Consideration and Possible Action: Vote to Accept Minutes of March 26, 2025, Meeting The minutes of the March 26, 2025, meeting were approved without correction or objection. IV. Consideration and Possible Action: Discussion and Review of Charter and Proposed Amendments A. The Commission discussed potential changes to Article 7. Municipal Planning and Zoning a. b. c. d. S ection 7.01 — Planning and zoning commission. S ection 7.02 — Reserved. S ection 7.03 — Platting and property. S ection 7.04 — Development of property. S o changes were recommended to 7.02 through 7.04, except S ection 7.01. The Commission recommends that Section 7.01 be amended by: Inserting "in compliance with state law." In reference to publication requirements, such as those involving newspaper notices. B. The Commission discussed potential changes to Article 8. Municipal Finance a. Section 8.01 — Fiscal year. b. Section 8.02 — Preparation and submission of budget. c. Section 8.03 — Anticipated revenues compared with other years in budget. d. Section 8.04 — Proposed expenditures compared with other years. e . Section 8.05 — Budget a public record. f. Section 8.06 — Notice of public hearing on budget. g. Section 8.07 — Public hearing of budget. h. Section 8.08 — Amendment before adoption. i. Section 8.09 — Vote required for adoption. j. Section 8.10 — Date of final adoption. k. Section 8.11 - Effective date of budget; certification; public availability I. Section 8.12 --Budget established appropriations. m. Section 8.13 — Budget established amount to be raised by property tax. n . Section 8.14 — Contingent appropriation. Section 8.15 — Estimated expenditures shall not exceed estimated resources. p. Section 8.16 — Emergency appropriations. q. No changes were recommended to Section 8.01 through 8.24, except Section 8 06. The Commission recommends that Section 8.06 be amended by: Inserting "in compliance with state law." In reference to publication requirements, such as those involving newspaper notices Commissioner Spiegelhauer recommended adding a new section 8.25 to require monthly financial reports to Council. May be included in the Charter Review Report. C. The Commission discussed potential changes to Article 9. Franchises and Public Utilities. a. b. c. d. e. f. g. h. J. S ection 9.01 - Powers of the city. S ection 9.02 - Power to grant franchise. S ection 9.03 - Grant not to be exclusive. S ection 9.04 - Ordinances granting franchise. S ection 9.05 - Transfer of franchise. S ection 9.06 - Franchise value not to be allowed. S ection 9.07 - Right of regulation. S ection 9.08 - Regulation of rates. S ection 9.09 - Municipally owned utilities. S ection 9.10 - Sales of municipal services. S o changes were recommended to Section 9.01 through 9.10, except Section 9.04 The Commission recommends that Section 9.04 be amended by: Inserting "in compliance with state law." In reference to publication requirements, such as those involving newspaper notices Commissioner Johnson and Commissioner Spiegelhauer discussed Section 9.10 regarding the sale of water outside City limits. City Attorney s will research existing policy and applicable state law regarding the current procedures for water rates. A recommendation concerning the resale of water and appropriate safeguards or parameters ("bumpers' or "guardrails") to govern such sales to customers outside the City limits may be included in the Charter Review Report. D. The Commission discussed potential changes to Article 10. General Provisions S ection 10.01 - Official oath. S ection 10.02 - Public records. S ection 10.03 - Official newspaper. S ection 10.04 - Notice of claim. S ection 10.05 - Provision relating to assignment, garnishment. S ection 10.06 - City not required to give security or S ection 10.07 - Personal interest in city contract. S ection 10.08 - Nepotism. S ection 10.09 - Reserved. S ection 10.10 - Effect of charter on existing law. S ection 10.11 - Reserved. S ection 10.12 - Applicability of general laws. S ection 10.13 - Amending the charter. S ection 10.14 - Separability clause S ection 10.15 - Charter review commission. S ection 10.16, 10.17 - Reserved. execution and execute bond. The Commission recommends that Section 10.03 and 10.15(b) be amended by: Inserting "in compliance with state law." In reference to publication requirements, such as those involving newspaper notices Section 3.07(e) was discussed by the Commission in conjunction with Section 10 15 regarding possible changes to establish rules for how the Charter Review Commission is appointed. A recommendation to include language requiring the selection of Charter Review Commission members at least six months prior to the beginning of the selection process may be included in the Charter Review Report. V. Future Business The Commission confirmed it would meet on May 21, 2025, at 6:00 p.m., to review the redline of Charter and prepare Charter Review Report. VI.
