COMMISSION OF THE CITY OF PEARLAND, TEXAS, MONDAY, JANUARY 6, 2025, AT 6:30

CALL TO ORDER
Chairperson Henry Fuertes opened the meeting for the P&Z Regular Meeting at 6:32 P.M.
In attendance were:

Also, present were Deputy City Attorney Lawrence Provins, Assistant City Attorney Katie
Leininger, Assistant City Engineer Francisco Reyes, Community Development Director Vance
Wyly, Community Development Deputy Director Martin Griggs, Planning Manager Katya
Copeland, Senior Planner Florence Buaku, Planner II Patrick Bauer, and Executive Assistant
Jennifer Danley.
CONSENT AGENDA
All items listed under the "Consent Agenda" are considered to be routine and require little or no
deliberation by the Planning & Zoning Commission. These items will be enacted / approved by
one motion unless a commissioner requests separate action on an item, in which event the item
will be removed from the Consent Agenda and considered by separate action (ix. Matters
removed from Consent Agenda). Approval of the Consent Agenda enacts the items of legislation.
Chairperson Fuertes and Commissioner Ordeneaux recused themselves from the consent
agenda and left the meeting at 6:33 pm.
Consideration and Possible Action - Approval of Minutes - Approve the P&Z Regular Meeting
minutes from December 16,2024.
Consideration and Possible Action - PLAT 24-92: Preliminary Plat of Luka Pearland Plaza
A request by Ryan Moeckel, of McKim & Creed, the applicant; on behalf of Unique Minds LLC,
owners; for approval of the Preliminary Plat of Luka Pearland Plaza, creating 1 lot on 2.982 acres
of land located at the west corner of Shadow Creek Parkway and North Trinity Bay Drive, described
to wit:
Legal Description: A subdivision of 2.982 acres of land located in the S.G. Haynie Survey, A-620,
Fort Bend County, and A-212, City of Pearland, Brazoria County, Texas.
General Location: Southwest corner of Shadow Creek Parkway and North Trinity Bay Drive,
Pearland, Texas.
Consideration and Possible Action - PLAT 24-94: Preliminary Plat of Massey Oaks Harkey
Road Street Dedication Section 1
A request by Andrew Lang, of BGE, the applicant; on behalf of Castle Rock Communities, LLC and
Meritage Homes of Texas LLC, owners; for approval of the Preliminary Plat of Massey Oaks Harkey
Road Street Dedication Section 1 dedicating a 100-foot-wide section of Street Right of Way with 3
reserves for Harkey Road on ± 7.64 acres of land located south of Old Massey Ranch Road,
described to wit:
Legal Description: A subdivision of 7.64 acres of land located in the H. Stevens survey, A-593,
and the CW Groos Survey, A-525, City of Pearland, Brazoria County, Texas.
General Location: Harkey Road south of Old Massey Ranch Road, Pearland, Texas.
Consideration and Possible Action - PLAT 24-95: Preliminary Plat of Massey Oaks Section 4
A request by Andrew Lang, of BGE, the applicant; on behalf of Castle Rock Communities, LLC and
Meritage Homes of Texas LLC, owners; for approval of the Preliminary Plat of Massey Oaks Section
4, creating 69 single-family lots, 2 reserves, and 3 blocks on 18.39 acres of land located south of
Old Massey Ranch Road described to wit:
Legal Description: A subdivision of 18.39 acres of land located in the H. Stevens survey, A-593,
City of Pearland, Brazoria County, Texas.
General Location: West of Harkey Road and South of Old Massey Ranch Road, Pearland, Texas.
Chairperson Fuertes asked for the motion to approve the Consent Agenda. Commissioner
Haskins made the motion to approve the consent agenda items A-D, except for E, and
Commissioner Echols seconded the motion.
Motion passed 5-0.
ITEMS REMOVED FROM THE CONSENT AGENDA
Chairperson Fuertes read into the record the item on Consideration and Possible
Action — PLAT 24-96 — Preliminary Plat of the Enclave at Massey Oaks.
Consideration and Possible Action - PLAT 24-96 - Preliminary Plat of the
Enclave at Massey Oaks
A request of BGE Inc, the applicant; on behalf of Massey Oaks Development LP,
owner; for approval of the Preliminary Plat of Enclave at Massey Oaks, creating 1 lot
and 1 reserve on 24.93 acres located south of Old Massey Ranch Road described to
wit:
Legal Description: A subdivision of 24.93 acres of land located in the H. Stevens
Survey, Abstract 593, City of Pearland, Brazoria County, Texas.
General Location: South of Old Massey Ranch Road, East of Harkey Road,
Pearland, Texas.
Senior Planner Buaku presented the staff report with exhibits. Mrs. Buaku noted a
conflict regarding the information on ownership for the property. Mrs. Buaku stated
that staff recommends approval of the Preliminary Plat, with the condition that the
discrepancy of the ownership would be addressed at the Final Plat.
Applicant, Andrew Lang of BGE Inc. at 10777 Westheimer Road, Houston, Texas
77042, was in attendance in -person in the Council Chambers to present to the P&Z
Board. Mr. Lang stated that Massy Oaks PTR LLC, Inc. is the new owner and is
available for any questions from the P&Z Board.
Chairperson Fuertes read into the record the item on Consideration and Possible
Action — PLAT 24-96 — Preliminary Plat of the Enclave at Massey Oaks.
Commissioner Echols made the motion to approve the Preliminary Plat with the
condition recommended by staff, and Commissioner McDonald seconded the motion.
Motion passed 5-0.
Chairperson Fuertes and Commissioner Ordeneaux returned to the meeting at 6:39
pm.
NEW BUSINESS
Chairperson Fuertes read into the record the item on Consideration and Possible Action — Zone
Change Application: ZONE 24-19.
Consideration and Possible Action - Zone Change Application: ZONE 24-19
Public Hearing: A request by Will Benson, applicant, on behalf of JM Projects, LLC., owner, for
approval of a zone change for 7.573 acres of land from Heavy Industrial (M-2) District to General
Commercial (GC) District, to wit:
Legal Description: Being a 7.573 acre (329,887 square feet) tract, out of Lot 15, lying west of State
Highway #35, out of the L.W. Murdock Subdivision, Volume 29, Page 175, Brazoria County Deed
Records, in the A.C.H. & B. Railroad Survey, Section II, Abstract 507, Brazoria County, Texas, said
7.583 acres being that same tract described in a deed recorded in Volume 1259, Page 139 of the
Brazoria County Deed Records.
General Location: Northwest Corner of Main Street and Bailey Road, Pearland, Texas.
Planner II Bauer presented the staff report with exhibits. Mr. Bauer explained that the request is
for a zone change from Heavy Industrial (M-2) District to General Commercial (GC) District and
that the applicant's intent is to enable commercial uses that would complement the surrounding
area. Mr. Bauer noted that staff receive no public comments in favor or against the request,
discussed the property's history, and mentioned the property is not platted. Mr. Bauer stated that
the zone change meets all criteria outlined in the Unified Development Code (UDC), and staff
recommends approval.
The applicant, Will Benson representing Benson Development at PO Box 3, League City, Texas
77573, was in attendance in -person in the Council Chambers to present to the P&Z Board. Mr.
Benson discussed the intent of the zone change and stated that he was available to answer any
questions from the P&Z Board.
Chairperson Fuertes called for public input.
There were no persons wishing to speak for or against the proposed request.
The Commission members, along with Chairperson Fuertes, expressed their support for the zone
change to GC, citing its proximity to Pearland High School as a key reason.
There was no further discussion from Staff, P&Z Commission or public input.
Chairperson Fuertes read into the record the item on Consideration and Possible Action — Zone
Change Application: ZONE 24-19. Vice Chairperson Isenberg made the motion to approve the
zone change, and Commissioner Haskins seconded the motion.
Motion passed 7-0.
DISCUSSION ITEMS
1. City Council Update Report: Deputy Director Griggs providedenupdate from the City
Council's regular meeting on December 16, 2024. Stating that the first reading of
ZONE 24-14`uzone change from Residential Estate /R-E\District hoPlanned
Development /PD\ [)iotric{, was approved by the Council with a 4-1 vote. Adding,
Conditional Use Permit, CUP 24-23, for an Art Studio was approved by Council.
Adding, CUP 24-21, for a self-service auto wash was approved by Council with the
proposed 7conditions. Adding, Council approved the annexation ofthe BrozV[io
County Municipal District No.1 6 and awarded the contract for the 2025 Parks Master
Plan toBaxter Woodman.
