R2007-4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AMENDING A CONTRACT FOR ENGINEERING SERVICES ASSOCIATED WITH THE ORANGE STREET IMPROVEMENTS. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. (GCE) amend professional engineering services to include the extension of Orange Street by approximately 2000 feet from Hatfield Road to O'Day Road. The project objective is to identify the necessary Right of Way and easement property to be acquired by the City of Pearland for the possible future extension of Orange Street from Hatfield Road to O'Day Road. The scope of work consists of the tasks necessary to identify a schematic alignment for the future segment and the additional land requirements for drainage and utility requirements associated with the future project construction. This segment will have the same Minor Collector classification and have a matching typical cross section as the segment of the roadway currently under design by GCE. ARTICLE I BASIC SERVICES: GCE shall render the following preliminary design services to the OWNER in connection with the Project. A. Preliminary Design Services Attend up to three meetings with the City and other interested parties to discuss alignment and land usage Issues 2 Review information including: hydrologiclhydraulic studies, geotechnical reports and land planning documents from existing sources 3 Review existing data to determine if Wetlands Delineation will be required or if there is a concern requiring an Environmental Assessment 4 Perform an Engineering Study for the proposed 2 lane roadway from Hatfield to O'Day culminating in a conceptual alignment of the roadway, a preliminary design for the drainage plan, and preliminary designs for intersections at Hatfield Road and O'Day Road, recommended Right of Way and Easement acquisition parcel map, in a Letter Report format. 5 Exhibits to be included: a) Utilizing existing typical cross-section for previous segments overlay the recommended roadway and drainage plan alignment on the boundary/ topographic survey. b) Drainage Area exhibit with storm sewer computations, storm water detention pond sizing including the location and outfall plan c) Utility Easement plan for possible future water main 6 Attend three monthly progress meetings during the progress 7 Submit Letter Report of Engineering Study and Right of Way acquisition recommendation in draft form for review and comment. 8 Submit five (5) copies of the fmal report incorporating review comments received from the City. B. Additional Services The following services will be provided upon authorization by the City: 1. Provide environmental services comprising of the following: · Phase I Environmental Site Assessment (ESA) to evaluate the potential of recognized Orange Street Extension from Hatfield Road to O'Day Road Page 1 of6 environmental concerns. The ESA will follow the ASTM International Standard Practice for Environmental Site Assessments E 1527-05 (ASTM E 1527-05). The objective of this ESA is to render an opinion based on the analysis of current and historical data for the potential for environmental liabilities associated with past or current practices of the properties along Old Alvin Road ROW. · Wetland delineation, if applicable. Should the wetland determination identify the presence of wetlands within the project corridor, a biological survey of the property will be performed to determine the presence of significant biological resources. Jurisdictional determination and Corps verification are not included in the scope of services. · Threatened and Endangered Species Determination. Specialized surveys to verify the presence of listed species (i. e., conducting surveys during the nesting season to determine the presence of listed bird speciesO will be a separate scope of services. DELIVERABLES GCE will deliver 3 copies of the Draft Phase I ESA and 3 copies of the Final Phase I ESA. One round of comment resolutions is included in the scope of fees. If no comments are received, the final report will be delivered on the 31 st day after submittal of the draft report. 2. Provide project surveying services - Surveying services will be provided by the GCE subconsultant C. L. Davis and Company. The scope of services and the cost proposal by the subconsultant is attached at the end of this proposal. 3. Provide miscellaneous expenses such as mileage, reproduction, printing, deliveries, etc., "Not to Exceed $800". ARTICLE II ADDITIONAL SERVICES: Additional Services to be performed by GCE, if authorized by OWNER, which are not included in the above described basic services, are described as follows: A. Providing services to investigate existing conditions or facilities, or to make measured drawings thereof, or to verify the accuracy of drawings or other information furnished by OWNER. B. Providing renderings, model and mock-ups requested by the OWNER. C. Making revisions to drawings, when such revisions are 1) consistent with approvals or instructions previously given by OWNER or 2) due to other causes not solely within the control of GCE. D. Performing fmal design, and bidding and construction services. E. Providing environmental support services other than those identified above. F. Design, contract modifications, studies or analysis required to comply with local, State, Federal or other regulatory agencies that become effective after the date of this agreement. G. Providing basic or additional services on an accelerated time schedule. The scope of this service include cost for overtime wages of employees and consultants, inefficiencies in work sequence and Orange Street Extension from Hatfield Road to O'Day Road Page 2 of6 plotting or reproduction costs directly attributable to an accelerated time schedule directed by the OWNER. H. Providing services made necessary because of unforeseen, concealed, or differing site conditions or due to the presence of hazardous substances in any form. I. Preparing statements for invoicing or other documentation for billing other than for the standard invoice for services attached to this professional services agreement. 1. Providing geotechnical engineering services. K. Providing services related to permitting and regulatory approvals. ARTICLE III TIME OF COMPLETION: The Basic services portion of the work of this engineering study will be completed (submittal of Draft Report with exhibits) within 90 days of notice to proceed and receipt of boundary survey. If Additional services are required, those services will be provided outside of the basic services schedule. If GeE's services are delayed or suspended in whole or in part by OWNER, or if GCE's services are extended by the Contractor's actions or in actions for more than 90 days through no fault of GCE, GCE may be entitled to equitable adjustment of rates and amounts of compensation. ARTICLE IV RESPONSILITIES OF OWNER: OWNER shall perform the following in a timely manner so as not to delay the services of GCE: A. Designate a person to act as OWNER's representative with respect to the services to be rendered under this AGREEMENT. Such person shall have contract authority to transmit instructions, receive information, interpret and define OWNER's policies and decisions with respect to GCE's services for the Project. B. Provide all criteria and full information as to OWNER's requirements for the Project, including design objectives and constraints, space, capacity and performance requirements, flexibility and expandability, and any budgetary limitations; and furnish copies of all design and construction standards which OWNER will require to be included in the drawings and specifications. C. Assist GCE by placing at GeE's disposal all available information pertinent to the Project including previous reports and any other data relative to design or construction of the Project. D. Arrange for access to and make all provisions for GCE to enter upon public and private property as required for GCE to perform services under this AGREEMENT. E. Give prompt written notice to GeE whenever OWNER observes or otherwise becomes aware of any development that affects the scope or timing of GCE's services, or any defect or nonconformance of the work of any Contractor. Furnish, or direct GeE to provide, Additional Services as stipulated in the Scope of Services, Article II ofthis AGREEMENT or other services as required. G. Broadway, Pearland, Texas 77581, (281) 412- 7008 Ext. 104) Orange Street Extension from Hatfield Road to 0 'Day Road Page 4 of6 EXHIBIT "B" COMPENSA nON Extension of Orange Street From Hatfield Road to O'Day Road LUMP SUM WITH ADDITIONAL SERVICES BASED ON HOURLY RATES For and in consideration of the services to be rendered by GCE, OWNER shall pay the fees hereinafter set forth. A. COMPENSATION: Exhibit "B" Compensation 1. Preliminary Design Phase: Compensation to GeE for the Preliminary Design Phase services as defined in Article IA of Exhibit "A" shall be a Lump Sum of $57,272.00 If GeE sees the Scope of Services changing so that additional services are needed, GeE will notify OWNER for OWNER's approval before proceeding. 2. Additional Services: For Additional Services as defined in Article IE of Exhibit "A", a total budget of $49,253.00 is proposed. Therefore, the total additional fee for this scope amendment shall be $106,525.00 and the agreement between the OWNER and GCE shall be amended to an overall amount of $518,874. Details concerning the amended fees are included in this Exhibit "B". B COMPENSATION TERMS: 1. "Sub-Consultant Expense" is defined as the expense that is incurred by GCE in employment of others in outside firms for services in the nature of foundation borings, testing, surveying, process design and similar services that are not included in the Basic Services. 2. "Direct Non-Labor Expense" is defined as that expense for any assignment incurred by GCE for supplies, transportation and equipment, travel, communications, subsistence and lodging away from home and similar incidentals in connection with that assignment. C. BASIC SERVICES: 1. Upon authorization from the OWNER, GCE shall proceed with the services outlined in Article IA & B of Exhibit "A". For the purposes of preparing monthly statements for the preliminary and design phase of the Project, GCE shall submit to the OWNER payment requests in proportion to that part of the service which has been accomplished as evidenced by monthly statements. Final payment for Preliminary Design phase shall be due upon the completion of service, whether the work be constructed or not. D. ADDITIONAL SERVICES: Additional Services as described in Article I of Exhibit "A" for this Project shall be invoiced either based on our Schedule of Hourly Rates or sub consultant fee plus 10%, as defined below.
