HELD ON OCTOBER 1, 2020 AT 6:00 P.M. IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DR. The following Board Members were present: Mark Lewis, Chairperson Jerry Acosta, Vice -Chair Teresa J. Del Valle, Secretary Don Glenn, Board Member Gary Shrum, Board Member Christopher Tristan, Alternate Natasha Charles, Alternate Nicole Tonini, Alternate The following members were absent: John H. Gehring, Jr., Alternate City Staff: Lawrence Provins, Deputy City Attorney; Martin Griggs, Planning Manager; Florence Buaku, Planner II; and Shelby Lowe, OfficeAssistant. I. CALL REGULAR MEETING TO ORDER Chairperson, Mark Lewis called the meeting to order at 6:06 p.m. II. APPROVAL OF MINUTES OF THE JULY 2, 2020 MEETING Secretary, Teresa J. Del Valle made a motion to approve the July 2, 2020 meeting minutes. Board Member, Don Glenn seconded the motion. Motion approved 5 to 0. III. NEW BUSINESS A ZBA APPLICATION NO. VARZ 20-00008 SPECIAL EXCEPTION FOR THE EXPANSION OF PEARLAND NEIGHBORHOOD CENTER 1. CALL PUBLIC HEARING TO ORDER Chairperson, Mark Lewis opened the public hearing for ZBA Application No. VARZ 20- 00008 at 6:07 p.m. Page 1 of 5 ZBA minutes 10/01/20 2. PURPOSE OF THE HEARING: A request by Deborah Rubestello, applicant on behalf of City of Pearland, owner; for a special exception, as permitted by the Unified Development Code, Ordinance No. 2000-T, to allow the expansion of the Pearland Neighborhood Center building, which has existing non -conformities, located in the Old Town Residential (OT-R) District (Section 2.7.3.7(a)(4))to wit: Legal Description: Being Tract A, Block 1, of Pearland Neighborhood Center, a Subdivision in Brazoria County, Texas according to the map or plat thereof, recorded in C.F 2009-0558611 of the map records of Brazoria County, Texas. General Location: 2335 N Texas Ave Pearland, TX. 3. STAFF REPORT Mrs. Buaku presented the Staff Report with exhibits and information on the case. Mrs. Buaku informed the board of the Special Exception request to allow expansion of existing nonconforming building. Mrs. Buaku explained the three nonconformities, (1) property line encroachment, (2) sewer easement encroachment, and (3) front setback encroachment. She informed the board that no public comments were obtained either in -favor or in opposition on the request. Mrs. Buaku informed the board that staff was recommending approval of the Special Exception. 4. APPLICANT PRESENTATION Deborah Rubestello, 2335 N. Texas Avenue, Pearland, TX. - With the Pearland Neighborhood Center. The Pearland Neighborhood Cervices since 1987, and they provide many multi services in the community. 5. PERSONS WISHING TO SPEAK FOR OR AGAINST THE PROPOSED REQUEST Anna Bryant, 2335 N. Texas Avenue, Pearland, TX. - With the Pearland Neighborhood Center, she is the board president. She would like to move forward with the new building to help serve the community. Stacy Adams, 3408 Nottingham, Pearland, TX. - With the Pearland Neighborhood Center, he is the commissioner. Mr. Adams echoed what Anna said, and reiterate that the new building where the expansion would be, was in compliance. Deborah Brown, 2924 Green Tee Dr. Pearland, TX. - With the Pearland Neighborhood Center, project manager and board member. She encourages the growth in P.N.C. social services in Pearland and hopes that the board approves David Miller, 512 W. Donovan St. Pearland, TX. - Mr. Miller wanted clarification of the Special Exception and what was being proposed. Mr. Province explained. Joel Hardy, with the City of Pearland — Mr. Hardy informed the board and the public, that Page 2 of 5 ZBA minutes 10/01/20 the proposed project was a HUD Funded Community Development Block Grant. The City had been working on it for several years. He informed the board that it had a place on the Action Plan from 2019 and Council had acted in favor to provide the funds to complete the project. 6. STAFF/BOARD/APPLICANT DISCUSSION None 7. ADJOURNMENT OF PUBLIC HEARING Chairperson, Mark Lewis adjourned the public hearing for ZBA Application No. VARZ 20- 00008 at 6:23 p.m. 8. CONSIDERATION AND POSSIBLE ACTION Alternate, Christopher Tristan made a motion to approve the Special Exception. Board member, Don Glenn seconded the motion. The motion passed 5 to 0. IV. OLD BUSINESS A. EXTENSION REQUEST - ZBA APPLICATION NO. VARZ 20-00006 SPECIAL EXCEPTION TO ALLOW A RESIDENTIAL TO OFFICE CONVERSION DISCUSSION - ZBA APPLICATION NO. VARZ 20-00006 A request by Cesar Dominguez and Sandra Barrientos, applicants on behalf of Perez Ernesto and Evelyn Pineda, owners; for an extension of a previously approved variance/special exception as permitted by the Unified Development Code, Ordinance No. 2000-T, to allow reduced building and parking setbacks and reduced landscape buffer to accommodate conversion of a residential structure into office use, (Section 2.7.3.7(b)(7)). Refer to the June 4, 2020 Agenda Packet. CONSIDERATION AND POSSIBLE ACTION - ZBA APPLICATION NO. VARZ 20-00006 A request by Cesar Dominguez and Sandra Barrientos, applicants on behalf of Perez Ernesto and Evelyn Pineda, owners; for an extension of a previously approved variance/special exception as permitted by the Unified Development Code, Ordinance No. 2000-T, to allow reduced building and parking setbacks and reduced landscape buffer to accommodate conversion of a residential structure into office use, (Section 2.7.3.7(b)(7)). Legal Description: A subdivision of a 0.2047-acre tract of land, being all of lot 15 of the Darlinda Addition, according to the Map or Plat recorded in Volume 7 Page 20 of the Plat records of Brazoria County Texas. General Location: 4602 W Broadway, Pearland, TX 1. STAFF REPORT Page 3 of 5 ZBA minutes 10/01/20 Mrs Buaku informed the board that a ZBA variance had been approved June 4, 2020 and according to the UDC, variances were good for up to three months. The applicant was requesting an extension for the variance, due to the need for TexDOT approval for the driveway before being able to submit for permits. Staff is in support of the extension. 2. APPLICANT PRESENTATION Sandra Barrientos, 10675 Mayfield Rd. Pearland, TX. — They are still waiting for TexDOT to approve the driveway in order to submit for permits. 3. PERSONS WISHING TO SPEAK FOR OR AGAINST THE PROPOSED REQUEST None 4. STAFF/BOARD/APPLICANT DISCUSSION Discussions were made on the length of time for the extension period. The board agreed to extend the expiration date for the variance to June 4, 2021 which was the same expiration date for the approved Special Exceptions. Fire Marshall was okay with the current design. 5. ADJOURNMENT OF PUBLIC HEARING Chairperson, Mark Lewis adjourned the public hearing for ZBA Application No. VARZ 20- 00006 at 6:38 p.m. 6. CONSIDERATION AND POSSIBLE ACTION Vice -Chair, Jerry Acosta made a motion to approve the variance with the expiration of June 4, 2021. Secretary, Teresa J Del Valle seconded the motion. The motion passed 5 to O. V.
