, to wit: Legal Description: A subdivision of 25.1041 Acres of Land being a Replat of Commercial Reserve, Block 1, minor plat of Packaging Service Docusign Envelope ID: 13C27D12-C62F-4959-8065-FE2303A115F2 Page 3 of 7 Pearland City Council Minutes September 08, 2025 Company and 3.02 acres of land situated in the H.T.& B.R.R, Abstract 543, Section 4 City of Pearland, Brazoria County, Texas. General Location: 4902 Shank Road, Pearland, Texas. Mayor Cole opened the Public Hearing. Presentation was provided by Martin Griggs, Deputy Director of Community Development. Jean-Pierre Baizan, applicant, gave a presentation and was present to answer questions from Council. Buck Stevens spoke in opposition to the Conditional Use Permit. Ronnie Castillo spoke in opposition to the Conditional Use Permit. Lisa Layfield spoke in opposition to the Conditional Use Permit. Mayor Cole closed the Public Hearing. VIII. NEW BUSINESS NO. 1 1. Consideration and Possible Action - Resolution No. R2025-CUP2025-0285 - A Resolution of the City Council of the City of Pearland, Texas, approving a Conditional Use Permit (CUP) for a Chemical Packaging/Blending use within the Light Industrial (M-1) District, on approximately 25.1041 acres of land, being a Replat of Commercial Reserve, Block 1, minor plat of Packaging Service Company and 3.02 acres of land situated in the H.T.& B.R.R, Abstract 543, Section 4 City of Pearland, Brazoria County, Texas (located at 4902 Shank Road, Pearland, Texas). Conditional Use Permit No. CUP2025-0285, for a Chemical Packaging/Blending use within the Light Industrial (M-1) District at the request of Thomas R Uzick, VP, Mission Constructors, Inc. applicant, on behalf of Jean-Pierre Baizan, owner, containing a savings clause, a severability clause, and an effective date and other provisions related to the subject. Councilmember Chavarria made the motion, seconded by Councilmember Carbone to approve Resolution No. R2025-CUP2025-0285. Councilmember Carbone made the motion, seconded by Councilmember Chavarria to postpone this item to the September 22, 2025 City Council meeting. AYES: Byrom, Carbone, Chavarria, Cade, Fernandez, and Patel. NAYS: None. The motion carried. Public Hearing on the proposed Fiscal Year 2025-2026 Budget. Mayor Cole opened the Public Hearing. Presentation was provided by Trent Epperson, City Manager and Rachel Wynslow, Head of Office Management and Budget. There were no citizen comments. Mayor Cole closed the Public Hearing. X. NEW BUSINESS 2. Consideration and Possible Action - First Reading of Ordinance No. 1650 - An appropriation Ordinance adopting a budget for the fiscal year beginning October 1, 2025, and ending September 30, 2026; pay plans for fiscal year 2025-2026; and, pursuant to Local Government Code, Section 102.007, providing for a separate ratification vote of the property tax revenue increase reflected in the budget. Mayor Pro-Tem Byrom made the motion, seconded by Councilmember Fernandez to approve the first reading of Ordinance No. 1650. AYES: Byrom, Carbone, Chavarria, Cade, and Fernandez. NAYS: Patel. The motion carried. Mayor Pro-Tem Byrom made the motion, seconded by Councilmember Carbone authorizing the ratification of the property tax revenue increase reflected in the budget Ordinance No. 1650. AYES: Byrom, Carbone, Chavarria, Cade, and Fernandez. NAYS: Patel. The motion carried. 3. Consideration and Possible Action - First Reading of Ordinance No. 1651 - An Ordinance adopting a tax rate of $0.6300 and levying taxes for the use and support of the Municipal Government of the City of Pearland, Texas, and providing for the interest and sinking fund of the taxable year 2025. Councilmember Cade made the motion, seconded by Councilmember Fernandez to approve the first reading of Ordinance No. 1651 and stated, "I move that the property tax rate be increased by the adoption of a tax rate of 0.6300, which is effectively a 1.70% percent increase in the tax rate." The motion carried. 4. Consideration and Possible Action - First Reading of Ordinance No. 1358- 32 - An Ordinance of the City Council of the City of Pearland, Texas, amending non-development usage and service fees; containing a savings clause, a severability clause, a repealer clause, providing for publication and an effective date. Councilmember Fernandez made the motion, seconded by Councilmember Carbone to approve the first reading of Ordinance No. 1358-32. AYES: Byrom, Carbone, Chavarria, Cade, Fernandez, and Patel. NAYS: None. The motion carried. 5. Consideration and Possible Action - Resolution No. R2025-141 - A Resolution of the City Council of the City of Pearland, Texas, adopting a Five-Year Capital Improvement Program (2026-2030). Councilmember Patel made the motion, seconded by Councilmember Cade to approve Resolution No. R2025-141. AYES: Byrom, Carbone, Chavarria, Cade, Fernandez, and Patel. NAYS: None. The motion carried. 6. Consideration and Possible Action - Resolution No. R2025-145 - A Resolution of the City of Pearland, Texas determining the costs of certain public improvements to be financed by the Smith Ranch Public Improvement District No. 1; accepting a Preliminary Service and Assessment Plan, including the Proposed Assessment Rolls; directing the filing of the Proposed Assessment Rolls with the City Secretary to make available for public inspection; calling public hearings on October 13, 2025 and October 27, 2025 to consider an ordinance levying assessments on property within the District; directing City staff to publish and mail notice of said public hearing; and resolving other matters incident and related thereto. Councilmember Carbone made the motion, seconded by Councilmember Fernandez to approve Resolution No. R2025-145. Nick Motamedi expressed support for this item. AYES: Byrom, Carbone, Chavarria, Cade, Fernandez, and Patel. NAYS: None. The motion carried. 7. Consideration and Possible Action - Resolution No. R2025-143 - A Docusign Envelope ID: 13C27D12-C62F-4959-8065-FE2303A115F2 Page 6 of 7 Pearland City Council Minutes September 08, 2025 Resolution of the City Council of the City of Pearland, Texas, authorizing participation in an interlocal cooperative purchasing program for the purchase of replacement networking equipment, in the amount of $662,162.03, from Sequel Data Systems, Inc. Councilmember Chavarria made the motion, seconded by Councilmember Cade to approve Resolution No. R2025-143. AYES: Byrom, Carbone, Chavarria, Cade, Fernandez, and Patel. NAYS: None. The motion carried. XI.OTHER BUSINESS There were no other business items. XII.MAYOR/COUNCIL ISSUES FOR CITY COUNCIL DISCUSSION There were no issues to discuss. XIII.EXECUTIVE SESSION UNDER TEXAS GOVERNMENT CODE Council adjourned into Executive Session at 9:07 p.m. Section 551.074 - Personnel Matters - Regarding City Boards and Commission reappointments. Conducted. Section 551.072 - Deliberations regarding the sale, purchase, lease or exchange of real Property. Conducted. Section 551.087 - Deliberations regarding economic development negotiations. Council returned from Executive Session at 10:47 p.m. XIV.NEW BUSINESS CONTINUED D.Consideration and Possible Action - Resolution No. R2025-142 - A Resolution of the City Council of the City of Pearland, Texas appointing a director to the Board of Directors of the Pearland Municipal Management District No. 2. Councilmember Carbone made the motion, seconded by Councilmember Cade made the motion to remove this item from the table.
