CITY OF PEARLAND, TEXAS
CITY COUNCIL REGULAR MEETING MINUTES
APRIL 14, 2025
The City Council of Pearland, Texas convened in a meeting on Monday, April 14, 2025 at the
Pearland City Hall Council Chambers, 3519 Liberty Drive, Pearland, Texas. The following
represents the actions taken by City Council in the order they occurred during the meeting. All
motions are made by Council in consecutive order, as determined by the Mayor.
I. CALL TO ORDER
Mayor J. Kevin Cole called the meeting to order at 6:39 p.m.
II. INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF
AMERICA FLAG AND TEXAS FLAG
Mayor Cole gave the Invocation and Councilmember Chavarria led the Pledge of
Allegiance to the United States of America Flag and the Texas Flag.
III. ROLL CALL AND CERTIFICATION OF QUORUM

IV. RECOGNITION AND AWARDS
1. Presentation of the Transparency Trailblazer Award by the State of Texas
Comptroller of Public Accounts.
V. CITIZEN COMMENTS
Conner Brady, 7736 Lester St., Boy Scout Troop 468, invited the public to purchase
tickets for the troops annual spaghetti dinner scheduled for April 26, 2025.
VI. CONSENT AGENDA
A. Consideration and Possible Action - Approval of the minutes of the
Pearland City Council Special Meeting held on March 24, 2025, City
Council Workshop held on March 24, 2025, and City Council Regular
Meeting held on March 24, 2025.

B. Consideration and Possible Action - Resolution No. R2025-41 - A
Resolution of the City Council of the City of Pearland, Texas, regarding the
application of CenterPoint Energy Resources Corp., Texas Division, to
increase rates under the Gas Reliability Infrastructure Program;
suspending the effective date of this rate application for forty-five days;
authorizing the City to continue to participate in a coalition of cities now
known as the “Alliance Of CenterPoint Municipalities-TCUC;” determining
that the meeting at which the resolution was adopted complied with the
Texas Open Meetings Act; making such other findings and provisions
related to the subject; and declaring an effective date.
C. Pulled for discussion.
D. Consideration and Possible Action - Second and Final Reading of
Ordinance No. 1121-3 - An Ordinance of the City Council of the City of
Pearland, Texas, amending Ordinance No. 1121-2, authorizing the offering
of health benefits coverage to City retirees; containing a repealer clause;
providing an effective date; and providing an open meetings clause.

G. Consideration and Possible Action - Resolution No. R2025-29 - A
Resolution of the City Council of the City of Pearland, Texas, awarding a
3-year unit supply contract (1-year initial term; two 1-year renewals) for
Ditch Cleaning Services to Texas Drainage Inc., in the estimated amount
of $300,000.00, for the period of April 15, 2025 through April 14, 2026.
H. Consideration and Possible Action - Resolution No. R2025-45 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
participation in an interlocal cooperative purchasing program for the
purchase of audio-visual equipment (City Hall Complex), in the estimated
amount of $73,917.95, from Data Vox, Inc.
I. Consideration and Possible Action - Resolution No. R2025-47 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
participation in an interlocal cooperative pricing arrangement with the
Texas Department of Information Resources (DIR), for the purchase of
Panasonic Toughbooks, from Southern Computer Warehouse, in the
estimated amount of $145,310.73.
This agenda item was postponed to the April 28, 2025 meeting.
J. Pulled for discussion.
Councilmember Koza made the motion, seconded by Mayor Pro-Tem Carbone
to approve the Consent Agenda items A-J except C, E, F, I, and J.
AYES: Carbone, Koza, Chavarria, Byrom, Cade, and Patel.
NAYS: None.

VII. MATTERS REMOVED FROM CONSENT AGENDA
C. Consideration and Possible Action - Resolution No. R2025-48 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
participation in an Interlocal Agreement with the Pearland Independent
School District (“PISD”) associated with the Veteran’s Sports Complex.
Councilmember Chavarria made the motion, seconded by Mayor Pro-Tem
Carbone to approve Resolution No. R2025-48.
AYES: Carbone, Koza, Chavarria, Byrom, Cade, and Patel.
NAYS: None.
The motion carried.
E. Consideration and Possible Action - Resolution No. R2025-51 - A
Resolution of the City Council of the City of Pearland, Texas, approving
participation in the Office of the Governor, Criminal Justice Division, FY
2026 Victim Assistance, General Victim Assistance Direct Services
Program (VOCA); Grant Number 23623-13, in the total amount of
$169,580.00.
Councilmember Byrom made the motion, seconded by Councilmember Cade to
approve Resolution No. R2025-51.
AYES: Carbone, Koza, Chavarria, Byrom, Cade, and Patel.
NAYS: None.
The motion carried.
F. Consideration and Possible Action – Resolution No. R2025-52 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to enter into a Letter Finance Agreement
with Lower Kirby Pearland Management District, associated with the
Hooper South and Fruge West Road Improvements.
Councilmember Cade made the motion, seconded by Councilmember Koza to
approve Resolution No. R2025-52.
AYES: Carbone, Koza, Chavarria, Byrom, Cade, and Patel.
NAYS: None.
The motion carried.
J. Consideration and Possible Action - Resolution No. R2025-46 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
participation in an interlocal cooperative purchasing program for the
purchase of Bunker Gear, in the estimated amount of $319,200.00, from
Metro Fire Apparatus Specialists, Inc.

Councilmember Patel made the motion, seconded by Councilmember Cade to
approve Resolution No. R2025-46.
AYES: Carbone, Koza, Chavarria, and Byrom.
NAYS: Cade and Patel.
The motion carried.
VIII. PUBLIC HEARING NO. 1
1. Public Hearing: A request by Carlos Saenz, applicant, on behalf of
Armando Lozano, owner, for approval of a zone change for 2.7761 acres
of land from Cullen-Mixed Use (C-MU) District to General Commercial (GC)
District, to wit:
Legal Description: Tract 1: A 1.854-acre tract of land situated in the H.T. &
B.R.R. Company Survey, Section 19, Abstract No. 234, Brazoria County,
Texas, being part of Lot 1, of the Allison Richey Gulf Coast Home Company
Subdivision, Section 19, according to the plat recorded in Volume 2, Page
23-24 of the Plat Records of Brazoria County, Texas, and being the
remainder of a called 2.004-acre tract of land described by deed recorded
under County Clerk’s File No. 2018059756 of the Official Public Records of
Brazoria County, Texas. Tract 2: A 0.9221-acre tract of land situated in the
H.T. & B.R.R. Company Survey, Section 19, Abstract No. 234, Brazoria
County, Texas, being part of Lot 1, of the Allison Richey Gulf Coast Home
Company Subdivision, Section 19, according to the plat recorded in
Volume 2, Page 23-24 of the Plat Records of Brazoria County, Texas, being
part of a tract of land conveyed to Sharon Childers by deed recorded under
County Clerk’s File No. 2018058267 of the Official Public Records of
Brazoria County, Texas.
General Location: 8402 & 8422 McHard Road, Pearland, Texas.
Mayor Cole opened the Public Hearing.
Presentation was provided by Martin Griggs, Deputy Director of Community
Development.
Armando Lozano, applicant, was present to answer questions from Council.
There were no citizen comments.
Mayor Cole closed the Public Hearing.
IX. NEW BUSINESS
1. Consideration and Possible Action - First Reading of Ordinance No.
2000M-269 - An Ordinance of the City Council of the City of Pearland,
Texas, amending Ordinance No. 2000M, the zoning map of the City of
Pearland, Texas, for the purpose of changing the classification of certain

property; being Tract 1: A 1.854-acre tract of land situated in the H.T. &
B.R.R. Company Survey, Section 19, Abstract No. 234, Brazoria County,
Texas, being part of Lot 1, of the Allison Richey Gulf Coast Home Company
Subdivision, Section 19, according to the plat recorded in Volume 2, Page
23-24 of the Plat Records of Brazoria County, Texas, and being the
remainder of a called 2.004-acre tract of land described by deed recorded
under County Clerk’s File No. 2018059756 of the Official Public Records of

zone change for 2.7761 acres of land from Cullen-Mixed Use (C-MU)
District to General Commercial (GC) District; providing for an amendment
of the zoning district map; containing a savings clause, a severability
clause, and an effective date and other provisions related to the subject.
Councilmember Chavarria made the motion, seconded by Councilmember
Koza.
Mayor Pro-Tem Carbone made the motion, seconded by Councilmember Byrom
to amend the resolution from General Commercial (GC) District to General
Business (GB) District.
AYES: Carbone, Koza, Chavarria, Byrom, Cade, and Patel.
NAYS: None.
The motion carried.
Councilmember Chavarria made the motion, seconded by Councilmember Koza
to approve first reading of Ordinance No.2000M-269 as amended.
AYES: Carbone, Koza, Chavarria, Byrom, Cade, and Patel.
NAYS: None.
The motion carried.
X. PUBLIC HEARING NO. 2
2. Public Hearing: A request by the Director of Community Development of
the City of Pearland for approval of a permanent zone classification for the
land previously within the Brazoria County Municipal Utility District No. 16,
as follows:
a) General Business (GB) District for newly annexed tracts of land as
described in the following plats: Pearland Asian Town, Oak Square

Subdivision, and Reserves B, C, and Oak Road within Avalon Terrace
Section 1 within 270’ of Broadway Street,
b) Single-Family Residential-3 (R-3) District for newly annexed tract of
land as described in the following plats: Avalon Terrace Section 1
[excluding Reserves B, C, and Oak Road within 270’ of Broadway
Street], Avalon Terrace Section 2, Avalon Terrace Section 3, Avalon
Terrace Section 4, Avalon Terrace Section 5, Avalon Terrace Section
6, and City of Pearland Sports Complex,
c) Suburban Residential-12 (SR-12) District for newly annexed tracts
of land as described in the following plat: Lakeside Estates Section 1,
d) Suburban Development (SD) District for all areas excluded in plats
and areas stated above, to wit:
Legal Description: All properties within the Brazoria County Municipal
Utility District No. 16 adopted by Ordinance No. 1645.
General Location: North of Broadway Street, west of Reid Boulevard, east
of Stone Road, and south of the northern boundary of Lakeside Estates
Section 1, with the exclusion of 2350 Reid Boulevard.
Mayor Cole opened the Public Hearing.

XI. NEW BUSINESS
2. Consideration and Possible Action - First Reading of Ordinance No.
2000M-270 - An Ordinance of the City Council of the City of Pearland,
Texas, amending Ordinance No. 2000M, the zoning map of the City of
Pearland, Texas, for the purpose of changing the classification of certain
property; being all properties within the Brazoria County Municipal Utility
District No. 16 adopted by Ordinance No. 1645 (located North of Broadway
Street, west of Reid Boulevard, east of Stone Road, and south of the
northern boundary of Lakeside Estates Section 1, with the exclusion of
2350 Reid Boulevard). Zone Change Application No. ZON2025-0036, a
request by the Director of Community Development of the City of Pearland
for approval of a permanent zone classification for the land previously
within the Brazoria County Municipal Utility District No. 16, as follows: a)
General Business (GB) District for newly annexed tracts of land as
described in the following plats: Pearland Asian Town, Oak Square
Subdivision, and Reserves B, C, and Oak Road within Avalon Terrace
Section 1 within 270’ of Broadway Street; b) Single-Family Residential-3
(R-3) District for newly annexed tract of land as described in the following

Development (SD) District for all areas excluded in plats and areas stated

Mayor Pro-Tem Carbone made the motion, seconded by Councilmember Cade
to approve first reading of Ordinance No. 2000M-270.
AYES: Carbone, Koza, Chavarria, Byrom, Cade, and Patel.
NAYS: None.
The motion carried.
XII. NEW BUSINESS CONTINUED
3. Consideration and Possible Action - Resolution R2025-53 - A Resolution
of the City Council of the City of Pearland, Texas, expressing opposition
to Senate Bill 2722 and House Bill 5177, and urging the Texas Legislature
to reject these measures in their current form.
Councilmember Byrom made the motion, seconded by Councilmember Cade to
approve Resolution R2025-53.
AYES: Carbone, Koza, Chavarria, Byrom, and Cade.
NAYS: Patel.
The motion carried.
XIII. OTHER BUSINESS
There were no other business items.
XIV. MAYOR/COUNCIL ISSUES FOR CITY COUNCIL DISCUSSION
There were no issues to discuss.
XV. EXECUTIVE SESSION UNDER TEXAS GOVERNMENT CODE
Council adjourned into Executive Session at 7:55 p.m.
