CALL TO ORDER
Chairperson Mark Lewis opened the meeting for the Zoning Board of Adjustments
Regular Meeting at 6:00 P.M.
ZBA Chairperson, Mark Lewis
ZBA Vice Chairperson, Jerry Acosta
ZBA Member, Gary Shrum
ZBA Member, Christopher Tristan
ZBA Alternate Member, John H. Gehring Jr.
Also, present were Deputy City Attorney Lawrence Provins, Planning Manager
Martin Griggs, Planner I Patrick Bauer and Office Assistant Shelby Lowe.
APPROVAL OF MINUTES
Approve the ZBA Meeting'minutes from October 7, 2021.
Chairperson Lewis read into the record the items on Approval of Minutes. Vice
Chairperson Acosta made the motion to approve, Alternate Member Gehring
seconded the motion.
Motion passed 5-0.
NEW BUSINESS
Chairperson Lewis read into the record the items on Consideration and Possible
Action — VARZ 21-00019g Side Setback Variance for Development in the Light
Industrial (M-1) Zoning District.
CONSIDERATION AND POSSIBLE ACTION — VARZ 21-00019: SIDE SETBACK
VARIANCE FOR DEVELOPMENT IN THE LIGHT INDUSTRIAL (M-1) ZONING
DISTRICT
A request by Cool the Air LLC, applicant, and owner, to allow a variance as
permitted by the Unified Development Code, Ordinance No 2000-T, to allow
reduced side setbacks for a proposed office warehouse in the Light Industrial (M-1)
District (Section 2.4.4.7), to wit:
Legal Description: 0 8513 acres (37,082 SF) of land, being Lot B of Magnolia
Business Park, recorded in Volume 18, Pages 39-40 B.C.P.R, in the A.C.H & B
Survey, Abstract 147, Brazoria County, Texas.
General Location: North and West of 3426 Main Street, Pearland, TX.
P lanning Manager Griggs presented the staff report with exhibits. Planning Manager
Griggs informed the board that the variance meets most of the criteria for approval.
S taff recommends approval of this variance.
Applicant Representative, Juan Huevos with Cool the Air LLC, at 120 Canal Drive,
Friendswood, Texas 77546, was in attendance in -person in Council Chambers to
present to the ZBA Board. Mr Huevos asked if he could show the board the site
plan. He said that the site might need more variances in the future but his engineers
said that he would just need a variance on the North and South side of the property.
Mr. Huevos explained the driveways as well.
Chairperson Lewis called for public input.
There were no persons wishing to speak for or against the proposed request.
Chairperson Lewis asked staff about the side setback wanting to be reduced.
P lanning Manager Griggs stated that staff worked with the applicant representative
requesting for the additional information to be provided, but they did not submit it.
P lanning Manager Griggs stated that the dumpsters location would trigger the need
for another variance, and the applicant didn't provide a fully developed site plan
because they still wanted to move forward with the ZBA request.
Deputy City Attorney Prowls told Chairperson Lewis that if they review the site plan
today that they would not have staff's review of the site, which would not be a fully
and proper review.
Vice Chairperson Acosta asked if the board could postpone the vote.
Member Shrum asked staff if the details of the warehouse or office space wouldn't
change the recommendation of the 12.5-foot setback.
P lanning Manager Griggs said staffs analysis is based only on the building
setbacks, but that the site plan would need to be further developed for access and
there will need to be more review to gain full approval.
N o further discussion from Staff, ZBA Board or Public input.
Chairperson Lewis read into the record the items on Consideration and Possible
Action — VARZ 21-00019: Side Setback Variance for Development in the Light
Industrial (M-1) Zoning District. Vice Chairperson Acosta made the motion to
postpone the vote until the ZBA Board receives more information on the site,
Member Tnstian seconded the motion.
Motion passed 5-0.
