R2007-001 2007-01-08 RESOLUTION NO. R2007-1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING THE SALE OF PROPERTY HELD IN TRUST BY THE CITY. WHEREAS, City of Pearland, Trustee for itself and other taxing authorities ("taxing authorities"), has foreclosed and will foreclose on property ("the property") through delinquent tax lawsuits and judgments and; WHEREAS, City of Pearland, Trustee for itself and other taxing authorities, has remained and will in the future remain unpaid after exhausting all legal means to satisfy the collection of the delinquent taxes due and owing to Brazoria County Sheriff and/or Constable on the first Tuesday of a month on the Brazoria County Courthouse steps as provided by law and; WHEREAS, City of Pearland has acquired or will acquire in the future title to certain properties since there will be no bids for the property at the first tax sale, and City of Pearland, Trustee for itself and other taxing authorities, now holds or will hold in the future the property in trust to secure the payment of taxes, penalties, interest and costs owed to all taxing authorities participating in the foreclosure judgment; WHEREAS, the property held in trust by the City of Pearland, Trustee for itself and other taxing authorities is exempt from taxation and it is in the best interest of the taxing authorities to have the property returned to the active tax rolls as taxable property; WHEREAS, Pursuant to the Texas Property Tax Code Sections 34.05(c) and (d), City of Pearland may request the Brazoria County Sheriff and/or Constable to conduct a second public sale to get the property returned to the active tax roll; RESOLUTION NO. R2007.1 WHEREAS, the opening minimum bid for each struck off, tax exempt property may, pursuant to the Texas Property Tax Code Section 34.05(b), be set at any amount for such public resales of the property; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That all of the above paragraphs are true, correct and in the best interest of the City of Pearland, Trustee and as such they are hereby incorporated in full and made part of this Resolution. Section 2. That the Trustees of the City of Pearland hereby request that the Brazoria County Sheriff and/or Constable resell such property as designated from time to time by the Tax Assessor Collector of Brazoria County by public resale pursuant to the Texas Property Tax Code Sections 34.05(c) and (d). Section 3. That the opening bid pursuant to this Resolution shall be the amount sufficient to pay all court costs under the judgment and additional costs by the first tax sale and all subsequent tax resales, or such greater amount as set by the Tax Assessor Collector of Brazoria County. Section 4. That the Tax Assessor Collector of Brazoria County is hereby requested and directed to designate from time to time those properties which, in the opinion of the Tax Assessor Collector, it would be in the best interest of the taxing authorities to offer for public resale as herein provided, and to designate the minimum opening bids for such properties as provided herein. 2 RESOLUTION NO.
