HomeMy WebLinkAbout2024-12-16 Planning and Zoning Regular Meeting MinutesMINUTES OF THE REGULAR MEETING HELD IN -PERSON BY THE PLANNNG AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, MONDAY, DECEMBER 16, 2024, AT 6:30 PM IN PEARLAND ECONOMIC DEVELOPMENT CORPORATION BOARDROOM, CITY HALL, 3519 LIBERTY DR., SUITE 350 CALL TO ORDER Chairperson Henry Fuertes opened the meeting for the P&Z Regular Meeting at 6:38 P.M. In attendance were: P&Z Chairperson Henry Fuertes P&Z Vice Chairperson Derrell Isenberg P&Z Commissioner Thomas Echols P&Z Commissioner Trey Haskins P&Z Commissioner Jennifer Henrichs P&Z Commissioner Jenifer Ordeneaux P&Z Commissioner John McDonald Also, present were Deputy City Attorney Lawrence Provins, Assistant City Engineer Francisco Reyes, Associate Engineer Ramiro Valdez, Planning Manager Katya Copeland, Senior Planner Florence Buaku, and Executive Assistant Jennifer Danley. CONSENT AGENDA All items listed under the "Consent Agenda" are considered to be routine and require little or no deliberation by the Planning & Zoning Commission. These items will be enacted / approved by one motion unless a commissioner requests separate action on an item, in which event the item will be removed from the Consent Agenda and considered by separate action (ix. Matters removed from Consent Agenda). Approval of the Consent Agenda enacts the items of legislation. Consideration and Possible Action - Excused Absences - Excuse the absence of Commissioner Trey Haskins and Commissioner Jennifer Henrichs from the December 2, 2024, P&Z Regular Meeting. Consideration and Possible Action - Approval of Minutes - Approve the P&Z Regular Meeting minutes from December 2,2024. Extension Request for PLAT 22-112 - Preliminary Plat of Magnolia Creek Section 1 A request by Chad Thuman, McKeever LLC, owner; for approval of the Extension of the Expiration date forthe Preliminary Plat of Magnolia Creek Section 1, creating 211 single family lots, 5 reserves, and 9 blocks on 62.54 acres of land located South of CR 100 described to wit: Legal Description: A subdivision of 62.54 acres of land, located in the H.T & B.R.R Co Survey Abstract No. 525, City of Pearland, Brazoria County, Texas. General Location: South of CR 100 (Old Massey Ranch Road), West of McLean Road, Pearland, Texas. Extension Request for PLAT 22-113 - Preliminary Plat of Magnolia Creek Section 2 A request by Chad Thuman, McKeever LLC, owner; for approval of the Extension of the Expiration date for the Preliminary Plat of Magnolia Creek Section 2, creating 71 single family lots, 1 reserve, and 4 blocks on 15.86 acres described to wit: Legal Description: A subdivision of 15.86 acres of land, located in the H.T & B.R.R Co Survey Abstract No. 525, Pearland, Brazoria County, Texas. General Location: South of CR 100 (Old Massey Ranch Road), West of McLean Road, Pearland, Texas. Chairperson Fuertes asked for the motion to approve the Consent Agenda. Commissioner McDonald made the motion to approve the consent agenda, and Commissioner Ordeneaux seconded the motion. Motion passed 7-0. ITEMS REMOVED FROM THE CONSENT AGENDA None. NEW BUSINESS Chairperson Fuertes read into the record the item on Consideration and Possible Action — VARP 24-10: Variance for Minimum Lot Frontage and the Creation of a Flag Lot in the Suburban Residential 12 (SR-12) District. VARP 24-10: Variance from Minimum Lot Frontage and the Creation of a Flag Lot in the Suburban Residential 12 (SR-12) District A request by Adriana Govea of South Texas Surveying Associates, applicant, on behalf Gerhard Wolfgang Tauss and Melissa R. Tauss, owners, for approval of a variance permitted in Section 2.6.1.1 (b)(1) of the Unified Development Code (UDC), Ordinance No. 2000-T, from the requirements of Section 3.2.14.2 (c) of the UDC to allow the creation of a Flag Lot that does not meet the minimum lot frontage, on approximately 3.64 acres of land described to wit: Legal Description: A 3.6418 Acre Tract of Land known as Lot 7 Bethel Subdivision Section 2 an unrecorded Subdivision of 25.9538 acres of land out of Lots 39, 40, 55 AND 58 of the Allison Richey Gulf Cost Home Company Subdivision of Section 19, H.T.&B.R.R. CO. Survey, Abstract 243, Brazoria County Texas. General Location: 2034 Stone Road, Pearland, Texas. Senior Planner Buaku presented the staff report with exhibits. Mrs. Buaku explained that the request involves two variances: one for the minimum lot frontage and another to create a flag lot in the Suburban Residential-12 (SR-12) District. Mrs. Buaku reviewed the property's zoning and provided a brief outline of the plat. Ms. Buaku stated that the variance meets all criteria in the Unified Development Code (UDC), and that staff recommends approval. The applicant, Gerhard Tauss at 2034 Stone Road, Pearland, Texas 77581, was in attendance in - person in the Council Chambers to present to the P&Z Board. Mr. Tauss discussed the reason for the plat. Chairperson Fuertes called for public input. There were no persons wishing to speak for or against the proposed request. There was no further discussion from Staff, P&Z Commission or public input. Vice Chairperson Isenberg made the motion to approve the variances, and Commissioner Ordeneaux seconded the motion. Motion passed 7-0. VARP 24-11: Variance from the Minimum Lot Depth Requirement in the General Commercial (GC) District A request by Hind Saad of RSG Engineering, applicant, on behalf McHard Flex LLC, owner, for approval of a variance permitted in Section 1.1.3.5 (b)(1) of the Unified Development Code (UDC), Ordinance No. 2000-T, from the requirements of Section 2.4.4.6 (c)(1) of the UDC to allow the platting of a property that does not meet the minimum lot depth requirement in the General Commercial District described to wit: Legal Description: Being a 2.073-acre tract of land being part of the south half of Lot 58 of the Zychlinski Subdivision Section 2, A subdivision recorded in Volume 29, Plage 43, Deed Records of Brazoria County Texas, situated in the H.T.& B.R.R Company Survey, Abstract No. 542, in Brazoria County, previously recorded in File No. 2022028687 Official Public Records of Brazoria County Texas. General Location: Northwest of McHard Road and Profax Road Intersection, Pearland, Texas. Senior Planner Buaku presented the staff report with exhibits. Mrs. Buaku explained that the request is for a variance from the minimum lot depth in the General Commercial (GC) District. Mrs. Buaku reviewed the required and proposed lot depth, discussed the property's zoning, and provided details of the plat. Mrs. Buaku stated that the variance meets all UDC criteria, and staff recommends approval. The applicant was not present. Chairperson Fuertes called for public input. There were no persons wishing to speak for or against the proposed request. Chairperson Fuertes commented on the hardship caused to the property by the McHard Road expansion project, noting that such situations should be addressed in the UDC update and approved at the staff level. There was no further discussion from Staff, P&Z Commission or Public input. Chairperson Fuertes read into the record the item on Consideration and Possible Action — VARP 24-11: Variance from the Minimum Lot Depth Requirement in the General Commercial (GC) District. Commissioner Ordeneaux made the motion to approve the variance, and Commissioner Henrichs seconded the motion. Motion passed 7-0. DISCUSSION ITEMS 1. City Council Update Report: Planning Manager Copeland St8[8d that at the {|hv Council's regular meeting on December 9, 2024, ZONE 24-20 failed to gain approval for a zone change from General Business (GB) District to General Commercial (GC) District located at 2849 Cullen Parkway. Mrs. Copeland also Doted that the Council approved the second reading ofunamendment torequiring oside setback for all corner lots not named in the LNFl Clear Creek 8p8Ct[UDO Planned Development Zoning [)iat[ioL 2. Commissioner Activity Report: Vice Chairperson Isenberg reminded the Commissioners to inform Chairperson Fuertea ifthey will be absent. Chairperson Fuertes congratulated Commissioner Henricheongraduating with e master's in civil engineering. 3.
