COMMISSION OF THE CITY OF PEARLAND, TEXAS, MONDAY, APRIL 21, 2025, AT 6:30 PM
IN COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DR.
CALL TO ORDER
Chairperson Henry Fuertes opened the meeting for the P&Z Regular Meeting at 6:30 P.M.
In attendance were:

Also, present were Deputy City Attorney Lawrence Provins, Assistant City Attorney Katie Leiniger,
Assistant City Engineer Francisco Reyes, Community Development Director Vance Wyly,
Community Development Deputy Director Martin Griggs, Planning Manager Katya Copeland,
Planner II Patrick Bauer, Planner II Katie Peterson, and Business Administrator Jennifer Danley.
Chairperson Fuertes and Commissioner Ordeneaux recused themselves from the consent agenda
and left the meeting at 6:32 pm.
CONSENT AGENDA
All items listed under the "Consent Agenda" are considered to be routine and require little or no
deliberation by the Planning & Zoning Commission. These items will be enacted / approved by
one motion unless a commissioner requests separate action on an item, in which event the item
will be removed from the Consent Agenda and considered by separate action (ix. Matters
removed from Consent Agenda). Approval of the Consent Agenda enacts the items of legislation.
Consideration and Possible Action - Excused Absences - Excuse the absence of
Commissioner Jennifer Henrichs and Commissioner John McDonald from the April 7, 2025, P&Z
Regular Meeting.
Consideration and Possible Action - Approval of Minutes - Approve the P&Z Regular Meeting
minutes from April 7, 2025.
Consideration and Possible Action - RPL2025-0093: Preliminary Plat of Massey Oaks East
Lake
A request by Andrew Lang, of BGE, the applicant; on behalf of Meritage Homes of Texas LLC,
owners; for approval of the Preliminary Plat of Massey Oaks East Lake, creating 1 restricted
reserve on 15.77 acres of land, described to wit:
Legal Description: A subdivision of 15.77 acres of land located in the H. Stevens survey, A-593,
City of Pearland, Brazoria County, Texas.
General Location: West of Harkey Road and East of Massey Oaks Trail, Pearland, Texas.

Vice Chairperson Isenberg read into the record the items on the Consent Agenda. Commissioner
McDonald made the motion to approve the consent agenda and Commissioner Henrichs
seconded the motion.
Motion passed 5-0.
Chairperson Fuertes and Commissioner Ordeneaux returned to the meeting at 6:33 pm

Chairperson Fuertes read into the record the item on Consideration and Possible Action —
CPL2025-0097: Final Plat of Dixie Farm Commercial Subdivision.
Consideration and Possible Action - CPL2025-0097: Final Plat of Dixie Farm Commercial
Subdivision
A request by Garrett Carter, of Hankins Development, the applicant; on behalf of Anthony Giuliani,
owner; for approval of the Final Plat of Dixie Farm Commercial Subdivision creating 4 lots on
approximately 9.6 acres described to wit:
Legal Description: Being a tract or parcel of land containing 9.6135 acres of land (418,766 square
feet), being out of and part of Lot 76, George W. Jenkins Subdivision of the lower one-fourth, (1/4),
of the W.D.C. Hall Survey. Abstract No. 70, Brazoria County, Texas, according to the map or plat
thereof recorded in Volume 79, page 616, of the Office of the County Clerk of Brazoria County,
Texas, said 9.6135 acre tract of land being that certain tract of land as conveyed to Gary Martin
Maynor and Wife, Cecelia Maynor, by instrument recorded in document CF No. 2001045201 of the
Office of the County Clerk of Brazoria County, Texas.
General Location: 3205 Dixie Farm Road, Pearland, Texas.
Planner II Peterson presented the staff report with exhibits. Ms. Peterson explained that the
request is for approval of a Final Plat to create four commercial lots. She provided a brief
overview of the aerial and zoning map and the Final Plat. Ms. Peterson stated that the Final Plat
meets the approval criteria outlined in the Unified Development Code (UDC), and staff
recommends approval with the following condition:
1. The maintenance agreement for the shared drainage be recorded and identified on the
Plat.
The applicant, Garrett Carter of Hankins Development, at 419 Alamo Street, Lake Charles,
Louisiana 70601, was present in -person in the Council Chambers to present to the P&Z Board.
Mr. Carter briefly discussed the Final Plat and stated that he was available to answer any
questions from the P&Z Board.
Chairperson Fuertes called for public input.
There were no persons wishing to speak for or against the proposed request.
There was no further discussion from Staff, P&Z Commission, or public input.
Chairperson Fuertes read into the record the item on Consideration and Possible Action —
CPL2025-0097: Final Plat of Dixie Farm Commercial Subdivision. Commissioner Ordeneaux
made the motion to approve the Final Plat, and Vice Chairperson Isenberg seconded the motion.
Commissioner McDonald made the motion to amend the Final Plat to include staff that the
Maintenance Agreement for the shared drainage be recorded and identified on the Plat, and
Commissioner Echols seconded the motion.
Amended motion passed 7-0.
Motion passed 7-0.

Change Application: ZONE 24-28.

Public Hearing: A request by Paige McKee, applicant, on behalf of Dixie Farm Property, LLC,
owner, for approval of a zone change for 15.91 acres of land from Light Industrial (M-1) and Heavy
Industrial (M-2) District to Planned Development (PD) District for a proposed RV, trailer, and boat
storage facility (self -storage facility) to wit:
Legal Description: Parcel 1: Lot 2, being 7.97 acres (347,082 sq. ft.), out of the Minor Plat of
Zamarron Special, a 11.91-acre subdivision in the City of Pearland, in Brazoria County, Texas,
according to the map or plat thereof, recorded under Brazoria County Clerk's File No. 2009037362
of the Official Public Records of Brazoria County, Texas. Parcel 2: A 7.94-acre tract of land being
part of and out of 11.110-acre tract of land out of Lot 178 of the Zychlinski Subdivision of Section
28 H.T. & B.R.R. Company Survey, Abstract 551, Brazoria County, Texas, according to the map or
plat thereof recorded in Volume 29, Page 9 of the Deed Records of Brazoria County, Texas, being
said 7.94-acre tract of land being out of and part of land described in deed dated May 23, 2003, to
Jesse G. Zamarron and Amalia V. Zamarron recorded under Brazoria County Clerk's File No.
2003052501.
General Location: Northeast of the Intersection of Dixie Farm Road and Main Street, Pearland,
Texas.
Planner II Bauer presented the staff report with exhibits. Mr. Bauer provided a summary of the
zone change request originally reviewed at the March 3, 2025, P&Z Meeting. He noted that staff
received thirteen written comments in support of the request. Mr. Bauer explained the updates
made by the applicant to the design plan and landscaping, reviewed the additional standards
included in the Planned Development (PD) document, and discussed the deviations requested by
the applicant. Mr. Bauer concluded that the zone change meets five out of the seven approval
criteria outlined in the UDC, and staff recommends approval.
The applicant, James McKee, of 3912 Livingston Lake Court Pearland, Texas 77581, was present
in -person in Council Chambers to present to the P&Z Board. Mr. McKee discussed the vegetative
buffer between the detention area and the neighboring property and noted that the adjacent
business has a restricted entrance.

present in -person in Council Chambers to present to the P&Z Board. Mrs. McKee discussed the
development changes made since the last meeting.
Chairperson Fuertes called for public input.
There were no persons wishing to speak for or against the proposed request.
The Commissioners provided positive feedback to the applicant for working with staff to address
the items identified for further attention during the previous meeting. Commissioner Echols
expressed concern regarding the location of the detention area along the property line. The
applicant, Mr. McKee, responded by explaining that the property line is boarded by a road and a
pipeline, and that there is a minimum 10-foot separation from the property line to the detention
area.
There was no further discussion from Staff, P&Z Commission, or public input.
Chairperson Fuertes read into the record the item on Consideration and Possible Action — Zone
Change Application: ZONE 24-28. Vice Chairperson Isenberg made the motion to approve the
zone change, and Commissioner Haskins seconded the motion.
Motion passed 7-0.
DISCUSSION ITEMS
1. City Council Update Report: Deputy Director Griggs reported that at the Aprill4, 2025,
City Council meeting, the Council heard the first reading of ZONE 24-25, a zone
change request from Cullen -Mixed Use (C-MU) District to General Commercial (GC)
District for the properties located at 8402 & 8422 McHard Road. Mr. Griggs stated the
Council amended the motion to approve the General Business (GB) designation, which
passed by a 6-0 vote. He also reported that Council approved the first reading of
ZON2025-0036, a zoning assignment for recently annexed property formerly within
MUD 16, also by a 6-0 vote.
