1975-10-13 CITY COUNCIL REGULAR MEETING MINUTESMINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY -OF PEARLAND, TEXAS HELD ON OCTOBER 13, 1975, AT 7:37 P.M. IN THE CITY HALL; 2335 N. TEXAS AVENUE, PEARLAND, TEXAS. The meeting was called to order with the following present: Mayor Councilman Councilman Councilman Councilman City Manager City Attorney City Secretary Carlton McComb Cecil W. Griffin (Entered 7:38 P.M.) Harry Farley Gene E. Sanders Tom Reid William E. Wolff Bobby J. Williams Dorothy L. Cook Absent from the meeting: Councilman Benny J. Frank INVOCATION AND PLEDGE OF ALLEGIANCE: The invocation was given by the Rev. Art Jones. The Pledge of Allegiance was led by Councilman Sanders. APPROVAL OF MINUTES: It was moved by Councilman Reid, seconded by Councilman Farley that the minutes of the meeting of September 22, 1975 be approved as submitted. Motion passed 4 to 0. It was moved by Councilman Griffin, seconded by Councilman Sanders that the minutes of the special meeting held on September 29, 1975 be approved as submitted. Motion passed 4 to 0. MAYOR'S ACTIVITY REPORT: Mayor McComb issued a Proclamation proclaiming Halloween - October 31, 1975 as "Greet 'N Treat Day" in Pearland. Mayor McComb invited members of the Council to join him on October 18, 1975 for an inspection of the new sanitary sewer system in the Brookland Acres-Mykawa Road Area. Mayor McComb advised that Councilman Sanders has been reviewing the Dog Ordinance and will be seeking input from the citizens on upgrading the ordinance and/or improving the service. Councilman Sanders asked that any suggestion be sent to him in writing at his home address. COUNCIL ACTIVITY REPORTS: None. DEPARTMENTAL REPORTS: None. 25 CITIZENS: Mrs. Gloria Garrison - A letter from Mrs. Garrison was read into the records by Councilman Griffin. The letter recommended a strict dog leash law with a fine of not less than $150.00 for violation. Mrs. Garrison',s letter also outlined various complaints and incidents in her area of the City relating. to dogs. Mrs. Garrison was present and advised the City Council that her letter, read into the records, explained her feelings and she did not wish to speak. Mayor McComb asked to the Council members: to permit other citizens present to speak on the subject. It was moved by Councilman Sanders, seconded by Councilman Griffin that members of the audience be permitted to speak on the subject. Motion passed 4 to 0. The following citizens spoke with comments or complaints regarding the enforcement of the dog ordinance: Mrs. Karen Shaw - 2112 Rose Street Gary Johnson - 2002 Cheryl Linda Crawford - 2403 S. Pearland Caroline Nickell - 3605 Longherridge Dr. Delia Ann Williams - 2003 Cheryl Dale A. Nussman - 1403 Roy Court George E. Young - Mr. Young spoke to the City Council with a request that a Public Hearing be called to hear comments on Applications 17, 18 and 19 regarding amendments to the present Zoning Ordinance. A discussion was held with Mr. Young regarding his request and it was decided that since this item was not on the agenda for action by the Council it would be considered at the regular meeting of the City Council after the report from the Planning & Zoning Commission thus following the regular procedure of the City Council on all applications for change in zoning. RECESSED 8:35 P.M. - RECONVENED 8:45 P.M. OFFICIAL NEWSPAPER FOR THE CITY: The following proposals were read by Mayor McComb: Newspaper Suburban Publications, Inc. The Journal Sun Progress Price 6� per word per insertion $2.80 per column inch for display material such as charts, forms, etc. 7� per word per insertion $1.75 per column inch for display material 5p per word It was moved by Councilman Griffin, seconded by Councilman Reid that the Sun Progress be named as the official newspaper for the City of Pearland. Motion passed 3 to 1. Councilman Sanders opposed. RESOLUTION NO. 75-24 - DESIGNATING THE SUN PROGRESS AS THE NEWS ORGAN OF THE CITY. Resolution No. 75-24 was read in full by Councilman Sanders. It was moved by Councilman Griffin, seconded by Councilman Sanders that Resolution No. 75-24 be passed and approved on first and final reading. Said Resolution No. 75-24 reads in caption as follows: RESOLUTION NO. 75-24 A RESOLUTION OFFICIALLY DESIGNATING THE SUN PROGRESS AS THE NEWS ORGAN OF THE CITY OF PEARLAND, TEXAS, AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT. Voting "aye" - Councilman Farley, Councilman Sanders, Councilman Griffin and Councilman Reid. Voting "no" - None Motion passed 4 to 0. NEW BUSINESS: ENGINEER'S ESTIMATE NO. 6 - R. T. BISHOP CONSTRUCTION COMPANY: This item passed until next regular agenda due to question on amount of retainage shown on the estimate. LIONS CLUB TURKEY SHOOT: Mayor McComb read a letter dated October 7, 1975 from Glenn Stanford, Chief of Police,advising that he and Don Crawford had examined the property at the VFW Hall and recommended that the Lions Club be allowed to relocate the Turkey Shoot on the property. He advised that he felt that this activity would be far less dangerous at this location than the present location on Highway 35. It was moved by Councilman Griffin, seconded by Councilman Reid that the Pearland Lions Club be granted a special permit for a Turkey Shoot on November lst and 2nd or any alternate rain -out date subject to liability insurance furnished to.the City , and coordination of the traffic flow with the Chief of Police. Motion passed 3 to 1. Councilman Sanders opposed. Councilman Sanders stated that his opposition was due to the noise factor and the inherent problems he foresaw and was not opposed to the Lions Club Turkey Shoot. TRAFFIC ENGINEER'S REPORT NO. 28, STOP SIGN ON MC GINNIS DRIVE AT INTERSECTION WITH DIXIE FARM ROAD: City Attorney Williams read Report No. 28 by the Traffic Engineer advising that he had caused to be installed a traffic control device, one stop sign, located on the Southwest corner of McGinnis Drive at its intersection with Dixie Farm Road, facing in a Northwesterly direction. It was moved by Councilman Farley, seconded by Councilman Reid that Acting Traffic Engineer's Report No. 28 be accepted into the records of the City. Motion passed 4 to 0. It was moved by Councilman Farley, seconded by Councilman Reid that Acting Traffic Engineer's Report No. 28 dated October 8, 1975 concerning installation of traffic control device as follows: One Stop Sign - located on the Southwest corner of McGinnis Drive at its intersection with Dixie Farm Road facing in a North- westerly direction, ._and that the above location be affirmed and ratified and the same be officially declared to be an official traffic device in and for the City of Pearland. Motion passed 4 to 0. PEARLAND-FRIENDSWOOD EXTRATERRITORIAL AGREEMENT - RESOLUTION NO. 75-25: Proposed Resolution No. 75-25 and Agreement read in full by Councilman Reid. It was moved by Councilman Reid, Seconded by Councilman Farley that Resolution No. 75-25 be passed and approved as amended. (Amendment - fifth line, first paragraph - change of word "of comprehensive planning" to "to comprehensive planning"). MEETING RECESSED 9:26 P.M. - RECONVENED 9:30 P.M. 0— Mayor McComb left the meeting at 9:30 P.M. Mayor Pro Tem Griffin presiding. It was moved by Councilman Sanders, seconded by Councilman Reid that the motion to pass and approve Resolution No. 75-25 be tabled until the next regular meeting. Motion failed 2 to 2. Councilman Sanders and Councilman Reid voting for and Councilman Farley and Councilman Griffin voting against. Tie vote, motion lost. Mayor Pro Tem Griffin called for a vote on the main motion. Voting "aye" - Councilman Farley, Councilman Griffin, Councilman Reid. Voting "no" - Councilman Sanders. Motion passed 3 to 1. Councilman Sanders stated that he was not opposed to the Agreement per se-, but to the width. OTHER BUSINESS: None. EXECUTIVE SESSION: Executive Session on Personnel at 9:40 P.M. - Reconvened to open session at 9:46 P.M. - No action as a result of executive session. MEETING ADJOURNED AT 9:47 P.M.
