CITY COUNCIL REGULAR MEETING MINUTES
JULY 28, 2025
The City Council of Pearland, Texas convened in a meeting on Monday, July 28, 2025 at the
Pearland City Hall Council Chambers, 3519 Liberty Drive, Pearland, Texas. The following
represents the actions taken by City Council in the order they occurred during the meeting. All
motions are made by Council in consecutive order, as determined by the Mayor.
I.CALL TO ORDER
Mayor J. Kevin Cole called the meeting to order at 6:30 p.m.
II.INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF
AMERICA FLAG AND TEXAS FLAG
Councilmember Byrom gave the Invocation and Boy Scouts Troop 446, led the Pledge
of Allegiance to the United States of America Flag and the Texas Flag.

1.Presentation of the Texas Association of Municipal Information Officers
(TAMIO) 'Most Creative with Least Dollars' Award and Award of
Excellence.
V.CITIZEN COMMENTS
Forgotten Angels performed their signature song, I Love to See You Smile, using
handbells.
Victoria Forsberg, spoke in favor of moving forward with common area fence
improvements in Avalon Terrace Community.

John Jackson, expressed concern regarding the fire code deficiency at the Pearland
Recreation Center.
VI.CONSENT AGENDA
A.Consideration and Possible Action - Approval of the minutes of the
Pearland City Council Special Meeting held on July 14, 2025 and City
Council Regular Meeting held on July 14, 2025.
B.Consideration and Possible Action - Excuse the absence of
Councilmember Rushi Patel from the July 14, 2025 City Council Regular
Meeting.
C.Consideration and Possible Action - Resolution No. R2025-118 - A
Resolution of the City Council of the City of Pearland, Texas, supporting
the City of Pearland’s application to the Parks and Wildlife Department
(TPWD) Local Parks Grants Program call for projects.
D.Consideration and Possible Action - Resolution No. R2025-130 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
a Funding Agreement with the Avalon Terrace Community Association
(Avalon Terrace) for common area fence improvements, in amount not to
exceed $200,000.00.
E.Consideration and Possible Action - Resolution No. R2025-133 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to enter a 3-year Interlocal Agreement
with the Pearland Independent School District for the School Resource
Officer Program, for the period of July 29th, 2025, through July 28th,
2028.
F.Consideration and Possible Action - Resolution No. R2025-102 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
participation in an interlocal cooperative pricing arrangement for the
purchase of Police Department firearm ammunition, in the estimated
amount of $63,471.50, from GT Distributors, Inc.
G.Consideration and Possible Action - Resolution No. R2025-117 - A
Resolution of the City Council of the City of Pearland, Texas, awarding a
contract for the purchase of law enforcement surveillance trailers, to
Industrial Video and Control, in the estimated amount of $147,741.00.
H.Pulled for discussion.
I.Consideration and Possible Action - Resolution No. R2025-109 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
a 3-year contract (3-year initial term; two 1-year renewals) for Water and
Wastewater Operations Software services with Klir, Inc., in the estimated
annual amount of $80,200.00, for the period of July 29, 2025 through July
28, 2028.
J.Consideration and Possible Action - Resolution No. R2025-121 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing

a professional service contract with Data Efficiency Solutions for Utility
Assessment Services, in the amount of $86,484.72.
K.Consideration and Possible Action - Resolution No. R2025-131 - A
Resolution of the City Council of the City of Pearland, Texas, awarding a
supply contract for Chemical Feed Pumps to Macaulay Controls
Company, in the estimated annual amount of $182,278.70, for the period
of July 29, 2025, through July 28, 2026.
L.Consideration and Possible Action - Resolution No. R2025-128 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
an expenditure of the Pearland Economic Development Corporation, in
the amount of $360,000.00, with LandCare USA, LLC for the renewal of a
landscape maintenance service contract (Commercial Corridors and
Entryways), for the period beginning October 1, 2025 through September
30, 2026.
M.Consideration and Possible Action - Resolution No. R2025-122 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
Parks related sidewalk repairs using allocated funds in the Parks
Equipment Recapitalization Program (PK2301) for construction services
related to the construction contract previously awarded to Greenscapes
Six, LLC (Bid #0624-29).
Councilmember Koza made the motion, seconded by Councilmember Carbone
to approve the Consent Agenda items A - M, except H.
AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel.
NAYS: None.
The motion carried.
VII.MATTERS REMOVED FROM CONSENT AGENDA
H.Consideration and Possible Action - Resolution No. R2025-116 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to participate in an interlocal
cooperative pricing arrangement for the purchase of fire alarm
monitoring, fire safety inspection, and fire alarm repair services, from
Firetron, in the estimated amount of $151,325.00, for the period of July
29, 2025, through July 28, 2026.
Councilmember Koza made the motion, seconded by Councilmember
Fernandez to approve Resolution R2025-116.
AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel.
NAYS: None.

VIII.PUBLIC HEARING NO. 1

1. Public Hearing: The second of two public hearings within the required 30-
day comment period for the FY 2026 Community Development Block
Grant (CDBG) Annual Action Plan (HUD Program Year 2025): CDBG
Award No. B-25-MC-48-0400.
This Public Hearing was postponed to August 11, 2025 City Council meeting.
IX.PUBLIC HEARING NO. 2
2.Public Hearing: A request by Nick Motamedi, applicant, on behalf of 24
AC Pearland Parkway, LLC., owner, for approval of a zone change for
3.2816 acres of land from Single-Family Residential-1 (R-1) to General
Business (GB) District, to wit:
Legal Description: A 3.2816-acre tract being out of a 8.84 acres of land in
the T.D. Yocum Survey, Abstract 399 & A.C.H.&B Survey, Abstract 147,
Brazoria County, Texas. Said 8.84-acre tract being comprised of two
tracts of land, Tract 1, being out and a part of a called 18.26 acre tract,
Tract 2, being all of a called 5.5584 acre tract both of record in the name
of 24 AC Pearland Parkway, LLC., in Brazoria County Clerk’s File
(B.C.C.F.) Number 2024000361; save and except all that certain 5.5584
acres, along the east side of Pearland Parkway being part of a 27.12 acre
tract situated in the T.D. Yocum Survey, Abstract 399 & A.C.H.&B Survey,

General Location: East side of Pearland Parkway, North of the John Lizer

Mayor Cole opened the Public Hearing.
Presentation was provided by Katya Copeland, Planning Manager.
Nick Motamedi, applicant, gave a presentation and was present to answer
questions from Council.
There were no citizen comments.
Mayor Cole closed the Public Hearing.
X.NEW BUSINESS
1.Consideration and Possible Action - First Reading of Ordinance No.
2000M-274 - An Ordinance of the City Council of the City of Pearland,
Texas, amending Ordinance No. 2000M, the zoning map of the City of
Pearland, Texas, for the purpose of changing the classification of certain
property; being a 3.2816-acre tract being out of a 8.84 acres of land in the
T.D. Yocum Survey, Abstract 399 & A.C.H.&B Survey, Abstract 147,
Brazoria County, Texas. Said 8.84-acre tract being comprised of two

Councilmember Carbone made the motion, seconded by Councilmember Cade
to approve the first reading of Ordinance No. 2000M-274.

2.Consideration and Possible Action - First and Only Reading of Ordinance
No. 1648 - An Ordinance of the City Council of the City of Pearland,
Texas, authorizing the issuance of City of Pearland, Texas Certificates of
Obligation, Series 2025A; prescribing the terms thereof; providing for the
payment thereof; awarding the sale thereof; making other provisions
regarding such Certificates and matters incident thereto; and declaring
an emergency.
Councilmember Chavarria made the motion, seconded by Councilmember
Cade to approve the first and only reading of Ordinance No. 1648.

Financial Securities.
AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel.

3.Consideration and Possible Action - First and Only Reading of Ordinance
No. 1649 - An Ordinance of the City Council of the City of Pearland,
Texas, authorizing the issuance of City of Pearland, Texas Certificates of
Obligation, Series 2025B; prescribing the terms thereof; providing for the
payment thereof; awarding the sale thereof; making other provisions
regarding such Certificates and matters incident thereto; and declaring
an emergency.

Mayor Pro-Tem Byrom made the motion, seconded by Councilmember
Fernandez to approve the first and only reading of Ordinance No. 1649.

4. Consideration and Possible Action - Resolution No. R2025-126 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the Lower Kirby Pearland Management District (“District”) to issue and
sell bonds (no City of Pearland bond obligations), totaling $7,160,000.00,
for certain drainage and parks projects (Lower Kirby Park and Regional
Detention Land Acquisition) in the District.
Councilmember Cade made the motion, seconded by Councilmember Koza to
approve Resolution No. R2025-126.

AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel.

5. Consideration and Possible Action - First Reading of Ordinance No. 1633-
1 - An Ordinance of the City Council of the City of Pearland, Texas,
amending portions of the Thoroughfare Plan portion of the City’s
Comprehensive Plan; having a savings clause, a severability clause, and
a repealer clause; providing for codification and an effective date.
Councilmember Fernandez made the motion, seconded by Councilmember
Cade to approve the first reading of Ordinance No. 1633-1.
Lauren Fair with BGE, was present to answer questions from the Council.
AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel.
NAYS: None.
The motion carried.
6. Consideration and Possible Action - Resolution No. R2025-127 - A
Resolution of the City Council of the City of Pearland, renewing an
agreement with Cigna for health plan third party administration services,
prescription benefit management services and stop loss coverage;
renewing an agreement with Cigna to provide a fully insured Dental PPO
and Dental HMO plan; renewing an agreement with Unum to continue to

provide a fully insured Vision plan; and renewing an agreement with
Alliance Work Partners to continue to provide an EAP program.
Councilmember Patel made the motion, seconded by Councilmember
Fernandez to approve Resolution No. R2025-127.

AYES: Byrom, Koza, Carbone, Fernandez, and Patel.
NAYS: Chavarria and Cade.

7. Consideration and Possible Action - Resolution No. R2025-129 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to participate in an interlocal
cooperative pricing arrangement for the purchase of Self-Contained
Breathing Apparatus (SCBA), in the estimated amount of $863,384.00,
from Metro Fire Apparatus Specialists, Inc.
Councilmember Koza made the motion, seconded by Councilmember Carbone
to approve Resolution No. R2025-129.
AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel.
NAYS: None.
The motion carried.
8. Consideration and Possible Action - Resolution No. R2025-115 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
participation in interlocal cooperative purchasing programs for the
purchase of twenty-three (23) fleet vehicles, from Sewell, in the amount of
$1,952,834.26.
Councilmember Carbone made the motion, seconded by Councilmember
Fernandez to approve Resolution No. R2025-115.
David Gomez, Fleet Director with Sewell Ford was available for questions.
AYES: Byrom, Carbone, Chavarria, Cade, Fernandez, and Patel.
NAYS: Koza.
The motion carried.
9. Consideration and Possible Action - Resolution No. R2025-108 - A
Resolution of the City Council of the City of Pearland, Texas, awarding a
construction services contract associated with the Pearland Parkway at
Broadway Intersection Improvement Project, to MetroCity, LLC, in the
amount of $1,105,950.00.
Councilmember Chavarria made the motion, seconded by Councilmember

10.Consideration and Possible Action - Resolution No. R2025-99 - A
Resolution of the City Council of the City of Pearland, Texas, awarding
multiple supply contracts (3-year initial term; two 1-year renewals) for
Chemical Reagents, Instrumentation, and Lab Supplies, in the total
annual estimated amount of $578,000.00, for the period of July 15, 2025
through July 14, 2028.
Mayor Pro-Tem Byrom made the motion, seconded by Councilmember Cade
to approve Resolution No. R2025-99.
AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel.
NAYS: None.
The motion carried.
11.Consideration and Possible Action - Resolution No. R2025-125 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
an Interlocal Agreement with Brazoria County for paving services, for the
period of August 11, 2025 through August 10, 2026.
Councilmember Cade made the motion, seconded by Councilmember
Fernandez to approve Resolution No. R2025-125.
AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel.
NAYS: None.
The motion carried.
12.Consideration and Possible Action - Resolution No. R2025-123 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
participation in an interlocal cooperative pricing arrangement for the
purchase of asphalt rehabilitation services from Pavecon, in the
estimated amount of $535,266.38.
Councilmember Koza recused himself from this item.
Councilmember Fernandez made the motion, seconded by Councilmember
Cade to approve Resolution No. R2025-123.
AYES: Byrom, Carbone, Chavarria, Cade, Fernandez, and Patel.
NAYS: None.

13.Consideration and Possible Action - Resolution No. R2025-124 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing

a contract with American Materials, for the purchase of road paving
materials, in the estimated amount of $588,000.00, for the period of

Fernandez to approve Resolution No. R2025-124.

14. Consideration and Possible Action - Resolution Number R2024-62.1 - A
Resolution of the City Council of the City of Pearland, Texas, amending
Resolution No.2024-62, authorizing the power of eminent domain to
acquire fee title to certain property for public facility improvements
related to public safety training, municipal office space, and other
municipal services; all of that certain tract or parcel containing 20.35
Acres (886,331 square feet) of land situated in the H. T. & B. R. R.
Company Survey, Section 19, A-243 , Pearland, Brazoria County, Texas,
being all of a called 20.3472 acre tract of land conveyed to SA 2011 LLC
as described in deed recorded under Brazoria County Clerk’s File
Number (B.C.C.F. No.) 2013002026, in the Official Records of Brazoria
County, Texas for the construction and maintenance of public facility
improvements on certain real property described herein; authorizing the
city attorney, or his designee, and other city officials to take such actions
as are necessary to acquire said property, located within the city, by
donation, purchase, or by the exercise of the power of eminent domain.
Darrin Coker, City Attorney, read the motion into record: Consideration and
Possible Action - Resolution Number R2024-62.1 - A Resolution of the City
Council of the City of Pearland, Texas, amending Resolution No.2024-62,
authorizing the power of eminent domain to acquire fee title to certain property
for public facility improvements related to public safety training, municipal office
space, and other municipal services; all of that certain tract or parcel containing
20.35 Acres (886,331 square feet) of land situated in the H. T. & B. R. R.
Company Survey, Section 19, A-243 , Pearland, Brazoria County, Texas,
being all of a called 20.3472 acre tract of land conveyed to SA 2011 LLC as

Councilmember Carbone made the motion, seconded by Councilmember Koza
to approve Resolution No. R2024-62.1.

Council adjourned into Executive Session at 8:13 p.m.

appointment of a Court Administrator.

Section 551.087 - Deliberations regarding economic development

Section 551.071 - Consultation with City Attorney for legal advice related
to property development regulations.

Council returned from Executive Session at 9:45 p.m.
XIV.NEW BUSINESS CONTINUED
15.Consideration and Possible Action - City Council ratification of the City
Manager's appointment of a Court Administrator.
Councilmember Carbone made the motion, seconded by Councilmember Koza
ratifying the City Manager's appointment of a Court Administrator.
AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel.
NAYS: None.
The motion carried.
XV.ADJOURNMENT
Mayor Cole adjourned the meeting at 9:46 p.m.
