The following Board Members were present: Mark Lewis, Chairperson Jerry Acosta, Vice -Chair Don Glenn, Board Member Gary Shrum, Board Member Natasha Charles, Alternate The following members were absent: Teresa J Del Valle, Secretary, John H. Gehring, Jr., Alternate, Christopher Tristan, Alternate and Nicole Tonini, Alternate City Staff: Lawrence Provins, Deputy City Attorney; Martin Griggs, Planning Manager; Florence Buaku, Planner II; and Monica Aizpurua, Office Assistant. I. CALL REGULAR M EETI N G T O O RD ER Chairperson, Mark Lewis called the meeting to order at 6:02 p.m. II. APPROVAL OF MINUTES OF THE JANUARY 7, 2021 MEETING Board Member Don Glenn made a motion to approve the January 7, 2021 meeting minutes. Alternate, Natasha Charles seconded the motion. Motion approved 5 to 0. III. NEW BUSINESS A ZBA APPLICATION NO. VARZ 20-00016 - Special Exceptions for Pearland Animal Hospital 1. CALL PUBLIC HEARING TO ORDER Chairperson, Mark Lewis opened the public hearing for ZBA Application No. VARZ 20 - 00016 at 6:05 p.m. 2. PURPOSE OF THE HEARING: A request by Carrie Sheldon, Helm Design Group LLC, applicant on behalf of Kristofer Schoeffler owner; for a special exception, as permitted by the Unified Development Code, Ordinance No. 2000-T, to allow a new addition to an existing Animal Hospital on a property with nonconformities, in the General Commercial (GC) District (Section 2 7.3.7(a)(4)), to wit: Page 1 of 4 Legal Description: Lot 1, Block 1, of Pearland Animal Hospital, a subdivision recorded in Plat Number 2011035769, Bra7oria County Plat Records, in the H.T & B R.R. Co. survey, Abstract No. 542, Bra7oria County, Texas General Location:1601 N Main Street, Pearland, TX 3. STAFF REPORT Mrs. Buaku presented the Staff Report with exhibits and information on the case. Mrs Buaku informed the board that the City did not receive any Public Comment Forms either in support nor against the request. Mrs Buaku explained the intent of the special exception to address existing non -conforming building and on -street parking along Alice Street. She explained that the building was encroaching into the required 25-foot setback for the zoning district and the water sewer easement. The special exception would keep the existing non - conformities and allow the applicant to construct a new building with associated parking on the site. Mrs Buaku informed the board that staff recommended approval of the request of the Special Exception. 4. APPLICANT PRESENTATION Carrie Sheldon with HELM Design Group — 979 Astoria Ln. ADJOURNM ENT OF PUBLIC HEARING Chairperson Mark Lewis adjourned the public hearing forZBAApplication No. VARZ 20- 000016 at 6:23 p.m. 8. CONSIDERATIONANDPOSSIBLEACTION Vice -Chair, Jerry Acosta made a motion to approve the Special Exception Board member, Don Glenn seconded the motion. The motion passed 5 to 0. B ZBA APPLICATION NO. VARZ 21-00001 - Yost Blvd Fence Variance 1. CALLPUBLIC HEARING TO ORDER Chairperson, Mark Lewis opened the public hearing for ZBA Application No. VARZ 21- 00001 at 6:23 p.m. Pacie 2 of 4 2. PURPOSE OF THE HEARING: A request by Trey Custer, Custer Fence LLC, applicant on behalf of Randall Myers, owner; for a variance, as permitted by the Unified Development Code, Ordinance No 2000-T, to allow a 6-foot front yard fence in lieu of the 4-feet permitted, on a property zoned Single Family Residential 1 (R-1) District, (Section 4.2 4.3(a)(2)(b)), to wit: Legal Description: Being 1.871 acres out of 3.2087 acres in the W.D.0 Hall Survey, Abstract 23 and Abstract 70, Recorded in volume (91)936, Page 676 of the official records of Brazoria County, Texas. General Location: 2920 Yost Blvd, Pearland, TX. 3. STAFF REPORT Mrs Buaku presented the Staff Report with exhibits and information on the case. Mrs Buaku informed the board that the City did not receive any Public Comment Forms either in support nor against the request. She explained that there was a hardship on the property because it was located along Yost Blvd which is a heavily trafficked street. The variance for the 6-footfront yard fence instead of the 4-foot permitted was necessary for the safety of the residents. Staff recommended approval of the variance for the 6-footfront yard fence with a condition. 1. The gate forvehicularaccess along Yost Blvd. shall be setback at least 24 feetfromthe street right-of-way. 4. APPLICANTPRESENTATION Randall Myers — 2950 Yost Blvd. Pearland, TX. 77581 5. PERSONS WISHING TO SPEAKFOR OR AGAINSTTHE PROPOSED REQUEST None 6. STAFF/BOARD/APPLICANT DISCUSSION Discussions were made about the height and location of the proposed fence. Owner Randall Myers explained the materials proposed for the construction of the fence. 7. ADJOURNMENT OF PUBLIC HEARING Chairperson, Mark Lewis adjourned the public hearing forZBA Application No. VARZ 21-00001 at6:43p.m. 8. CONSIDERATION AND POSSIBLEACTION Board member, Don Glenn, made a motion to approve the variance request with staff's condition. Board member Gary Shrum seconded the motion. The motion passed 5 to 0.
