The following represents the actions taken by City Council in the order they occurred during the meeting. All motions are made by Council in consecutive order, as determined by the Mayor. I. CALL TO ORDER Mayor J. Kevin Cole called the meeting to order at 6:46 p.m. II. INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF AMERICA FLAG AND TEXAS FLAG Mayor Cole gave the Invocation and Councilmember Cade led the Pledge of Allegiance to the United States of America Flag and the Texas Flag. III. ROLL CALL AND CERTIFICATION OF QUORUM Mayor J. Consideration and Possible Action - Resolution No. R2025-64 - A Resolution of the City Council of the City of Pearland, Texas reappointing directors to the Board of Directors of the Pearland Municipal Management District No.1. B. Consideration and Possible Action - Resolution No. R2025-65 - A Resolution of the City Council of the City of Pearland, Texas reappointing directors to the Board of Directors of the Pearland Municipal Management District No. 2. Consideration and Possible Action - Resolution No. R2025-66 - A Resolution of the City Council of the City of Pearland, Texas reappointing directors to the Board of Directors of the Lower Kirby Pearland Management District. D. Consideration and Possible Action - Resolution No. R2025-67 - A Resolution of the City Council of the City of Pearland, Texas, updating and approving the City's guidelines and criteria for granting tax abatements within a reinvestment zone created in the City of Pearland, Brazoria County, Fort Bend County, and Harris County, Texas; providing a savings clause; providing a severability clause; and providing for an effective date. E. Consideration and Possible Action - Resolution No. R2025-74 - A Resolution of the City Council of the City of Pearland, Texas, awarding a three-year contract, (one 1-year initial term; two 1-year renewals) for a department records management system to ESO, Inc., in the estimated amount of $79,111.31, for the period of June 2, 2025, through June 1, 2026. F. Consideration and Possible Action - Resolution No. R2025-60 - A Resolution of the City Council of the City of Pearland, Texas, awarding a 3-year unit supply contract (1-year initial term; two 1-year renewals) for Rough Cut, Open Ditches, and Bridge Grounds Maintenance Service to Greenscape Six, LLC, in the estimated amount of $222,328.80, for the period of June 1, 2025 through May 31, 2026. Councilmember Koza made the motion, seconded by Councilmember Carbone to approve the Consent Agenda items A - F. AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel. NAYS: None. The motion carried. VI. MATTERS REMOVED FROM CONSENT AGENDA There were no items removed from Consent Agenda. VII. PUBLIC HEARING NO. 1 1. Public Hearing: A request by Andrew Allemand, Beacon Land Services, LLC, Texas, applicant, on behalf of BE GP I, LLC, Texas, owners, for approval of a zone change from Suburban Residential – 12 (SR-12) District to Planned Development (PD) District, creating a Planned Development of approximately 7.9731 acres of land to identify as the McHard Road & Adamo Lane Planned Development, to wit: Legal Description: Being a 7.9731-acre tract of land, being part of Lots 17 & 18 out of the Allison-Richey Gulf Coast Home Company Subdivision, Section 19, situated in the H.T. & B.R.R. Co. Survey, Abstract 243, according to the map or plat recorded in Volume 2, Page 23, of the Plat records of Brazoria County, Texas. John Lejsal expressed support for the proposed townhouse-style multi-family residential development. Gwen Lejsal expressed support for the proposed townhouse-style multi-family residential development. Clayton Smith expressed opposition to the proposed townhouse-style multi- family residential development. Ryan Johnson expressed support for the proposed townhouse-style multi-family residential development. Sean McBride expressed support for the proposed townhouse-style multi-family residential development. Benito Valadez expressed opposition to the proposed townhouse-style multi- family residential development. Alex Serrano expressed opposition to the proposed townhouse-style multi- family residential development. William Hunter expressed support for the proposed townhouse-style multi-family residential development. Shirley Hunter expressed support for the proposed townhouse-style multi-family residential development. Jennifer Meier expressed support for the proposed townhouse-style multi-family residential development. Rania Koronfel expressed support for the proposed townhouse-style multi-family residential development. Muhammad Daoudi expressed support for the proposed townhouse-style multi- family residential development. Steve Knippel expressed support for the proposed townhouse-style multi-family residential development. Consideration and Possible Action - First Reading of Ordinance No. 2000M-272 - An Ordinance of the City Council of the City of Pearland, Texas, amending Ordinance No. 2000M, the zoning map of the City of Pearland, Texas, for the purpose of changing the classification of certain property; being a 7.9731-acre tract of land, being part of Lots 17 & 18 out of the Allison-Richey Gulf Coast Home Company Subdivision, Section 19, situated in the H.T. & B.R.R. Co. Survey, Abstract 243, according to the map or plat recorded in Volume 2, Page 23, of the Plat records of Brazoria County, Texas (located at 8210 McHard Road, Pearland, Texas). Zone Change Application No. ZONE 24-27, a request by Andrew Allemand, Beacon Land Services, LLC, Texas, applicant, on behalf of BE GP I, LLC, Texas, owners, for approval of a zone change from Suburban Residential – 12 (SR-12) District to Planned Development (PD) District, creating a Planned Development of approximately 7.9731 acres of land to identify as the McHard Road & Adamo Lane Planned Development; providing for an amendment of the zoning district map; containing a savings clause, a severability clause, and an effective date and other provisions related to the subject. Councilmember Carbone made the motion, seconded by Councilmember Koza to approve the first reading of Ordinance No. 2000M-272. Written opposition was received from over 20% of the land within the 200ft notification area. A supermajority vote is required. AYES: Koza, Carbone, Chavarria, and Fernandez. NAYS: Byrom, Cade, and Patel. The motion failed. IX. PUBLIC HEARING NO. 2 2. Public Hearing: A request by Gulf Tex Roofing and Services, applicant, on behalf of Halle Properties, LLC., owner, for approval of a Conditional Use Docusign Envelope ID: BFBAA784-71EF-4FB7-B5B3-F4288C580DD4 Pearland City Council Minutes May 19, 2025 Page 5 of 9 Permit (CUP) for an expansion to an existing Auto Repair (Minor) use within the General Business (GB) District, on approximately 0.9125 acres of land, to wit: Legal Description: Lot 2, Block 1, Final Plat of Broadway West, a subdivision in Brazoria County, Texas, according to the map or plat thereof, recorded in Volume 20, Page 307 & 308 of the Plat Records of Brazoria County, Texas. Consideration and Possible Action - Resolution No. R2025-CUP2025-0107 - A Resolution of the City Council of the City of Pearland, Texas, approving a Conditional Use Permit (CUP) for an expansion to an existing Auto Repair (Minor) use within the General Business (GB) District, on approximately 0.9125 acres of land, being Lot 2, Block 1, Final Plat of Broadway West, a subdivision in Brazoria County, Texas, according to the map or plat thereof, recorded in Volume 20, Page 307 & 308 of the Plat Records of Brazoria County, Texas (located at 10331 Broadway Street, Pearland, Texas). Conditional Use Permit Application No. CUP2025-0107, for an expansion to an existing Auto Repair (Minor) use within the General Business (GB) District, at the request of Gulf Tex Roofing and Services, applicant, on behalf of Halle Properties, LLC., owner, containing a savings clause, a severability clause, and an effective date and other provisions related to the subject. Councilmember Chavarria made the motion, seconded by Councilmember Cade to approve Resolution No. R2025-CUP2025-0107. AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel. NAYS: None. The motion carried. 3. Mayor Pro-Tem Byrom made the motion, seconded by Councilmember Cade to approve Resolution No. R2025-76. Presentation provided by John Robuck, Executive Vice President with BOK Financial Securities. Consideration and Possible Action - Resolution No. R2025-75 - A Resolution of the City Council of the City of Pearland, Texas, authorizing publication of notice of intention to issue certificates of obligation for the design, acquisition, construction and improvement of certain public works, authorizing distribution of a preliminary official statement relating to such series of certificates and authorizing certain other matters relating thereto. Councilmember Cade made the motion, seconded by Councilmember Fernandez to approve Resolution No. R2025-75. Consideration and Possible Action - First Reading of Ordinance No. 1647 - An Ordinance of the City Council of the City of Pearland, Texas, authorizing the issuance of City of Pearland, Texas, permanent improvement bonds in one or more series; setting certain parameters for the bonds; authorizing a pricing officer to approve the amount, the interest rate, price, and terms thereof and certain other procedures and provisions relating thereto. Councilmember Fernandez made the motion, seconded by Councilmember Cade to approve the first reading of Ordinance No. 1647. Consideration and Possible Action - Resolution No. R2025-77 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the defeasance and redemption of certain of the City’s Certificates of Obligations Series 2020B and 2021B (TIRZ related projects); and making certain findings and containing other provisions related thereto. Councilmember Patel made the motion, seconded by Mayor Pro-Tem Byrom to approve Resolution No. R2025-77. Presentation provided by John Robuck, Executive Vice President with BOK Financial Securities. AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel. NAYS: None. The motion carried. 7. Consideration and Possible Action - Resolution No. R2025-59 - A Resolution of the City Council of the City of Pearland, Texas, authorizing an expenditure of the Pearland Economic Development Corporation, in the annual estimated amount of $296,222.00, with the Pearland Chamber of Commerce for a 3-year contract to operate the Pearland Innovation HUB for small business assistance in Pearland. Councilmember Koza made the motion, seconded by Councilmember Carbone to approve Resolution No. R2025-59. Noe Montoya expressed support for the Pearland Innovation HUB. Marilyn Ramirez Segundo expressed support for the Pearland Innovation HUB. Kim Hattan expressed support for the Pearland Innovation HUB. William Garay, Jr. expressed support for the Pearland Innovation HUB. Ali Udawala expressed support for the Pearland Innovation HUB. David Graham expressed support for the Pearland Innovation HUB. Presentation was provided by Matt Buchanan, President of Pearland Economic Development Corporation and Jim Johnson, President with Pearland Chamber of Commerce. Consideration and Possible Action - Resolution No. R2025-70 - A Resolution granting the consent of the City Council of the City of Pearland, Texas, consenting to the annexation of approximately 220.7 acres, (CR 100 east of Harkey Road), into Brazoria County Municipal Utility District No. 69. Councilmember Carbone made the motion, seconded by Councilmember Koza to approve Resolution No. R2025-70. AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel. NAYS: None. The motion carried. 9. Consideration and Possible Action - Resolution No. R2025-39 - A Resolution of the City Council of the City of Pearland, Texas, accepting a petition concerning the creation of a Public Improvement District; finding the petition to be compliant with applicable laws; approving and authorizing the mailing and publication of notice of public hearing regarding the possible creation of a Public Improvement District; and resolving other matters in connection therewith. Councilmember Chavarria made the motion, seconded by Councilmember Cade to approve Resolution No. R2025-39. AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel. NAYS: None. The motion carried. 10. Consideration and Possible Action - First Reading of Ordinance No.1587- 1 - An Ordinance of the City Council of the City of Pearland, Texas, amending Chapter 29, TRAFFIC, of the City of Pearland Code of Ordinances; having a savings clause, a severability clause, and a repealer clause; and providing for codification -and an effective date. Mayor Pro-Tem Byrom made the motion, seconded by Councilmember Koza to approve the first reading of Ordinance No. 1587-1. AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel. NAYS: None. The motion carried. 11. Consideration and Possible Action - Resolution No. R2025-73 - A Resolution of the City Council of the City of Pearland, Texas, authorizing expenditures with McGriff Insurance Service, for Wind, Hail, and Driven Rain Insurance, in the amount of $1,528,995.81, for the period of May 26, 2025, to May 26, 2026. Councilmember Cade made the motion, seconded by Councilmember Fernandez to approve Resolution No. R2025-73. Councilmember Fernandez made the motion, seconded by Councilmember Koza to approve the first reading of Ordinance No. 1643-2. Presentation was provided by Rachel Wynslow, Head of Office of Management and Budget. AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel. NAYS: None. The motion carried.
