MINUTES OF A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS
HELD ON SEPTEMBER 3, 1975, AT 7:40 P.M. IN THE CITY HALL, 2335 NORTH TEXAS AVENUE,
PEARLAND, TEXAS.
The meeting was called to order with the following present:
Mayor Carlton McComb
Councilman Cecil W. Griffin
Councilman Harry Farley
Councilman Gene E. Sanders
Councilman Tom Reid
Councilman Benny J. Frank
City Manager William E. Wolff
City Attorney Bobby J. Williams
City Engineer Malcolm Collins
City Secretary Dorothy L. Cook
Others Present: Buford R. Urban, W. H. Houser, J. B. Wolf, Mrs. Jean Kubin,
Mrs. Alice Morris, W. R. Scott, William B. Roberts, and James F. McDivit, Realtor.
INVOCATION AND PLEDGE OF ALLEGIANCE:
The invocation was given by Councilman Reid. The Pledge of Allegiance was led by
Councilman Farley.
PURPOSE OF THE HEARING:
Street Assessment Hearing of East Circle Drive from the
Southwest right-of-way line of East Broadway (F. M. 518)
Southwesterly to the Northeast right-of-way line of Shadybend
Drive, being approximately 2,268.6 feet.

STREET IMPROVEMENT COST DISTRIBUTION:
Total footage 2,268.6 feet. Cost Per Property foot $3.29
Property footage abutting Improvements 4,537.2 Owner's Assessment rate $2.00
Property Owner's cost $9,074.40 City's cost above Assessment $5,854.15
Total Construction Cost $14,928.55
TESTIMONY ON BEHALF OF CITY:
Malcolm Collins, City Engineer, testified that the improvements on East Circle .are in
accordance with the specifications. Also, that the property owners are paying less
than 90% of the total cost of the improvements. Mr. Collins testified that before
the improvement the street had four inches of base and was 16 feet to 18 feet wide.
The street is now 24 feet wide with an asphalt surface, double penetration type, on
at least a 7 1/2 inch crushed concrete base. Mr. Collins recommended that the City
accept the street.

Mr. James McDivit, Realtor, testified that the improvements made to East Circle
Drive had enhanced the value of the abutting property. He testified that the
property abutting this street would have an increased market value to a sum greater
than $2.00 per front foot.
PROPERTY OWNER'S TESTIMONY:
No formal testimony was presented by the property owners, however, questions were
asked by the audience after the Engineer's testimony. Requests for the loose
gravel to be removed on East Circle at its intersections with East Broadway and
Shadybend Drive was referred to City Manager, Mr. Wolff, for attention.
RECESS:
Mayor McComb recessed the Hearing at 8:50 P.M. and advised that the Hearing would
be reconvened at 7:30 P.M. on September 8, 1975 under the Docketed Public Hearings
of the regular agenda.
