ORDINANCE NO. 509-789
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, AMENDING ORDINANCE NO. 509, THE LAND USE AND URBAN
DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS, FOR
THE PURPOSE OF CHANGING THE CLASSIFICATION OF CERTAIN REAL
PROPERTY LOCATION BEING 0.0413 ACRES OF LAND OUT OF LOT 22,
SECTION 8, ABSTRACT 504, ALLISON RICHEY GULF COAST HOME
COMPANY SUBDIVISION, CITY OF PEARLAND, BRAZORIA COUNTY,
TEXAS (LOCATED AT 2633 ROY ROAD) (SPECIFIC USE PERMIT
APPLICATION NO. 146) FOR A SPECIFIC USE PERMIT FOR TELEPHONE
EXCHANGE SWITCHING RELAY AND TRANSMITTING EQUIPMENT, IN
THE SUBURBAN DEVELOPMENT DISTRICT (SD(S)) AT THE REQUEST OF
EDWARDS AND KELCEY, APPLICANT FOR SOUTHWESTERN BELL
COMMUNICATIONS, OWNER, PROVIDING FOR AN AMENDMENT OF THE
LAND USE DISTRICT MAP; CONTAINING A SAVINGS CLAUSE, A
SEVERABILITY CLAUSE, AN EFFECTIVE DATE AND OTHER PROVISIONS
RELATED TO THE SUBJECT.
WHEREAS, Edwards and Kelcey, applicant for Southwestern Bell
Communications, owner, filed on May 19, 2005, an application for amendment pursuant
to Section 28 of Ordinance No. 509, the Land Use and Urban Development Ordinance
of the City, for approval of a change in the land use as provided for in said Section 28,
said property being legally described in the original applications for amendment
attached hereto and made a part hereof for all purposes as Exhibit "A"; and
WHEREAS, on the 20th day of June, 2005, a Joint Public Hearing was held
before the Planning and Zoning Commission and the City Council of the City of
Pearland, Texas, notice being given by publication in the official newspaper of the City,
the affidavit of publication being attached thereto and made a part hereof for all
purposes, as Exhibit "B", said call and notice being in strict conformity with provisions
of Section 28.3 and 28.4 of Ordinance No. 509; and
WHEREAS, on the 151 day of July, 2005, the Planning and Zoning Commission
of the City submitted its report and recommendation to the City Council regarding the
proposed amendment application by Edwards and Kelcey, applicant for Southwestern

Bell Communications, owner, whereby the Commission recommended approval of the
Specific Use Permit for Telephone Exchange Switching Relay and Transmitting
Equipment, in the Suburban Development District (SD(S)); and
WHEREAS, upon receipt of the report from the Planning and Zoning
Commission, the City Council considered this application and the recommendation of
the Planning and Zoning Commission at a regular meeting on July 11, 2005; and
WHEREAS, the City Council having fully heard the testimony and argument of
all interested parties, and having been fully advised in the premises, finds that in the
case of the application of Edwards and Kelcey, applicant for Southwestern Bell
Communications, owner, presented which, in the judgment of the City Council, would
justify the approval of said application; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
I.
The following described property located within the corporate City limits of the
City of Pearland, Texas, and presently classified as Suburban Development District
(SD) is hereby zoned for a Specific Use Permit for Telephone Exchange Switching
Relay and Transmitting Equipment, in the Suburban Development District (SD(S)),
such property being more particularly described as:
0.0413 acres of land out of Lot 22, Section 8, Abstract 504, Allison Richey Gulf
Coast Home Company Subdivision, City of Pearland, Brazoria County, Texas
(Located at 2633 Roy Road)
II.
The City Council of the City of Pearland finds and determines that the recitations

in the preamble hereof are true and that all necessary prerequisites of law have been
accomplished and that no valid protest of the proposed change has been made. The
City Council further finds and determines that there has been compliance with the
mandates of law in the posting and presentation of this matter to the Planning and
Zoning Commission and to the City Council for consideration and decision.
III.
The City Council of the City of Pearland finds and determines that the
amendment adopted herein promotes the health, safety, and general welfare of the
public and is a proper valid exercise of the City's police powers.
IV.
If any section, subsection, sentence, clause, phrase, or portion of this Ordinance
is for any reason held invalid or unconstitutional by any court of competent jurisdiction,
such portion shall be deemed a separate, distinct, and independent provision and such
holding shall not affect the validity of the remaining portions thereof.
V.
All rights and remedies, which have accrued in the favor of the City under this
Ordinance and its amendments thereto, shall be and are preserved for the benefit of
the City.
VI.
The City Secretary is hereby directed to cause to be prepared an amendment to
the official Land Use District Map of the City, pursuant to the provisions of Section 2 of
Ordinance No. 509 and consistent with the approval herein granted for the
reclassification of the herein above described property.

Screening Standards for Telecommunications Switching
Stations etc. - DRAFT
Planning staff did a quick research and looked into some other cities in Texas to see
what kind of screening standards they had. We looked at Missouri City, Sugarland,
West University, Bellaire, Houston, Friendswood, Plano, McKinney, and Richardson.
Below is a brief summary of findings. I am attaching copies of the standards that we
did find with this memo.

Missouri City — Yes.
Require ground -mounted equipment, within view of roadways and driveways used by
general public, to be screened by masonry walls. Ground mounted equipment, not

landscaping. The screening standards are further detailed under Landscaping
requirements. Seems like this requirement is only for non-residential, condominium and
multifamily residential development. Copy of the ordinance attached.
Sugarland - Maybe be considered accessory and required to be screened.
Nothing in the code to address this. The planner indicated that if these are accompanied
by a building, then they are considered as accessory facilities and may be required to be

CONFORMANCE TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE: The
subject property is currently zoned SD, which does not have any minimum lot size or width
requirements. The subject property is 30 feet wide and 60 feet deep, for a total square
footage of 1,800 square feet.
PLATTING STATUS: The subject property is owned by Southwestern Bell and is a
dedicated easement that is filed for record. No further platting is required at this time.

property and for all of the surrounding properties within this general area. The
Comprehensive Plan further indicates that the appropriate zoning districts for "Business
Commercial" are the General Business District (GB) and the Commercial District (C).
Since the proposed specific use permit provides for a facility for a utility company and is
allowed within this zoning district by approval of a specific use permit, the proposed
specific use permit conforms to the Comprehensive Plan.
CONFORMANCE TO THE THOROUGHFARE PLAN: The subject property has frontage
on Roy Road, a major collector street with an ultimate right-of-way of 80 feet that is to be

widened in the future as necessary.
No other roadways affect the subject property.
AVAILABILITY OF UTILITIES: There is no City water and sewer service available for the
subject property. Utility service will be reviewed as part of the application for a building
permit.
IMPACT ON EXISTING AND FUTURE DEVELOPMENT: The subject property is already
developed with the telephone switching station. The addition of an additional building or
switching cabinets to the subject property should not have a negative impact on the
adjacent neighborhoods.
SPECIFIC USE PERMIT CONSIDERATIONS: The following is a list of items that should
be considered as a part of the Specific Use Permit:
1. Fence. The subject property is currently enclosed with a chain link fence with
screening slats. The Council and Commission may want to include a specific type
of fencing or upgrade to the existing fence as an enclosure around the facility.
2. Landscaping. The Council and Commission may want to include specific types of
landscaping around the subject property to enhance the appearance of the subject
property.
3. Building Facade. The Council and Commission may want to include specific types
of building facade materials for the construction of the new structures on the subject
property.
PUBLIC COMMENTS: Public notice/comment forms were mailed to property owners
within 200 feet of the subject property under consideration. A legal notice of public hearing
was published in the local newspaper, and a Zoning Sign was placed on the subject
property.
STAFF RECOMMENDATION: Staff recommends approval of specific use permit, as
proposed by the applicant, for the following reasons:

1. The proposed specific use permit does not conflict with the "Business Commercial"
as recommended by the Comprehensive Plan, thereby being in conformance with
the Comprehensive Plan.
2. The proposed specific use permit provides for a telephone switching station to serve
the nearby residential neighborhoods.
3. The applicant is proposing to add additional features to the existing SBC site, which
would not cause a negative impact on the surrounding neighborhood.
