1976-08-23 CITY COUNCIL REGULAR MEETING MINUTES100 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON AUGUST 23, 1976, AT 7:37 P. M. IN THE CITY HALL, 2335 N. TEXAS AVENUE, PEARLAND, TEXAS. The meeting was called to order with the following present: Mayor Carlton McComb Councilman Councilman Councilman Administrative Assistant City Attorney Tom Reid Terry Gray Benny Frank Buford Parrish Bobby J. Williams City Secretary Dorothy L. Cook ABSENT FROM THE MEETING: Councilman Griffin, Councilman Farley, and City Manager William E. Wolff. INVOCATION AND PLEDGE OF ALLEGIANCE: The invocation was given by Councilman Reid. The Pledge of Allegiance was led by Councilman Gray. APPROVAL OF MINUTES: It was moved by Councilman Reid, seconded by Councilman Gray that the minutes of the regular meeting of the City Council held on August 9, 1976, be approved as submitted. Motion passed 3 to 0. Mayor McComb reported that Councilman Reid has agreed to serve on the Steering Committee of the American Association of Small Cities. Councilman Reid will replace Mayor McComb on this Committee. The Mayor explained that his new job required him to travel frequently and he was unable to make the meetings. Mayor McComb also announced that Councilman Reid has been appointed as represent- ative in the Houston -Galveston Area Council's Executive Committee. Councilman Yeamans of Alvin has been the representative and Councilman Reid has been the alternate, however, due to business reasons he was unable to continue in this position. Councilman Reid advised that he had received several requests from citizens pertaining to pedestrian crossing on Highway 518 at the Schools. This would be three crossings: one at 518 and Old Alvin Road, Highway 518 and the entrance to Regency Park Subdivision, and Highway 518 and Grand Boulevard. M" The Acting Traffic Engineer is to get together with the School Superintendent and provide a protected pedestrian crossing at one or two of the locations immediately after school. Acting Traffic Engineer to report back to the City Council on this matter. DEPARTMENTAL REPORTS: None CITIZENS: Mr. George H. Counts, Jr. of 1602 Willits Drive felt that he should not have to pay for a 24 foot asphalt surface on Willits Drive when the width is in reality only 20 foot. This matter was referred to City Attorney Bobby Williams for further investigation. Mr. Counts also asked that the ditch in his property facing Dixie Farm Road be moved into City property, and that the bridge abuttment at Dixie Farm Road and Willits Drive be rebuilt where it is collapsing. These matters will be referred to the Drainage District. Mr. Toby Lytle of 2109 Old Alvin Road requested that the sidewalk being built along the East side of Old Alvin Road from Highway 518 to the Intermediate School be extended down to Plum Street. Mayor McComb stated that the Jaycees have already met concerning raising funds to continue this sidewalk along Old Alvin Road. DOCKETED PUBLIC HEARINGS: 1. REQUEST FOR CHANGE IN LAND USE - APPLICATION NO. 28, GEORGE L. GETZ AND APPLICATION NO. 28A, BRUNETTE C. COPPINGER. MF TO COMMERCIAL. PERSONS WISHING TO SPEAK FOR THE CHANGE IN LAND USE: George L. Getz advised that he wanted to put in_a Beauty Shop and a Garden Shop in the remaining buildings that were once used by ":Coppinger_.Electric. The portion that Mrs. Coppinger is involved with is to adjoin this property,and she is.interested in installing mini -storages on this property. PERSONS WISHING TO SPEAK AGAINST THE CHANGE IN LAND USE: None QUESTIONS FROM THE CITY COUNCIL: Councilman Gray asked Mr. Getz if this would change the existing structures in any way. Mr. Getz advised that the buildings would be dressed up which would enhance them. Councilman Gray also asked if Mr. Getz anticipated any heavy traffic or high parking volume. Mr. Getz advised that he did not. Councilman Reid asked how far was the nearest residence to these buildings. Mr Getz advised that there was a vacant lot between these buildings and the nearest residence. 212 ADJOURN HEARING AT 8:10 P. M. 2. Hall Survey Abstract 70 Brazoria County, Texas. PERSONS WISHING TO SPEAK FOR THE CHANGE IN LAND USE: John Garner spoke for the requested change. UNFINISHED BUSINESS: COUNCIL'S ACTION ON APPLICATION NO. 28, GEORGE L. GETZ , APPLICATION NO. 28A, BRUNETTE C. COPPINGER, AND APPLICATION NO. 29, HAROLD RUSSELL: It was moved by Councilman Gray, seconded by Councilman Reid that Application No. 28 by George L. Getz, and Application No. 28A by Brunette C. Coppinger be approved and ordinances be prepared. Motion passed 3 to 0. It was moved by Councilman Frank, seconded by Councilman Gray that an ordinance be prepared for a requested change in land use by Harold Russell, Application No. 29. Motion passed 3 to 0. ORDINANCE NO. 315 - AN ORDINANCE ESTABLISHING LOAD LIMITS ON STREETS WITHIN THE CITY OF PEARLAND: Ordinance No. 315 was read in full by Councilman Gray and Councilman Frank. (Second and Final Reading) It was moved by Councilman Gray, seconded by Councilman Reid that Ordinance No. 315 be passed on second and final reading. Said Ordinance No. 315 reads in caption as follows: ORDINANCE NO. 315 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, ESTABLISHING LOAD LIMITS ON STREETS WITHIN THE CITY, ESTABLISHING PER- MITS, ESTABLISHING TRUCK ROUTES, PROVIDING FOR ENFORCEMENT AND PENALTIES, AND CONTAINING OTHER MATTERS RELATING TO THE SUBJECT. Voting "Aye" - Councilman Frank, Councilman Gray, and Councilman Reid. Voting "No" - None Motion passed 3 to 0. MEETING RECESSED AT 8:35 P.M. - RECONVENED AT 8:40 P.M. APPROVAL OF PRELIMINARY PLAT OF DIXIE HOLLOW SUBDIVISION: It was moved by Councilman Reid, seconded by Councilman Gray that the City Council approve the Preliminary Plat of Dixie Hollow Subdivision. Motion passed 3 to 0. DISCUSSION ON RULES OF PROCEDURE - CITY COUNCIL - RESOLUTION NO. 72-4, SECTION I: 1 Councilman Frank asked that this item be postponed to a later meeting until all of the Councilmen could be present for discussion. ORDINANCE NO. 334, AN APPROPRIATION ORDINANCE ADOPTING A BUDGET FOR THE. FISCAL YEAR BEGINNING OCTOBER 1, 1976: Ordinance No. 334 was read in full by Councilman Reid. (First Reading) It was moved by Councilman Reid, seconded by Councilman Frank that Ordinance No. 334 be passed and approved on this first reading. Said Ordinance No. 334 reads in caption as follows: ORDINANCE NO. 334 AN APPROPRIATION ORDINANCE ADOPTING A BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1976, AND ENDING SEPTEMBER 30, 1977. ORDINANCE NO. 335, AN ORDINANCE LEVYING TAXES FOR THE USE AND SUPPORT OF THE MUNICIPAL GOVERNMENT OF THE CITY OF PEARLAND, TEXAS: Ordinance No. 335 was read in full by Councilman Reid. (First Reading) It was moved by Councilman Reid, seconded by Councilman Gray that Ordinance No. 335 be passed and approved on first reading. Said Ordinance No. 335 reads in caption as follows: ORDINANCE NO. 335 AN ORDINANCE LEVYING TAXES FOR THE USE AND SUPPORT OF THE MUNICIPAL GOVERNMENT OF THE CITY OF PEARLAND, TEXAS, AND PROVIDING FOR THE INTEREST AND SINKING FUND OF THE TAXABLE YEAR 1976 AND APPORTIONING EACH LEVY FOR THE SPECIFIC PURPOSE. EXCUSED ABSENCE FROM THE MEETING OF AUGUST 9, 1976 - MAYOR MC COMB AND COUNCILMAN GRAY: It was moved by Councilman Reid, seconded by Councilman Frank that the absence of Councilman Gray and Mayor McComb from the meeting of August 9, 1976 be shown as an excused absence.
