MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, HELD
ON APRIL 5, 1976, AT 7:30 P. M. IN THE CITY HALL, 2335 N. TEXAS AVENUE, PEARLAND,

HELD ON APRIL 3, 1976, INCLUDING RESOLUTION AND ORDER DECLARING
THE RESULTS OF SAID ELECTION AND ANY OTHER BUSINESS PERTINENT
TO SAID ELECTION.
2. DISCUSSION WITH CITIZENS OF SLEEPY HOLLOW SUBDIVISION REGARDING
BUILDING LOTS.
RESULTS OF THE CITY OFFICERS' ELECTION REGULAR AND SPECIAL:
Mayor McComb read the official tabulation of cumulative votes as certified by
central counting station in Angleton.

It was moved by Councilman Griffin, seconded by Councilman Frank that Resolution
No. 76-7 be adopted. Said Resolution No. 76-7 reads as follows:

On this the 5th day of April, 1976, the City Council of the City of Pearland,
Texas convened in Special called session open to the public at the regular meeting
place thereof with the following members present, to-wit:

among other proceedings had were the following:
Councilman Griffin introduced a resolution and order and moved its adoption.
The motion was seconded by Councilman Frank, and the motion carrying with it the
adoption of the resolution and order prevailed by the following vote, AYES:
Councilman Frank, Councilman Reid, Councilman Griffin, Councilman Farley, NOES:
None. The resolution is as follows:
There came on to be considered the returns of an election held on the 3rd
day of April, 1976, for the purpose of electing the hereinafter named officials,
and it appearing from said returns, duly and legally made, that there were cast at
said election 1,429 valid and legal votes; that each of the candidates in said
election received the following votes:

THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
That said election was duly called; that notice of said election was given in
accordance with law, and that said election was held in accordance with law, and
that pursuant to valid ballots cast Harry Farley was duly elected City Councilman
Position 2 of said City; and Tom Reid was duly elected City Councilman Position 4
of said City, at said election, and said above named parties are hereby declared
duly elected to said respective offices, subject to the taking of their oaths and
filing bond as provided by the laws of the State of Texas.
That further, according to the valid ballots cast in the Special Election for
Councilman Position 3 (unexpired term) a runoff election becomes necessary between
Daniel G. Shaw and Terry Gray inasmuch as no one candidate for said office received
a majority of all votes cast in said election. Said runoff election shall be called
and held pursuant to Section 5.06 of the Home Rule Charter of the City and appli-
cable provisions of the Election Code of the State of Texas.
It is further found and determined that in accordance with the order of this
governing body the Secretary posted written notice of the date, place and subject
of this meeting on the bulletin board located in the City Hall, a place convenient
and readily accessible to the general public, and said notice having been so
posted and remaining posted continuously for at least 72 hours preceding the
scheduled time of said meeting. A copy of the return of said posting shall be
attached to the minutes of this meeting and shall be made a part thereof for all
intents and purposes.
PASSED, ADOPTED, AND APPROVED THIS THE 5th day of April, A. D. 1976.

and administered the Oath of Office to the newly elected Councilmen.
RESOLUTION NO. 76-8, ADOPTING PROVISIONS OF ARTICLE 7.15, AND OTHER PERTINENT
PROVISIONS OF THE TEXAS ELECTION CODE:
Resolution No. 76-8 was read in full by Mayor McComb.
It was moved by Councilman Farley, seconded by Councilman Griffin that Resolution
No. 76-8 be adopted. Said Resolution No. 76-8 reads in caption as follows:

RESOLUTION NO. 76-9, ORDERING THE HOLDING OF A CITY RUNOFF ELECTION:
Resolution No. 76-9 read in full by Councilman Griffin.
It was moved by Councilman Reid, seconded by Councilman Frank that Resolution No.
76-9 be passed and approved as submitted. Said Resolution No. 76-9 reads in caption
as follows:

A RESOLUTION AND ORDER OF THE CITY COUNCIL OF THE CITY OF
PEARLAND, TEXAS, ORDERING THE HOLDING OF A CITY RUN-OFF
ELECTION ON THE 8TH DAY OF MAY, 1976, FOR THE PURPOSE OF
ELECTING ONE COUNCILMAN FOR THE UNEXPIRED TERM OF COUNCIL-
MAN POSITION NO. 3 IN AND FOR THE CITY OF PEARLAND, TEXAS;
AND ESTABLISHING PROCEDURES FOR SAID RUN-OFF ELECTION.
Voting "Aye" - Councilman Frank, Councilman Reid, Councilman Farley, Councilman
Griffin.
Voting "No" - None.
Motion passed 4 to 0.
DISCUSSION WITH CITIZENS OF SLEEPY HOLLOW SUBDIVISION REGARDING BUILDING LOTS:
Mr. Mike Coppinger spoke on behalf of the citizens of Sleepy Hollow Subdivision
in protest of the reducing of the building lots sizes from the original filed plat.
Attorney Marshall Ray was also present representing the citizens of Sleepy Hollow.
Mr. Coppinger presented a Zerox copy of a petition containing some 101 names.
It was moved by Councilman Farley, seconded by Councilman Reid that a copy of
these petitions be entered into the records and that the originals be transmitted
to the City Secretary and be made part of the minutes of this meeting.
Motion passed 4 to 0.
Meeting recessed at 8:15 P. M.
It was moved by Councilman Farley, seconded by Councilman Reid that by minute order
of this Council no building permits shall be issued on any lot smaller than the
lot or plot size at the time of the original platting except by permission of the
City Council, and further that the City Attorney be instructed to amend the
Subdivision Ordinance to so state.
Motion passed 4 to 0.
Attorney Marshall Ray spoke to the City Council in regard to the Lot sizes.
