CITY COUNCIL REGULAR MEETING MINUTES
JUNE 23, 2025
The City Council of Pearland, Texas convened in a meeting on Monday, June 23, 2025 at the
Pearland City Hall Council Chambers, 3519 Liberty Drive, Pearland, Texas. The following
represents the actions taken by City Council in the order they occurred during the meeting. All
motions are made by Council in consecutive order, as determined by the Mayor.
I. CALL TO ORDER
Mayor J. Kevin Cole called the meeting to order at 6:30 p.m.
II. INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF
AMERICA FLAG AND TEXAS FLAG
Mayor Cole gave the Invocation and Councilmember Fernandez led the Pledge of
Allegiance to the United States of America Flag and the Texas Flag.
III. ROLL CALL AND CERTIFICATION OF QUORUM

IV. CITIZEN COMMENTS
Leslie Malone expressed concern regarding the need for striping of Pickleball courts at
Independence Park and Centennial Park, as well as the delayed construction project
at 2024 Broadway.
V. CONSENT AGENDA
A. Consideration and Possible Action - Approval of the minutes of the
Pearland City Council Workshop held on June 9, 2025 and City Council
Regular Meeting held on June 9, 2025.
B. Consideration and Possible Action - Approve appointment to citizen
boards and commissions as presented in the staff report.

C. Consideration and Possible Action - Second and Final Reading of
Ordinance No. 2000M-273 - An Ordinance of the City Council of the City
of Pearland, Texas, amending Ordinance No. 2000M, the zoning map of
the City of Pearland, Texas, for the purpose of changing the classification
of certain property; being Exhibit A: A 23.60 acre tract of land situated in
the Thomas J. Green Survey, Abstract Number 198, Brazoria County,
Texas in the City of Pearland, being all of a tract of land described as
Exhibit “A” in the deed to Jennie Settegast Smith recorded in Document
Number 2023034456, Brazoria County Clerk’s Office and a portion of the
remainder of a called 17.850 acre tract described as Tract 2, in the deed
to Marion E. Settegast, Jr., recorded in Volume 1247, Page 922, Brazoria
County Deed Records and Exhibit B: A 11.59 acre tract of land situated in
the Thomas J. Green Survey, Abstract Number 198, Brazoria County,
Texas in the City of Pearland, being all of a tract of land described as
Exhibit “B” in the deed to Jennie Settegast Smith recorded in Document
Number 2023034456, Brazoria County Clerk’s Office (located on the north
and south sides of Pearland Parkway across from Shallow Creek Drive.
North of The Center at Pearland Parkway, Pearland, Texas). Zone Change
Application No. ZON2025-0069, a request by Dunaway, applicant, on
behalf of Jennie Settegast Smith, Sandra Settegast Abadie, Marion E.
Settegast III, Carlita S. Sealy, Marion Sullivan, Third Coast Resources I,
LTD., and Third Coast Resources II, LTD, owners, for approval of a zone
change for 23.60 acres and 11.59 acres of land from Single-Family
Residential- 2 (R-2) District to General Business (GB) District; providing
for an amendment of the zoning district map; containing a savins clause,
and an effective date and other provisions related to the subject.
D. Consideration and Possible Action - Resolution No. R2025-100 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the purchase of contingent workforce services utilizing an existing
interlocal agreement between the City and Harris County, in the annual
estimated amount of $150,000.00, for the period beginning June 24, 2025
through February 27, 2027.

Councilmember Koza made the motion, seconded by Councilmember Cade to
approve the Consent Agenda items A-F except E and F.
AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel.

VI. MATTERS REMOVED FROM CONSENT AGENDA
E. Consideration and Possible Action - Resolution No. R2025-98 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to enter into a Traffic Signal
Reimbursement Agreement with Pelican Builders, for the construction of
Traffic Signal Improvements (Business Center Drive at Town Center
South Driveway).
Councilmember Koza made the motion, seconded by Councilmember Carbone
to approve Resolution No. R2025-98.
AYES: Byrom, Koza, Carbone, and Fernandez.
NAYS: Chavarria, Cade, and Patel.
The motion carried.
F. Consideration and Possible Action - Resolution No. R2025-91 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
participation in an interlocal cooperative purchasing program for the
replacement of airbags and struts, from Siddons Martin Emergency
Group, in the estimated amount of $108,794.85.
Councilmember Koza made the motion, seconded by Councilmember Carbone
to approve Resolution No. R2025-91.
AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel.
NAYS: None.
The motion carried.
VII. PUBLIC HEARING NO. 1
1. Public Hearing: A request by VHR Construction, LLC applicant and
owners, for approval of a Conditional Use Permit (CUP) for Dwelling -
Single-Family Detached use on approximately 0.143 acres (6,250 sq.ft.) of
land within the Old Town-Mixed Use (OT-MU) District, to wit:
Legal Description: Lots 12 and 13, in Block 6 of Pearland Townsite, a
subdivision in Brazoria County, Texas, according to the map or plat
thereof recorded in Volume 29, Page 41 of the Plat Records of Brazoria
County, Texas.
General Location: 2225 North Houston Avenue, Pearland, Texas.
Mayor Cole opened the Public Hearing.

VIII. NEW BUSINESS NO. 1
1. Consideration and Possible Action - Resolution No. R2025-CUP2025-0182
- A Resolution of the City Council of the City of Pearland, Texas,
approving a Conditional Use Permit (CUP) for Dwelling - Single-Family
Detached use on approximately 0.143 acres (6,250 sq.ft.) of land within
the Old Town-Mixed Use (OT-MU) District, being Lots 12 and 13, in Block
6 of Pearland Townsite, a subdivision in Brazoria County, Texas,
according to the map or plat thereof recorded in Volume 29, Page 41 of
the Plat Records of Brazoria County, Texas (2225 North Houston
Avenue). Conditional Use Permit No. CUP2025-0182, for Dwelling -
Single-Family Detached use within the Old Town-Mixed Use (OT-MU)
District, at the request of VHR Construction, LLC applicant and owners,
containing a savings clause, a severability clause, and an effective date
and other provisions related to the subject.
Councilmember Carbone made the motion, seconded by Councilmember
Fernandez to approve Resolution No. R2025-CUP2025-0182.
AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel.
NAYS: None.
The motion carried.
IX. PUBLIC HEARING NO. 2
2. Public Hearing: A request by John Hannah, applicant, on behalf of Blake
Cmajdalka, owner, for approval of a Conditional Use Permit (CUP) for
Accessory Dwelling Unit use within the Single-Family Residential-1 (R-1)
District, on approximately 2.0 acres of land, to wit:
Legal Description: Lot 2 of the Minor Plat of Cmajdalka Estates, a
Subdivision in Brazoria County Texas, according to the map or plat
thereof recorded in Clerk File No. 2020001977 of the Official Public
Records of Brazoria County, Texas.
General Location: 2644 Miller Ranch Road, Pearland, Texas.
Mayor Cole opened the Public Hearing.

X. NEW BUSINESS NO. 2
2. Consideration and Possible Action - Resolution No. R2025-CUP2025-0159
- A Resolution of the City Council of the City of Pearland, Texas,
approving a Conditional Use Permit (CUP) for Accessory Dwelling Unit
use within the Single-Family Residential-1 (R-1) District, on
approximately 2.0 acres of land, being Lot 2 of the Minor Plat of
Cmajdalka Estates, a Subdivision in Brazoria County Texas, according to
the map or plat thereof recorded in Clerk File No. 2020001977 of the
Official Public Records of Brazoria County, Texas (located at 2644 Miller
Ranch Road, Pearland, Texas). Conditional Use Permit Application No.
CUP2025-0159, for Accessory Dwelling Unit use within the Single-Family
Residential-1 (R-1) District, at the request of John Hannah, applicant, on
behalf of Blake Cmajdalka, owner,
Councilmember Chavarria made the motion, seconded by Councilmember
Cade to approve Resolution No. R2025-CUP2025-0159 with the following
condition:
1. The Conditional Use Permit (CUP) shall only allow for the accessory
dwelling unit to be occupied by a person who is related to the person
who occupies the primary dwelling unit on the subject property.
AYES: Carbone and Patel.
NAYS: Byrom, Koza, Chavarria, Cade, and Fernandez.
The motion failed.
XI. PUBLIC HEARING NO. 3
3. Public Hearing: A request to create the Smith Ranch Road Public
Improvement District, on approximately 80-acre area generally located at
the southeast corner of Smith Ranch Road and Hughes Ranch Road.
Mayor Cole opened the Public Hearing.
Presentation provided by Trent Epperson, City Manager; Abdi Yassin, Senior
Vice President with MuniCap, Inc.; Jonathan Pollard, Development Manager;
and Matt Buchanan, President of Pearland Economic Development
Corporation.
Carl Gehring spoke in support of the Public Improvement District.
Richard Atcheson spoke in support of the Public Improvement District.
Paul Edwards spoke in opposition of the Public Improvement District.
Nick Motamedi, Owner with Alimas Properties, Ltd., spoke in support of the
Public Improvement District.

Timm Wooten, Associate with Rockefeller Group, spoke in support of the
Public Improvement District.
Chris Mosley spoke in opposition of the Public Improvement District.
Mayor Cole closed the Public Hearing.
XII. NEW BUSINESS
3. Consideration and Possible Action - Resolution No. R2025-95 - A
Resolution of the City Council of the City of Pearland, Texas, accepting
the final report of the 2025 Charter Review Commission into the official
record of the City.
Mayor Pro-Tem Byrom made the motion, seconded by Councilmember Koza to
approve Resolution No. R2025-95.
Presentation provided by Darrin Coker, City Attorney and Craig Slater, Charter
Review Commission Chair.
AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel.
NAYS: None.
The motion carried.
4. Consideration and Possible Action - Resolution No. R2025-101 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the power of eminent domain to acquire a fee title interest on certain
property for improvements associated with the Mykawa Road Widening
Project; being a 0.2363 acres (10,292 square feet) parcel of land situated
in the H.T.&B.R.R. Co. Survey, A-543, Brazoria County, Texas, being a
portion of a calculated 1,3976 acre tract, Lot 1 and Lot 6, Block 60 of
Brookside Subdivision, a subdivision plat of record in Volume 2, Page
112 of the Brazoria County Deed Records (B.C.D.R.) filed on January 3,
1914, same being out of a tract of land conveyed from Eloisa Garza
(GRANTOR) to Johnny Flores Garza (GRANTEE) by deed executed
October 12, 2017 and recorded under Brazoria County; Clerk’s File
Number (B.C.C.F. No.) 2017050173, of the Official Records of Brazoria
County, Texas, for construction and maintenance of road improvements
on certain real property described herein; authorizing the city attorney, or
his designee, and other city officials to take such actions as are
necessary to acquire said property, located within the city, by donation,
purchase, or by the exercise of the power of eminent domain.

5. Consideration and Possible Action - Resolution No. R2025-94 - A
Resolution of the City Council of the City of Pearland, Texas, amending
the City Council Rules and Order of Business (“Rules”) as guidelines for
the organization and governance of the City Council.
Councilmember Fernandez made the motion, seconded by Councilmember
Cade to approve Resolution No. R2025-94.
AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel.
NAYS: None.
The motion carried.
6. Consideration and Possible Action - City Council selection of the at-large
position for the Advisory Boards and Commissions Recommendation
Committee.
Councilmember Chavarria made the motion, seconded by Councilmember
Koza to select Councilmember Patel as the City Council at-large position.
AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel.
NAYS: None.
The motion carried.
XIII. OTHER BUSINESS

XIV.MAYOR/COUNCIL ISSUES FOR CITY COUNCIL DISCUSSION
There were no other issues to discuss.
XV.EXECUTIVE SESSION UNDER TEXAS GOVERNMENT CODE
Council adjourned into Executive Session at 8:43 p.m.

Conducted.
Council returned from Executive Session at 9:53 p.m.
XVI.ADJOURNMENT
Mayor Cole adjourned the meeting at 9:53 p.m.
