Cook PURPOSE OF THE MEETING: 1. PUBLIC HEARING ON REQUEST FOR CHANGE IN LAND USE BY W. B.. BRADLEY - NS TO R-2 (SINGLE FAMILY RESIDENTIAL) BLOCK 3, LOTS 16 $ 17, WILLOWCREST SUBDIVISION, SECTION I. 2. PUBLIC HEARINGS ON STREET ASSESSMENTS: I. GLASTONBURY DRIVE, II_. BOBBY STREET, AND III. I: Mayor McComb read a letter dated December 23, 1976 from Dennis Frauenberger, Chairman of the Planning and Zoning Commission advising that the Commission voted 6 to 0 to recommend approval of the requested change by W. B. Bradley, Applica- tion No. 34. PERSONS WISHING TO SPEAK FOR THE REQUESTED CHANGE: None PERSONS WISHING TO SPEAK AGAINST THE REQUESTED CHANGE: None QUESTIONS FROM THE CITY COUNCIL: None ADJOURN HEARING NO. I: None PUBLIC HEARING ON STREET ASSESSMENTS: Beginning at 7:42 P.M. Mayor McComb advised the audience that the public hearing was being held pursuant to the authority and statutory requirements of Article 1105b etc. NOTICE AND HEARING: City Secretary, Dorothy L. Cook, advised that all statutory notice of the hearing had been duly mailed and published according to Section 9 of Article 1105b of Vernon's Annotated Civil Statutes and that no railways were affected by this proposed street assessment. TESTIMONY ON BEHALF OF CITY: Mayor McComb asked the City Attorney to present evidence on behalf of the City regarding the proposed improvements and proposed assessment on Glastonbury Drive, Bobby Street, and Lynn Drive. The City Attorney called for the testimony of Malcolm Collins, City Engineer. Mr. Collins testified on the cost distribution of the streets as follows: GLASTONBURY DRIVE: From Robinson Dr. to Cost per property Lt. 33, Block 7 of foot $3.40 Glastonbury Dr. 1,656.9 feet Property footage abutting Improvements 3,291.38 feet Property owner's City Cost Above Total Construction Cost Cost $6,583.66 Assessment $11,263.83 $4,680.17 BOBBY STREET: From Knapp Rd. to Cost per property Robinson Dr. foot $3.40 1,260 feet Property footage abutting Improvements 2,426.49 feet Property Owner's City Cost Above Total Construction Cost Cost $4,852.98 Assessment $3,712.35 $8,565.33 LYNN DRIVE: From F. M. 518 to Cost per property Cherry St. foot $4.21 1,788.9 feet Property Owner's City Cost Above Cost $4,099.43 Assessment $10,945.71 Property footage abutting Improvements 2,502.65 feet Total Construction Cost $15,045.14 Owner's Assessment $2.00 Owner's Assessment $2.00 Owner's Assessment $2.00 $1.25 Mr. Collins testified that the assessment on these projects was at $2.00 per front foot with the exception of the lst block of Lynn Drive between West Broadway and Pear Street which was assessed at $1.25 as it was previously paved and accepted by the City. Mr. Collins testified that the property owners were being assessed less than 90% of the total cost of the improvements. He further testified that based on his inspection the improvements have been placed according to his specifications, the 282 streets have been completed subject to approval of the City Council, however, there is one section on Lynn Drive that needs some maintenance. Mr. Peterson asked why the section of Glastonbury had not been paved (Lot 34 and 35 in Block 9) and he was informed that the paving under the Ordinance of Necessity stopped at Block 33 and any money paid for paving beyond this point should be returned. This money, as collected in error by the City, would be returned to the person or firm who had mailed the money to the City. Mr. Ben Walzem, 2507 Lynn Drive, advised the City Council that there is a place on Lynn Drive at the intersection of Pear Street where the black top is directly on the culvert. City Engineer Collins advised that if base material had been placed on this area it would have caused a hump and if the culvert had been lowered, the ditches whould have to be cut in order for the water to drain. Mr. Gilmore, 1108 Bobby Street, asked about the width of the street. He advised that at several points at the north part of Bobby Street the base was 24 feet or less and the paved area 21 feet or less. Mr. Collins advised that this street has been in for some time and as these streets have a tendency to ravel off and they will be narrow at some points. Mr. James F. McDevitt, Real Estate Broker, was called to testify by City Attorney Bobby Williams. Mr. McDevitt testified that he had inspected the various streets covered by this Hearing and that the abutting property had been increased by a value greater than $2.00 per front foot. PROPERTY OWNERS WERE GIVEN AN OPPORTUNITY TO QUESTION MR. McDEVITT AT THIS TIME: The City's testimony closed at this time. PROPERTY OWNERS' TESTIMONY: The property owners were given an opportunity to speak either themselves or legal counsel. Mayor McComb recessed the Hearing until January 24, 1977.
