HomeMy WebLinkAbout20250217 City Council Regular Meeting Minutes Pearland City Council Minutes February 17, 2025 CITY OF PEARLAND, TEXAS CITY COUNCIL REGULAR MEETING MINUTES FEBRUARY 17, 2025 The City Council of Pearland, Texas convened in a meeting on Monday, February 17, 2025 at the Pearland City Hall Council Chambers, 3519 Liberty Drive, Pearland, Texas. The following represents the actions taken by City Council in the order they occurred during the meeting. All motions are made by Council in consecutive order, as determined by the Mayor. I. CALL TO ORDER Mayor J. Kevin Cole called the meeting to order at 6:30 p.m. II. INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF AMERICA FLAG AND TEXAS FLAG Councilmember Byrom gave the Invocation and Councilmember Chavarria led the Pledge of Allegiance to the United States of America Flag and the Texas Flag. III. ROLL CALL AND CERTIFICATION OF QUORUM Mayor J. Kevin Cole Mayor Pro-Tem Tony Carbone Councilmember Joseph Koza Councilmember Mona Chavarria Councilmember Clint Byrom Councilmember Layni Cade Councilmember Chad Thumann Councilmember Rushi Patel Councilmember Trent Epperson Deputy City Attorney Lawrence Provins City Secretary Frances Aguilar All members were present. IV. RECOGNITION AND AWARDS A. Recognition by the Office of the Governor's Economic Development and Tourism awarding the City of Pearland as a Tourism Friendly Certified Community. V. CITIZEN COMMENTS Russ Wilkins, 3401 S. Main St., expressed his concern regarding the expansion of Industrial Road project. Keith Williams with Pearland Citizens Police Academy, invited the public to participate in the Pear Run scheduled for May 3, 2025. Consideration and Possible Action - Excuse the absence of Mayor J. Kevin Cole from the February 10, 2025 City Council Regular Meeting. B. Consideration and Possible Action - Excuse the absence of Councilmember Chad Thumann from the February 10, 2025 City Council Regular Meeting. C. Consideration and Possible Action - Second and Final Reading of Ordinance No. 1591-1 - An Ordinance of the City Council of the City of Pearland, Texas, amending Water Conservation Plan and a Drought Contingency/Water Emergency Response Plan (collectively, the “Plans”) for the City of Pearland to promote responsible use of water and to provide for penalties and/or the disconnection of water service for noncompliance with the provisions of the Water Conservation and Drought Contingency/Water Emergency Response Plan. D. Consideration and Possible Action - Resolution No. R2025-32 - A Resolution of the City Council of the City of Pearland, Texas, renewing a Software Maintenance Service Contract with Azteca Systems, LLC - City Works, in the amount of $210,000.00, for the period of March 8, 2025 through March 7, 2026. Councilmember Koza made the motion, seconded by Mayor Pro-Tem Carbone to approve the Consent Agenda items A-D. AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel. NAYS: None. The motion carried. VII. MATTERS REMOVED FROM CONSENT AGENDA There were no items removed from Consent Agenda. VIII. NEW BUSINESS 1. Consideration and Possible Action - Resolution No. R2025-29 - A Resolution of the City Council of the City of Pearland, Texas, amending a Construction Manager at Risk contract (Barry Rose Water Reclamation Facility and Longwood Water Reclamation Facility Decommission Project Project) with McCarthy Building Companies; establishing a Guaranteed Maximum Price 2 (GMP 2) in the amount of $126,643,050.00. Councilmember Chavarria made the motion, seconded by Councilmember Thumann to approve Resolution No. R2025-29. AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel. NAYS: None. Consideration and Possible Action - Resolution No. R2025-27 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the power of eminent domain to acquire a sewer utility easement on certain property for improvements to the Barry Rose Wastewater Reclamation Facility; being all of that certain tract or parcel containing a 0.364-acre tract in the Thomas J. Green Survey, Abstract No. 198 in Brazoria County, Texas. Said 0.364-acre tract is in a 172.0566-acre tract of land described in a deed to Robert L. Alexander as recorded in Volume 1725, Page 120 in the Brazoria County Deed Records, for construction and maintenance of sewer utility improvements on certain real property described herein; authorizing the city attorney, or his designee, and other city officials to take such actions as are necessary to acquire said property, located within the city, by donation, purchase, or by the exercise of the power of eminent domain. Lawrence Provins, Deputy City Attorney, read the motion into record: Consideration and Possible Action - Resolution No. R2025-27 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the power of eminent domain to acquire a sewer utility easement on certain property for improvements to the Barry Rose Wastewater Reclamation Facility; being all of that certain tract or parcel containing a 0.364-acre tract in the Thomas J. Green Survey, Abstract No. 198 in Brazoria County, Texas. Said 0.364-acre tract is in a 172.0566-acre tract of land described in a deed to Robert L. Mayor Pro-Tem Carbone made the motion, seconded by Councilmember Byrom to approve Resolution No. R2025-27. AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel. NAYS: None. The motion carried. 3. Consideration and Possible Action - Resolution No. R2025-28 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the power of eminent domain to acquire a sewer utility easement on certain property for improvements to the Barry Rose Wastewater Reclamation Facility; being all of that certain tract or parcel containing a 0.234-acre tract in the Thomas J. Green Survey, Abstract No. 198 in Brazoria County, Texas. Said 0.234-acre tract is in the remainder of a 140.6899-acre tract of land described in a deed to Carter Craig Crouch, et al as recorded in Clerk's File No. 98003394 in the Brazoria County Clerk's Office, for construction and maintenance of sewer utility improvements on certain real property described herein; authorizing the city attorney, or his designee, and other city officials to take such actions as are necessary to acquire said property, located within the city, by donation, Page 3 of 5 Docusign Envelope ID: 2DB60810-59E2-472C-A7D4-4C9CEE250292 Pearland City Council Minutes February 17, 2025 purchase, or by the exercise of the power of eminent domain. Said 0.234-acre tract is in the remainder of a 140.6899-acre tract of land described in a deed to Carter Craig Crouch, et al as recorded in Clerk's File No. 98003394 in the Brazoria County Clerk's Office, for construction and maintenance of sewer utility improvements on certain real property described herein; authorizing the city attorney, or his designee, and other city officials to take such actions as are necessary to acquire said property, located within the city, by donation, purchase, or by the exercise of the power of eminent domain Councilmember Byrom made the motion, seconded by Councilmember Koza to approve Resolution No. R2025-28. AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel. NAYS: None. The motion carried. 4. Council Discussion - Regarding the City of Pearland Procurement Presentation: Policies, Procedures, and Best Practices. Presentation provided by Trent Epperson, City Manager; Melissa Saxton, Director of Finance; Joel Hardy, Head of External Affairs; and Victor Brownlees, Assistant City Manager. IX. OTHER BUSINESS There we no other business. X. MAYOR/COUNCIL ISSUES FOR CITY COUNCIL DISCUSSION There were no issues to discuss. XI.
