HomeMy WebLinkAbout20250811 City Council Regular Meeting MinutesPage 1 of 7 Pearland City Council Minutes August 11, 2025 CITY OF PEARLAND, TEXAS CITY COUNCIL REGULAR MEETING MINUTES AUGUST 11, 2025 The City Council of Pearland, Texas convened in a meeting on Monday, August 11, 2025 at the Pearland City Hall Council Chambers, 3519 Liberty Drive, Pearland, Texas. The following represents the actions taken by City Council in the order they occurred during the meeting. All motions are made by Council in consecutive order, as determined by the Mayor. I. CALL TO ORDER Mayor J. Kevin Cole called the meeting to order at 6:30 p.m. II. INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF AMERICA FLAG AND TEXAS FLAG Councilmember Cade gave the Invocation and Councilmember Fernandez led the Pledge of Allegiance to the United States of America Flag and the Texas Flag. III. ROLL CALL AND CERTIFICATION OF QUORUM Mayor J. Kevin Cole Mayor Pro-Tem Clint Byrom Councilmember Joseph Koza Councilmember Tony Carbone Councilmember Mona Chavarria Councilmember Layni Cade Councilmember Rick Fernandez City Manager Trent Epperson City Attorney Darrin Coker City Secretary Frances Aguilar All members were present except Councilmember Rushi Patel. IV. CITIZEN COMMENTS There were no citizen comments. V. CONSENT AGENDA A. Consideration and Possible Action - Second and Final Reading of Ordinance No. 1633-1 - An Ordinance of the City Council of the City of Pearland, Texas, amending portions of the Thoroughfare Plan portion of the City’s Comprehensive Plan; having a savings clause, a severability clause, and a repealer clause; providing for codification and an effective date B. Consideration and Possible Action - Second and Final Reading of Ordinance No. 2000M-274 - An Ordinance of the City Council of the City of Pearland, Texas, amending Ordinance No. 2000M, the zoning map of the City of Pearland, Texas, for the purpose of changing the classification Docusign Envelope ID: B39F1F8C-5EF2-446B-BDAF-89821992BBA6 Page 2 of 7 Pearland City Council Minutes August 11, 2025 of certain property; being a 3.2816 -acre tract being out of a 8.84 acres of land in the T.D. Yocum Survey, Abstract 399 & A.C.H.&B Survey, Abstract 147, Brazoria County, Texas. Said 8.84-acre tract being comprised of two tracts of land, Tract 1, being out and a part of a called 18.26 acre tract, Tract 2, being all of a called 5.5584 acre tract both of record in the name of 24 AC Pearland Parkway, LLC., in Brazoria County Clerk’s File (B.C.C.F.) Number 2024000361; save and except all that certain 5.5584 acres, along the east side of Pearland Parkway being part of a 27.12 acre tract situated in the T.D. Yocum Survey, Abstract 399 & A.C.H.&B Survey, Abstract 147, Brazoria County, Texas, recorded in Clerk’s File No. 1993007446 of the Deed Records of Brazoria County, Texas (located along the East side of Pearland Parkway, North of the John Lizer Road, Pearland, Texas). Zone Change Application No. ZON2025-0210, a request by Nick Motamedi, applicant, on behalf of 24 AC Pearland Parkway, LLC., owner, for approval of a zone change for 3.2816 acres of land from Single-Family Residential-1 (R-1) District to General Business (GB) District; providing for an amendment of the zoning district map; containing a savins clause, and an effective date and other provisions related to the subject. Councilmember Koza made the motion, seconded by Councilmember Cade to approve Consent Agenda items A - B. AYES: Byrom, Koza, Carbone, Chavarria, Cade, and Fernandez. NAYS: None. The motion carried. VI. MATTERS REMOVED FROM CONSENT AGENDA There were no items removed from Consent Agenda. VII. PUBLIC HEARING NO. 1 1. Public Hearing: The second of two public hearings within the required 30- day comment period for the FY 2026 Community Development Block Grant (CDBG) Annual Action Plan (HUD Program Year 2025): CDBG Award No. B-25-MC-48-0400. Mayor Cole opened the Public Hearing. Presentation was provided by Michael Rawlinson, Grants Manager. There were no citizen comments. Mayor Cole closed the Public Hearing. VIII. NEW BUSINESS 1. Consideration and Possible Action - Resolution No. R2025-137 - A Resolution of the City Council of the City of Pearland, Texas, approving Docusign Envelope ID: B39F1F8C-5EF2-446B-BDAF-89821992BBA6 Page 3 of 7 Pearland City Council Minutes August 11, 2025 the City of Pearland’s Fiscal Year 2026 Community Development Block Grant (CDBG) Annual Action Plan (Program Year 2025), for submission to the U.S. Department of Housing and Urban Development (HUD) in the amount of $537,831.00. Councilmember Carbone made the motion, seconded by Councilmember Koza to approve Resolution No. R2025-137. AYES: Byrom, Koza, Carbone, Chavarria, Cade, and Fernandez. NAYS: None. The motion carried. IX.PUBLIC HEARING NO. 2 2.Public Hearing: A request to create the Smith Ranch Road Public Improvement District, on approximately 80-acre area generally located at the southeast corner of Smith Ranch Road and Hughes Ranch Road. Mayor Cole opened the Public Hearing. Presentation was provided by Matt Buchanan, President of Pearland Economic Development Corporation and Abdi Yassin, Senior Vice President with Municap, Inc. Richard Lee Atcheson, spoke in support of the Public Improvement District. Paul Edwards, spoke in opposition to the Public Improvement District. Nick Motamedi, owner with AIMAS Properties, LTD., spoke in support of the Public Improvement District. Timm Wooten, Associate with Rockefeller Group, spoke in support of the Public Improvement District. X.NEW BUSINESS 2.Consideration and Possible Action - Resolution No. R2025-38 - A Resolution of the City Council of the City of Pearland, Texas, authorizing and creating the Smith Ranch Public Improvement District in accordance with Chapter 372 of the Texas Local Government Code; resolving other matters incident and related thereto; and providing an effective date. Councilmember Chavarria made the motion, seconded by Councilmember Cade to approve Resolution No. R2025-38. AYES: Byrom, Koza, Carbone, Chavarria, and Fernandez. NAYS: Cade. The motion carried. Docusign Envelope ID: B39F1F8C-5EF2-446B-BDAF-89821992BBA6 Page 4 of 7 Pearland City Council Minutes August 11, 2025 3.Consideration and Possible Action - Resolution No. R2025-93 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to enter into a Development Agreement between the City and Rockefeller Group, associated with the construction and funding of wastewater improvements to serve portions of property generally located at the southeast corner of Smith Ranch Road and Hughes Ranch Road; and authorizing a Reimbursement Agreement between the City and the Pearland Economic Development Corporation. Mayor Pro-Tem Byrom made the motion, seconded by Councilmember Fernandez to approve Resolution No. R2025-93. Timm Wooten, Associate with Rockefeller Group was present to answer questions from Council. AYES: Byrom, Koza, Carbone, Chavarria, Cade, and Fernandez. NAYS: None. The motion carried. 4.Consideration and Possible Action - Resolution No. R2025-135 - A Resolution of the City Council of the City of Pearland, Texas, placing on the agendas of September 8, 2025, and September 22, 2025 City Council meetings, consideration of the proposed fiscal year 2025-2026 budget and setting the public hearing on the budget for September 8, 2025 at 6:30 PM. Councilmember Cade made the motion, seconded by Mayor Pro-Tem Byrom to approve Resolution No. R2025-135. AYES: Byrom, Koza, Carbone, Chavarria, Cade, and Fernandez. NAYS: None. The motion carried. 5.Consideration and Possible Action - Resolution No. R2025-136 - A Resolution of the City Council of the City of Pearland, Texas, proposing a tax rate not to exceed .635000, which represents a property tax revenue increase of 2.51% above the No New Revenue Tax Rate, and placing on the agendas of September 8, 2025 and September 22, 2025 regular City Council meetings, consideration of the proposed fiscal year 2025-2026 tax rate and setting a public hearing on the tax rate for September 22, 2025 at 6:30 pm. Councilmember Fernandez made the motion, seconded by Councilmember Cade to approve Resolution No. R2025-136. Councilmember Carbone made the motion, seconded by Councilmember Cade to amend the proposed tax rate to maximum .630 and property tax revenue of 1.770% above the No New Revenue Tax Rate. The motion failed. Councilmember Fernandez made the motion, seconded by Councilmember Cade to approve Resolution No. R2025-136. AYES: Cole, Byrom, Chavarria, and Fernandez. NAYS: Koza, Carbone, and Cade. The motion carried. 6.Consideration and Possible Action - Resolution No. R2025-104 - A Resolution of the City Council of the City of Pearland, Texas, awarding a construction services contract associated with the Veterans 2 Regional Lift Station Rehabilitation Project, to McDonald Municipal and Industrial, in the amount of $2,025,817.00. Councilmember Koza made the motion, seconded by Councilmember Carbone to approve Resolution No. R2025-104. AYES: Byrom, Koza, Carbone, Chavarria, Cade, and Fernandez. NAYS: None. The motion carried. 7.Consideration and Possible Action - Resolution No. R2025-134 - A Resolution of the City Council of the City of Pearland, Texas, authorizing participation in an interlocal cooperative pricing arrangement for the purchase of equipment and installation services (Southdown Park Playground and Splash Pad Renovation) from Kraftsman Commercial Playground, in the amount of $910,464.00. Councilmember Carbone made the motion, seconded by Councilmember Koza to approve Resolution No. R2025-134. AYES: Byrom, Koza, Carbone, Chavarria, Cade, and Fernandez. NAYS: None. The motion carried. XI.OTHER BUSINESS There were no other business items. XII.MAYOR/COUNCIL ISSUES FOR CITY COUNCIL DISCUSSION There were no issues to discuss. Conducted. Section 551.074 - Deliberation regarding the roles and responsibilities of the Municipal Court Judge. Conducted. Council returned from Executive Session at 8:14 p.m. XIV.NEW BUSINESS CONTINUED 8.Consideration and Possible Action - Regarding the appointment of a Municipal Court Associate Judge. Councilmember Carbone made the motion, seconded by Councilmember Cade to appoint Cindy Bennett Smith, Rosalyn L. Carter, and Michael C. Diaz to two - year terms as associate Municipal Court Judges. AYES: Byrom, Koza, Carbone, Chavarria, Cade, and Fernandez. NAYS: None. The motion carried. 9.Consideration and Possible Action - Regarding the roles and responsibilities of the Municipal Court Judge. Mayor Pro -Tem Byrom made the motion, seconded by Councilmember Koza to authorize a modification to the Municipal Court Judge job description to clarify that the Juvenile Case Manager does not fall under the supervision of the Municipal Court Judge, but may report information to the Municipal Court Judge, and that the Municipal Court Judge does not supervise the Juvenile Case Manager position. AYES: Byrom, Koza, Carbone, Chavarria, Cade, and Fernandez. NAYS: None. The motion carried. XV.ADJOURNMENT Mayor Cole adjourned the meeting at 8:16 p.m. The Minutes were approved on this the 8th day of September 2025.
