A Resolution of the City Council of the City of Pearland, Texas, authorizing the
power of eminent domain to acquire fee title to certain property for drainage
improvements; all of that certain tract or parcel containing 1.2410 acres out of
H.T. & B. RR Co. Survey, Abstract 239, Pearland, Brazoria County, Texas and
being the residue of that certain tract described in a deed dated 11-17-2016
from Houston Cougars Foundation, Inc. to Daniel Mingau, et al. as filed in the
Official Records of Brazoria County as Clerk’s File Number 2016056852, in the
Official Records of Brazoria County, Texas for the construction and
maintenance of drainage improvements on certain real property described
herein; authorizing the city attorney, or his designee, and other city officials to
take such actions as are necessary to acquire said property, located within the
city, by donation, purchase, or by the exercise of the power of eminent
domain.
WHEREAS, the City Council recognizes that a public convenience and necessity exists for
the location, construction, operation, and maintenance of drainage improvements on certain real
property described herein; and
WHEREAS, accordingly, the City Council hereby acknowledges that it is in the public’s best
interest to acquire certain real property; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. The City Council hereby finds and determines that a public convenience and
necessity exists for the construction of drainage improvements on certain real property located in
Brazoria County, Texas.
Section 2. The public convenience and necessity requires the acquisition of fee title by
donation, purchase, condemnation, or otherwise, of certain real property located within the City and
situated in Brazoria County, more particularly described in Exhibits “A” and “B”, attached hereto and
incorporated herein for all purposes.
Section 3. The City Attorney, or his designee, and other City officials are hereby
authorized and directed, on behalf of the City to take such actions as are necessary to acquire the
property interest, described in Exhibits “A” and “B”, either by donation, purchase or the exercise of
the power of eminent domain.

METES AND BOUNDS DESCRIPTION
1.2410 ACRES OUT OF
H.T. & B. RR. CO. SURVEY, ABSTRACT 239
PEARLAND, BRAZORIA COUNTY, TEXAS
All that certain 1.2410 acres out of H.T. & B. RR Co. Survey, Abstract 239, Pearland, Brazoria County,
Texas and being the residue of that certain tract described in a deed dated 11-17-2016 from Houston
Cougars Foundation, Inc. to Daniel Mingau, et al. as filed in the Official Records of Brazoria County as
Clerk’s File Number 2016056852 and being more particularly described by metes and bounds as follows
(bearings based on Texas Coordinate System of 1983, South Central Zone);
Commencing at a point marking the south end of a cut-back corner located at the intersection of the east
right-of-way line of Veterans Drive (width varies) and the south right-of-way line of Summer Lane (width
varies), from which a found 5/8” iron rod with cap (illegible) bears N 89° 53’ 43” E – 6.37’ for reference;
Thence S 02° 51’ 55” E – 53.17’ with the existing east right-of-way line of said Veterans Drive to a found
5/8” iron rod marking the POINT OF BEGINNING and marking the northeast corner of that certain
called 0.270 acre tract described in a deed dated 09-30-1998 from William John Schneider, et al. to City
of Pearland as filed in the Official Public Records of Brazoria County at Clerk’s File Number 98-042169
and from which a found 5/8” iron rod bears N 84° 29’ 06” E – 6.57’ for reference;
1. Thence N 87° 12’ 54” E – 58.21’ with the most westerly south line of that certain called 0.6214 acre
tract described in a deed dated 03-16-2006 from John A. Sage, Trustee to Star Two Twin Lakes, L.P.
as filed in the Official Public Records of Brazoria County at Clerk’s File Number 2006015838 to a set
5/8” iron rod with cap (stamped C.L. DAVIS - RPLS 4464) for corner, from which a found 5/8” iron
rod bears N 86° 32’ 16” E – 5.50’ for reference;
2. Thence S 02° 52’ 30” E – 659.45’ (called 659.72’) with the west line of said Star Two Twin Lakes
tract and the west line of Reserve “I”, Twin Lakes Section One according to the plat thereof filed in
Volume 24, Page 232-233, Brazoria County Plat Records to a called and found 3/4” sucker rod for
corner;
3. Thence S 87° 22’ 45” W – 142.00’ with the south line of said Daniel Mingau tract and the most
westerly north line of said Reserve “I” to a set 5/8” iron rod with cap (stamped C.L. DAVIS - RPLS
4464) for corner;
Thence the following (2) courses with the east line of said City of Pearland tract and the east right-of-way
line of said Veterans Drive;
4. Thence N 09° 45’ 59” E – 382.62’ (called 383.64’) to a set 5/8” iron rod with cap (stamped C.L.
DAVIS - RPLS 4464) for corner, from which a 1/2” iron rod bears N 27° 13’ 30” E – 1.19’ for
reference;
5. Thence N 02° 51’ 55” W – 285.57’ to the POINT OF BEGINNING and containing 1.2410 acres
(54,056 square feet) of land more or less.
This metes and bounds description is accompanied by a separate plat, drawing or exhibit per Texas Board
of Professional Land Surveyor’s “General Rules of Procedures and Practices” Section 663.19(9).
