MINUTES OF THE REGULAR MEETING HELD IN -PERSON BY THE PLANNNG AND ZONING
COMMISSION OF THE CITY OF PEARLAND, TEXAS, MONDAY, JUNE 16, 2025, AT 6:30 PM
IN COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DR.
CALL TO ORDER
Chairperson Henry Fuertes opened the meeting for the Planning and Zoning Regular Meeting at
6:31 P.M.

CONSENT AGENDA
All items listed under the "Consent Agenda" are considered to be routine and require little or no
deliberation by the Planning and Zoning Commission. These items will be enacted / approved by
one motion unless a commissioner requests separate action on an item, in which event the item
will be removed from the Consent Agenda and considered by separate action (ix. Matters
removed from Consent Agenda). Approval of the Consent Agenda enacts the items of legislation.
A. Consideration and Possible Action - Approval of Minutes - Approve the P&Z Regular
Meeting minutes from June 2, 2025.
B. Consideration and Possible Action - RPL2025-0200: Final Plat of Massey Oaks Harkey
Road Street Dedication Section 1
A request by RG Miller, DCCM, applicant; on behalf of Castle Rock Communities, LLC,
Meritage Homes of Texas LLC, Brazoria County Municipal Utility District No. 69, and City of
Pearland, owners; for approval of the Final Plat of Massey Oaks Harkey Road Street
Dedication Section 1 dedicating a 100-foot-wide section of Street Right of Way with 2 reserves
for Harkey Road on ± 7.6169 acres of land located south of Old Massey Ranch Road,
described to wit:
Legal Description: A subdivision of 7.6169 acres of land located in the H. Stevens survey, A-
593, and the CW Groos Survey, A-525, City of Pearland, Brazoria County, Texas.
General Location: Harkey Road south of Old Massey Ranch Road, Pearland, Texas.
Chairperson Fuertes and Commissioner Ordeneaux recused themselves and left the meeting at
6:33 pm.

Vice Chairperson Isenberg asked for the motion to approve items A. and B. on the Consent
Agenda. Commissioner Echols made the motion to approve items A. and B. on the Consent
Agenda and Commissioner Henrichs seconded the motion.
Motion passed 5-0.
ITEMS REMOVED FROM THE CONSENT AGENDA
Vice Chairperson Isenberg made the motion to remove items C and D from the consent agenda.
C. Consideration and Possible Action - RPL2025-0211: Preliminary Plat of Arcadian Estates
Section 3
A request by Andrew Lang, of BGE, the applicant; on behalf of KL LB BUY 4 LLC, owner; for
approval of the Preliminary Plat of Arcadian Estates Section 3, creating 27 single-family lots, 3
reserves, and 2 blocks on 14.51 acres of land located south of Old Massey Ranch Road
described to wit:
Legal Description: A subdivision of 14.51 acres of land located in the H.T. & B.R.R. Co.
Section 32, Survey, A-525, City of Pearland, Brazoria County, Texas.
General Location: South of Old Massey Ranch Road, East of the Future Harkey Road and
West of McLean Road, Pearland, Texas.
D. Consideration and Possible Action - RPL2025-0212: Preliminary Plat of Arcadian Estates
Section 4
A request by Andrew Lang, of BGE, the applicant; on behalf of KL LB BUY 4 LLC, owner; for
approval of the Preliminary Plat of Arcadian Estates Section 4, creating 49 single-family lots, 3
reserves, and 2 blocks on 19.17 acres of land located south of Old Massey Ranch Road
described to wit:
Legal Description: A subdivision of 19.17 acres of land located in the H.T. & B.R.R. Co.
Section 32, Survey, A-525, City of Pearland, Brazoria County, Texas.
General Location: South of Old Massey Ranch Road, East of the Future Harkey Road and
West of McLean Road, Pearland, Texas.
Senior Planner Bauer presented the staff report with exhibits. Mr. Bauer stated that the request is
for approval of the Preliminary Plat of Arcadian Estates Section 3, which proposes 27 single-family
lots and three reserves. He reviewed the zoning map and Plat, noting that staff recommends
approval of the Preliminary Plat with conditions. Mr. Bauer then presented the Preliminary Plat of
Arcadian Estates Section 4, which proposes 49 single-family lots and three reserves. He briefly
described the zoning map and Plat and confirmed that staff also recommends approval with
conditions. Planning Manager Copeland stated that some regional infrastructure improvements
remain outstanding, and presented two recommended staff conditions:
1. The Final Plat cannot be submitted until the regional infrastructure improvements have
been completed.
2. A development agreement addressing the regional infrastructure improvements must be
drafted prior to Final Plat submittal.
Deputy City Attorney recommended consolidating the conditions into a single requirement: The
Final Plat not be submitted until the regional infrastructure necessary to support Arcadian Estates
Section 3 and 4 is accepted by the City or a development agreement is entered between the

developer and the City addressing the infrastructure improvements.
Andrew Lang of BGE, located at 10777 Westheimer Road, Suite 500, Houston, Texas 77042, was
present in person in the Council Chambers to present to the Planning and Zoning Commission.
Mr. Lang stated the applicant agrees to the infrastructure improvements in front of the
development and requested clarification on the regional infrastructure improvements. Staff
clarified the location of the required improvements.
There was no further discussion from Staff, Planning and Zoning Commission, or public input.
Deputy City Attorney Provins requested a motion to approve RPL2025-0211: Preliminary Plat of
Arcadian Estates Section 3. Commissioner Haskins made the motion to approve the Plat, and
Commissioner McDonald seconded the motion.
Commissioner Haskins and Commissioner McDonald expressed agreement with staff's
recommended condition.
Motion passed 5-0.
Deputy City Attorney Provins then requested a motion to approve RPL2025-0212: Preliminary Plat
of Arcadian Estates Section 4. Commissioner Haskins made the motion to approve the Plat, and
Commissioner Echols seconded the motion.
Commissioner Haskins and Commissioner Echols expressed agreement with staff's
recommended condition.
Motion passed 5-0.
NEW BUSINESS
Vice Chairperson Isenberg read into the record the item on Consideration and Possible Action —
Zone Change Application: ZON2025-0163.

Public Hearing: A request by Gromax Development, LLC, applicant, on behalf of the owner,
Naseer and Sherida Mohamed, for approval of zone change for 0.233 acres (10,152 sf) of land
from Single -Family Residential- 2 (R-2) to Single -Family Residential-4 (R-4) District, to wit:
Legal Description: Lot 1, Block 2, Buena Vida Subdivision, Brazoria County, Texas, according to
the map or plat thereof, recorded in Volume 8, Page 68 of the Plat Records of Brazoria County
Texas.
General Location: Southeast corner of the Wagon Trail Road and Cantu Street, Pearland, Texas.
Planner II Peterson presented the staff report with exhibits. She explained that the request is for
approval of a zone change from Single -Family Residential-2 (R-2) District to the Single -Family
Residential-4 (R-4) District to allow for the development of a two-family dwelling. Ms. Peterson
noted that staff received a petition with 29 signatures in opposition to the request. She reviewed
the property's history and stated the proposed zone change meets all approval criteria outlined in
the Unified Development Code (UDC) and staff recommends approval of the request.
Applicant Paul Grohman, located at 2116 Kildare Drive, Pearland, Texas 77581, was present in
person in the Council Chambers to present to the Planning and Zoning Commission. Mr. Grohman
discussed the history and development of the property and stated he was available for questions.

Chairperson Fuertes called for public input.
Resident Lisa Cuevas, 5729 Ochoa Road, Pearland, Texas 77584, stated her opposition to the
zone change and expressed concerns about the impact on the character of the community.
Resident Yolanda Gardner, 5802 Cantu Road, Pearland, Texas 77584, stated her opposition to
the request and raised concerns about infrastructure and drainage.
Resident Benjamin Gardner, 5805 Cantu Road, Pearland, Texas 77584, voiced opposition and
expressed concerns about increased ground water saturation.
Resident Rebecca Uresti, 5726 Cantu Road, Pearland, Texas 77584, expressed concerns related
to flooding, increased traffic, and noted that the owner purchased the property knowing it was
zoned for single-family use.
Resident Thomas Severson, 5722 Cantu Road, Pearland, Texas 77584, stated his opposition,
citing flooding, parking, traffic, and safety concerns.
Resident Andriana Severson, 5722 Cantu Road, Pearland, Texas 77584, also opposed the
request, expressing concerns about increased traffic, crime, and pollution.
The Commissioners discussed permitted uses and development standards in the R-2 versus R-4
zoning districts. Staff clarified that a duplex would require a Conditional Use Permit (CUP) in the
R-4 District, and that the applicant would need to return to request that approval. Commissioner
McDonald inquired about flooding concerns, to which Assistant City Engineer Reyes responded
that the proposed development would not significantly impact the drainage. Vice Chairperson
Isenberg recommended that the applicant engage with surrounding neighbors regarding the
proposed development.
There was no further discussion from Staff, Planning and Zoning Commission, or public input.
Vice Chairperson Isenberg read into the record the item on Consideration and Possible Action —
Conditional Use Permit Application — CUP2025-0153. Commissioner Haskins made the motion to
approve the CUP, and Commissioner Henrichs seconded the motion.
Motion failed 2-3.

Zone Change Application: ZON2025-0164.

Public Hearing: A request by Paul Grohman, Gromax Development, LLC., applicant, on behalf of
Key Star Capital Fund 111 LP, owner, for approval of a zone change for 2.56 acres of land from
Single -Family Residential- 2 (R-2) District to General Business (GB) District, to wit:
Legal Description: A 2.56-acre tract being out of a 4.222-acre tract of land in the H.T. & B.R.R.
Co. Survey, Abstract No. 509, Brazoria County, Texas. Said 4.222 acre tract is described as being
the east half (1/2), of the northeast one fourth (1/4), of the northeast one fourth (1/4), of the
northeast one fourth (1/4) of Section 14 of said survey; said 4.222 acre tract is further described
as being a part of three tracts of land described in deed to Majestic Christian Center as recorded
in Clerk's File No. 96- 032710 and 96-032715 in the Brazoria County Clerk's Office; save and
except all that certain 0.5842 acre out of F.B. Drake survey, Abstract Number 509 and all that
certain 7,358 square feet out of F.B. Drake survey, Abstract Number 509.

General Location: Southwest Corner of Magnolia Parkway and McLean Road, Pearland, Texas.
Senior Planner Bauer presented the staff report with exhibits. He stated the request is for approval
of a zone change from the Single -Family Residential-2 (R-2) District to the General Business (GB)
District to allow for retail development. Mr. Bauer noted that staff received 34 public comments in
opposition to the request and one walk-in inquiry seeking additional information. He provided a
summary of the property's history and a brief overview of the review criteria. Mr. Bauer concluded
that the zone change meets some of the approval criteria outlined in the UDC, and staff is unable
to recommend approval.
The applicant, Paul Grohman, residing at 2116 Kildare Drive, Pearland, Texas 77581, was present
in person in the Council Chambers to present to the Planning and Zoning Commission. Mr.
Grohman discussed the proposed development and stated that he was available to answer any
questions from the Commission.
Chairperson Fuertes called for public input.
There were no persons wishing to speak for or against the proposed request.
The Commissioners discussed concerns related to traffic and development, the existing conditions
of McLean Road, and that a lesser commercial zoning designation, such as Neighborhood
Services (NS), might be more appropriate.
There was no further discussion from Staff, the Planning and Zoning Commission, or public input.
Vice Chairperson Isenberg read into the record the item on Consideration and Possible Action —
Zone Change Application: ZON2025-0164. Commissioner Haskins made a motion to approve the
zone change, and Commissioner Echols seconded the motion.
Motion failed 0-5.
Chairperson Fuertes and Commissioner Ordeneaux returned to the meeting at 7:40 pm.

Conditional Use Permit Application — CUP2025-0179.

Public Hearing: A request by Cody Rogers, ALJ Lindsey LLC., applicant, on behalf of Presidio
Equities LLC., owner, for approval of a Conditional Use Permit (CUP) for Food Sales On or Off
Premise use within the Light Industrial (M-1) District, on approximately 0.8278 acres of land, to wit:
Legal Description: Lot 2, Block 1, Minor Plat of Rice Drier Commercial Park No. 2, a subdivision
in Brazoria County, Texas, according to the filed plat recorded in County Clerk's File No.
2023030527 in the Plat Records of Brazoria County, Texas.
General Location: 1818 Main Street, Pearland, Texas.
Senior Planner Bauer presented the staff report with exhibits. Mr. Bauer explained that the request
was for the approval of a Conditional Use Permit (CUP) to allow for a coffee shop within the Light
Industrial (M-1) District. He noted that staff had not received any public comments either in
support of or opposition to the request and provided a review of the property's history. Mr. Bauer
stated that the CUP meets all seven approval criteria outlined in the UDC, and that staff

recommends approval with the following condition:
1. The exterior building facades shall be developed in substantial conformance with the
materials as depicted in the facade renderings.
The property owner, Bobby Orr, representing Presidio Equities, LLC, located at 1717 St. James
Place, Suite 680, Houston, Texas 77056, was present in person in the Council Chambers to
present to the Planning and Zoning Commission. Mr. Orr discussed the history of the property's
development.
The applicant, Cody Rogers, of ALJ Lindsey, LLC, located at 18635 North Eldridge Parkway, Suite
200, Tomball, Texas 77377, was present in person in the Council Chambers to present to the
Planning and Zoning Commission. Mr. Rogers discussed the TxDOT Traffic Impact Analysis (TIA),
stated that the storm sewer would be extended to the south, and indicated that they were available
to answer any questions from the Commission.
Chairperson Fuertes called for public input.
There were no persons wishing to speak for or against the proposed request.

Conditional Use Permit Application: CUP2025-0179. Commissioner McDonald made the motion to
approve the CUP, and Vice Chairperson Isenberg seconded the motion.
Commissioner McDonald made a motion to include the staff's recommended condition, and Vice
Chairperson Isenberg seconded the motion.
Motion passed 7-0.
Chairperson Fuertes read into the record the item on Consideration and Possible Action — 5-year
Capital Improvement Program 2026-2030.
Consideration and Possible Action - 5-year Capital Improvement Program 2026-2030
Public Hearing: The City of Pearland Five -Year Capital Improvement Program (CIP) has been
developed in order to further City's commitment to the citizens of Pearland by working to meet
today's needs, as well as those of the future. The development of the CIP is a continuous process
and hence, should be viewed as a working document. While the program includes five-year
planning, every year, staff works closely with various departments to update the program in order
to accommodate new projects and reflect changings needs.
Assistant Director of Capital Projects Fabiola De Carvalho presented the 5-year Capital
Improvement Program for 2026-2030.
The Commissioners discussed the projected cost, numerical data, and proposed projects.
There was no further discussion from Staff, the Planning and Zoning Commission, or public input.
Chairperson Fuertes read into the record the item on Consideration and Possible Action — 5-year
Capital Improvement Program 2026-2030. Commissioner McDonald made the motion approve the
CIP 2026-2030, and Vice Chairperson Isenberg seconded the motion.

DISCUSSION ITEMS
1. City Council Update Report: Deputy Director Griggs reported that, at the June 9, 2025,
City Council meeting, the Council approved the second reading of ZONE24-28 a zone
change from Light Industrial (M-1) and Heavy Industrial (M-2) Districts to Planned
Development (PD) District for a proposed RV, trailer, and boat storage facility located
at Dixie Farm Road and Main Street. Mr. Griggs also reported that the Council
approved the first reading of ZON2025-0069, a zone change from Single -Family
Residential-2 (R-2) District to General Business (GB) District for properties located on
the north and south sides of Pearland Parkway, across from Shallow Creek Drive and
north of the Center at Pearland Parkway.
2. City Council and Planning and Zoning Joint Workshop: June 30, 2025
Next Planning and Zoning Regular Meeting: July 7, 2025
