CALL TO ORDER
Chairperson Henry Fuertes opened the meeting for the P&Z Regular Meeting at 7:04 P.M.
In attendance were:

Reyes, Planning Manager Katya Copeland, Planner II Patrick Bauer, Planner II Katie Peterson,
and Executive Assistant Jennifer Danley.
CONSENT AGENDA
All items listed under the "Consent Agenda" are considered to be routine and require little or no
deliberation by the Planning & Zoning Commission. These items will be enacted / approved by
one motion unless a commissioner requests separate action on an item, in which event the item
will be removed from the Consent Agenda and considered by separate action (ix. Matters
removed from Consent Agenda). Approval of the Consent Agenda enacts the items of legislation.
Consideration and Possible Action - Excused Absences - Excuse the absence of
Commissioner Thomas Echols and Jenifer Ordeneaux from the March 3, 2025, P&Z Regular
Meeting.
Consideration and Possible Action - Approval of Minutes - Approve the P&Z Regular Meeting
minutes from March 3, 2025.
Chairperson Fuertes read into the record the items on the Consent Agenda. Commissioner
Haskins made the motion to approve the consent agenda and Vice Chairperson Isenberg
seconded the motion.
Motion passed 6-0.

Chairperson Fuertes read into the record the item on Consideration and Possible Action —
VAP2025-0058: Variance from the Minimum Lot Depth Requirement in the Old Town -General
Business (OT-GB) District.
Consideration and Possible Action - VAP2025-0058: Variance from the Minimum Lot Depth
Requirement in the Old Town -General Business (OT-GB) District
A request by Elizabeth Morton of South Point Surveying, applicant, on behalf of Luis Raffucci and
Olivia Raffucci, owners, for approval of a variance permitted in Section 3.1.1.6 (f) of the Unified
Development Code (UDC), Ordinance No. 2000-T, from the requirements of Section 2.4.4.5 (c)(1)
of the UDC to allow the platting of a property that does not meet the minimum lot depth requirement
in the Old Town -General Business District described to wit:
Legal Description: Being a 0.288-acre tract of land, being out of Lot 28, Block 28 of Pearland
Townsite, Volume 29, Page 41, Deed Records of Brazoria County Texas, situated in the H.T.&
B.R.R Company Survey, Abstract No. 542, in Brazoria County, Texas.
General Location: 2502 Main Street, Pearland, Texas.
Planner II Bauer presented the staff report with exhibits. Mr. Bauer explained that the variance
seeks to reduce the lot depth to 57.48 feet, deviating from the 125-foot requirement in the Old
Town -General Business (OT-GB) District. Mr. Bauer reviewed the zoning map and plat, stating
that the variance meets the approval criteria outlined in the Unified Development Code (UDC). Mr.
Bauer added that staff recommends approval.
The applicant, Elizabeth Morton of South Point Surveying at 3221 South Main Street, Pearland,
Texas 77581, was present in -person in the Pearland Economic Development Corporation (PEDC)
Board Room to present to the P&Z Board. Ms. Morton discussed the owner's plan to use the
property for a bakery.
Chairperson Fuertes called for public input.
There were no persons wishing to speak for or against the proposed request.
There was no further discussion from Staff, P&Z Commission, or public input.

Garden/O'Day Mixed Use Zoning District.

Depth to Lot Width Ratio in the Garden/O'Day Mixed Use Zoning District
A request by Elizabeth Morton of South Point Surveying, applicant, on behalf of Nemecio and Maria
Castillo, owners, for approval of a variance permitted in Section 2.6.1.1 (b)(1) of the Unified
Development Code, Ordinance No. 2000-T, from Section 3.2.14.2 (c) to allow the creation of one -
lot that exceeds the maximum 3 to 1 Lot Depth to Lot Width Ratio in the Garden O'Day Mixed Use
District, on approximately 4.77 acres described to wit:
Legal Description: Being a 4.777 acre tract of land situated in the Allison -Richey Gulf Coast
Company Subdivision of Section 7, H.T. & B.R.R. Survey, A-219, Volume 2, Pages 23-24 of the
Brazoria County Map Records, (B.C.M.R.), being out of a tract of land described in a deed to James
Damon Bird and wife Irene Elizabeth Bird, as shown in County Clerk's File No. (C.C.F.#)
2003059445, of the Official Records of Brazoria County, Texas (O.R.B.C.T.).
General Location: 1713 Garden Road, Pearland, Texas.
Planner II Peterson presented the staff report with exhibits. Ms. Peterson explained that the
variance would allow the creation of two Tots exceeding the maximum 3:1 lot depth -to -width ratio in
the Garden O'Day Mixed Use (G/O-MU) District. Ms. Peterson noted the use would remain Single -
Family Residential, reviewed the zoning and area map, and provided a briefly overview of the land
survey. Ms. Peterson concluded that the variance meets all criteria outlined in the UDC, and staff
recommends approval.
The applicant, Elizabeth Morton of South Point Surveying at 3221 South Main Street, Pearland,
Texas 77581, was present in -person the PEDC Boardroom to answer any questions from the P&Z
Board.
Chairperson Fuertes called for public input.

Public Hearing: A request by Carlos Saenz, applicant, on behalf of Armando Lozano, owner, for
approval of a zone change for 2.7761 acres of land from Cullen -Mixed Use (C-MU) District to
General Commercial (GC) District, to wit:
Legal Description: Tract 1: A 1.854-acre tract of land situated in the H.T. & B.R.R. Company
Survey, Section 19, Abstract No. 234, Brazoria County, Texas, being part of Lot 1, of the Allison
Richey Gulf Coast Home Company Subdivision, Section 19, according to the plat recorded in
Volume 2, Page 23-24 of the Plat Records of Brazoria County, Texas, and being the remainder of
a called 2.004-acre tract of land described by deed recorded under County Clerk's File No.
2018059756 of the Official Public Records of Brazoria County, Texas.
Tract 2: A 0.9221-acre tract of land situated in the H.T. & B.R.R. Company Survey, Section 19,
Abstract No. 234, Brazoria County, Texas, being part of Lot 1, of the Allison Richey Gulf Coast
Home Company Subdivision, Section 19, according to the plat recorded in Volume 2, Page 23-24
of the Plat Records of Brazoria County, Texas, being part of a tract of land conveyed to Sharon
Childers by deed recorded under County Clerk's File No. 2018058267 of the Official Public Records
of Brazoria County, Texas.
General Location: 8402 & 8422 McHard Road, Pearland, Texas.
Planner II Bauer presented the staff report with exhibits. Mr. Bauer noted that the zone change
request was previously presented at the February 17, 2025, meeting and was postponed to allow
the applicant to meet with staff and discuss the proposal. Mr. Bauer reviewed the application
details, stated that no public comments were received in favor or against the request, and noted
that the General Commercial (GC) District is inconsistent with the Comprehensive Plan and the
zoning of the surrounding properties. Mr. Bauer concluded that the request meets two of the four
criteria outlined in the UDC, and as a result, staff is unable to recommend approval of the zone
change.
The property owner, Armando Lozano at 6213 Ravenwood Drive, Pearland, Texas 77584, was
present in -person in PEDC Board Room to present to the P&Z Board. Mr. Lozano discussed the
zone change application and mentioned that he is available to answer any questions from the
P&Z Board.
Chairperson Fuertes called for public input.
Resident, Kevin Chama at 1006 Tennyson Drive, Pearland, Texas 77584, stated he was in favor
of the zone change to GC.
The Commissioners and the Chair discussed the permitted uses in the GC district and expressed
concerns. They suggested that a less intensive zoning designation may better align with the
Mixed -Use Center place type, as outlined in the Comprehensive Plan.
There was no further discussion from Staff, P&Z Commission, or public input.
Chairperson Fuertes read into the record the item of Consideration and Possible Action — Zone
Change Application: ZONE 24-25. Commissioner McDonald made the motion to approve the
zone change, and Vice Chairperson Isenberg seconded the motion.
Commissioner McDonald made the motion to amend the zone change designation to the
Neighborhood Services (NS) District, and Commissioner Ordeneaux seconded the motion.
Amended motion passed 6-0.

Chairperson Fuertes read into the record the item of Consideration and Possible Action — Zone
Change Application: ZON2025-0036.

Public Hearing: A request by the Director of Community Development of the City of Pearland for
approval of a permanent zone classification for the land previously within the Brazoria County
Municipal Utility District No. 16, as follows:
a) General Business (GB) District for newly annexed tracts of land as described in the
following plats: Pearland Asian Town, Oak Square Subdivision, and Reserves B, C,
and Oak Road within Avalon Terrace Section 1 within 270' of Broadway Street,
b) Single -Family Residential-3 (R-3) District for newly annexed tract of land as described
in the following plats: Avalon Terrace Section 1 [excluding Reserves B, C, and Oak
Road within 270' of Broadway Street], Avalon Terrace Section 2, Avalon Terrace
Section 3, Avalon Terrace Section 4, Avalon Terrace Section 5, Avalon Terrace
Section 6, and City of Pearland Sports Complex,
c) Suburban Residential-12 (SR-12) District for newly annexed tracts of land as
described in the following plat: Lakeside Estates Section 1,
d) Suburban Development (SD) District for all areas excluded in plats and areas stated
above, to wit:
Legal Description: All properties within the Brazoria County Municipal Utility District No. 16 adopted
by Ordinance No. 1645.
General Location: North of Broadway Street, west of Reid Boulevard, east of Stone Road, and
south of the northern boundary of Lakeside Estates Section 1, with the exclusion of 2350 Reid
Boulevard.
Planner II Bauer presented the staff report with exhibits. Mr. Bauer explained that the request is for
approval of a permanent zone classification for the properties formerly within the Brazoria County
Municipal Utility District No.16, which were annexed into the city in December 2024. Mr. Bauer noted
that no public comments had been received in favor or against the request. He briefly reviewed the
history and development of the properties and outlined the four proposed zoning districts. Mr. Bauer
concluded that the request meets all criteria outlined in the UDC, and that staff recommends
approval of the zone change.
Chairperson Fuertes called for public input.
Resident Alan Wang at 11809 Sea Shadow Bend, Pearland, Texas 77584, requested the city to
assist the developer with driveway access on Oak Road.
Daniel Lindenberg of BK Investments at 1218 West Drew Street, Houston, Texas 77006, stated he
was in support of the GB zoning.
The Chair inquired about the inclusion of the detention pond in the zoning package. Planner I
Bauer explained that the Suburban Development (SD) District aligns with the Compact Residential
place type, as the detention pond serves a residential neighborhood and park.
There was no further discussion from Staff, P&Z Commission or public input.
Chairperson Fuertes read into the record the item of Consideration and Possible Action — Zone
Change Application: ZON2025-0036. Commissioner McDonald made the motion to approve the
zone change, and Commissioner Ordeneaux seconded the motion.
Motion passed 6-0.
DISCUSSION ITEMS
1. City Council Update Report: Planning Manager Copeland stated that at the March 10,
2025, City Council meeting, the first reading of ZONE 24-18, a zone change request
from GC to Planned Development (PD) District for a gated townhouse -style residential
community, was presented. However, the applicant subsequently withdrew the request.
