CALL TO ORDER Chairperson Lewis opened the meeting for the Zoning Board of Adjustments Meeting at 6:00 PM. ZBA Chairperson, Mark Lewis ZBA Secretary, Gary Shrum ZBA Member, Todd locco ZBA Alternate Member, Crystal Cook ZBA Alternate Member, Bincy Jacob Also, present were Deputy City Attorney Lawrence Provins, Assistant City Attorney Katie Leiniger, Community Development Deputy Director Martin Griggs, Senior Planner Patrick Bauer, and Business Administrator Jennifer Danley. ELECTIONS Chairperson Lewis postponed the elections to the conclusion of New Business. APPROVAL OF MINUTES Consideration and Possible Action - Approve the ZBA Meeting Minutes from July 24, 2025. Chairperson Lewis read into the record the items on Approval of Minutes. Member locco made the motion to approve, and Alternate Member Jacob seconded the motion. Motion passed 5-0. NEW BUSINESS Chairperson Lewis read into the record the item on Consideration and Possible Action — VAZ2025-0337: Variance for the Reduction of the corridor Overlay District Setback for Food Store/Supermarket Use. Consideration and Possible Action - VAZ2025-0337: Variance for the Reduction of the Corridor Overlay District Setback for Food Store/Supermarket Use Public Hearing: A request by Hamad Elsaadi, applicant, on behalf of 2011 Property Inc., owner, for approval of variance, as permitted by the Unified Development Code, Ordinance No. 2000-T, to allow: 1. Variance to reduce the required 30' setback for parking and maneuvering areas within the Corridor Overlay District Section 2.4.5.1(c)(2)), to wit: Legal Description: Being a tract or parcel containing 0.8199 of an acre (35,718 square feet) of land situated in the W.D.C. Hall Leage, Abstract Number 70, Brazoria County, Texas; being all of a called 0.613 acre tract of record in the name of 2011 Property, Inc., in Brazoria County Clerk's File (B.C.C.F.) Number 2024035106 and all of a called 0.2673 acre tract of record in the name of 2011 Property, Inc., in B.C.C.F. Number 2024045816; Saif 0.8199 acre tract also being out of and a part of Commercial Reserve in Vie Villa, a subdivision duly of record in Volume 14, Page 60, in the Plat of Records of Brazoria County (B.C.P.R.), Texas. General Location: Northwest corner of Broadway Street and Yost Boulevard, Pearland, Texas. Senior Planner Bauer presented the staff report with exhibits and explained that the request to reduce the 30 -foot setback for all off-street parking, maneuvering, and loading areas within the Corridor Overlay District (COD) to nine feet on the left side and twenty feet on the right side of the driveway access from Broadway Street. He noted that staff received nine written comments in favor and two in opposition, as well as three phone calls — one in favor, one opposed, and one requesting additional information. Mr. Bauer reviewed the property's history, summarized the proposed site plan, and highlighted the buffers. He stated that the request met four and may meet two of the eight criteria outlined in the Unified Development Code (UDC) criteria and staff recommended approval. Architect John Linton, 553 Hues Road, Shephard, Texas 77581, and Janice Wagner 22910 Wren Lane, Tomball, Texas 77377, were present in -person in Council Chambers to present details of the proposed development and briefly outlined the site plan. Chairperson Lewis called for public input. Resident Dawn Fertitta, 2108 Roland Rue Street, Pearland, Texas 77581, opposed the request, cited safety concerns and potential decline in property values. Resident Linda Fertitta, 2101 Roland Rue Street, Pearland, Texas 77581, expressed opposition to the request, raising safety concerns and anticipated noise from dogs barking. Resident Damien Trump, 2103 Roland Rue Street, Pearland, Texas 77581, opposed the request, noting alternative locations in Pearland for a bakery and concerns of unpleasant dumpster odor. Resident William Schulte, 2113 Roland Rue Street, Pearland, Texas 77581, cited safety concerns in opposing the request. Discussion among the ZBA members focused on differences between the current request and the previous case on the property. Members Cook and locco asked staff and the applicant about compliance with parking and lighting requirements under the UDC & COD requirements. No further discussion from Staff, ZBA Board or Public input. Chairperson Lewis read into the record the item on Consideration and Possible Action — VAZ2025-0337: Variance for the Reduction of the Corridor Overlay District Setback for Food Store/Supermarket Use. Member locco made the motion to approve the variance with the condition of no windows or doors on the backside of the building, and Alternate Member Jacob seconded the motion. Motion passed 5-0. ELECTIONS: Member Shrum made the motion to elect Mark Lewis as Chairperson, Jerry Acosta as Vice Chairperson, and Gary Shrum as Secretary, and Member locco seconded the motion Motion passed 5-0. ADJOURNMENT Chairperson Lewis adjourned the Zoning Board of Adjustment Meeting at 6:46 PM.
