CITY OF PEARLAND, TEXAS
CITY COUNCIL REGULAR MEETING MINUTES
FEBRUARY 10, 2025
The City Council of Pearland, Texas convened in a meeting on Monday, February 10, 2025 at the
Pearland City Hall Council Chambers, 3519 Liberty Drive, Pearland, Texas. The following
represents the actions taken by City Council in the order they occurred during the meeting. All
motions are made by Council in consecutive order, as determined by the Mayor.
I.CALL TO ORDER
Mayor Pro-Tem Tony Carbone called the meeting to order at 6:30 p.m.
II.INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF
AMERICA FLAG AND TEXAS FLAG
Councilmember Cade gave the Invocation and Councilmember Chavarria led the
Pledge of Allegiance to the United States of America Flag and the Texas Flag.
III.ROLL CALL AND CERTIFICATION OF QUORUM
Mayor Pro-Tem Tony Carbone
Councilmember Joseph Koza
Councilmember Mona Chavarria
Councilmember Clint Byrom
Councilmember Layni Cade
Councilmember Rushi Patel
City Manager Trent Epperson
Deputy City Attorney Lawrence Provins

All members were present except Mayor J. Kevin Cole and Councilmember Chad
Thumann.
IV.CITIZEN COMMENTS
Breck Hamrock, 3712 Lockhead St., expressed his concern regarding accessibility in
public places.
Christine Scruggs, with Parent Action Network, 3808 Pine Branch Dr., expressed her
concern regarding the ban of cannabis/Tetrahydrocannabinol (THC) products in our
City.
V.CONSENT AGENDA
A.Consideration and Possible Action - Approval of the minutes of the
Pearland City Council Workshop held on January 27, 2025, City Council
Regular Meeting held on January 27, 2025, City Council Workshop held on
January 31, 2025, and City Council Special Meeting held on February 1,
2025.

B.Consideration and Possible Action - Resolution No. R2025-26 - A
Resolution of the City Council of the City of Pearland, Texas, ordering a
General Election to be held on the 3rd day of May 2025, establishing the
procedure; and providing for other related matters related thereto.
C.Consideration and Possible Action - Resolution No. R2025-24 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
a 3-year (1-year initial term with two (2) 1-year renewals) Software
Maintenance Contract with Trihedral, Inc., in the estimated amount of
$70,022.00 annually (total estimated cost of $210,066.00).
Councilmember Chavarria made the motion, seconded by Councilmember
Byrom to approve the Consent Agenda items A-C.
AYES: Carbone, Koza, Chavarria, Byrom, Cade, and Patel.
NAYS: None.
The motion carried.
VI.MATTERS REMOVED FROM CONSENT AGENDA
There were no items removed from Consent Agenda.
VII.NEW BUSINESS
1.Consideration and Possible Action - Second and Final Reading of
Ordinance No. 2000M-267 - An Ordinance of the City Council of the City of
Pearland, Texas, amending Ordinance No. 2000M, the zoning map of the
City of Pearland, Texas, for the purpose of changing the classification of
certain property; being a 7.573 acre (329,887 square feet) tract, out of Lot
15, lying west of State Highway #35, out of the L.W. Murdock Subdivision,
Volume 29, Page 175, Brazoria County Deed Records, in the A.C.H. & B.
Railroad Survey, Section II, Abstract 507, Brazoria County, Texas, said
7.583 acres being that same tract described in a deed recorded in Volume
1259, Page 139 of the Brazoria County Deed Records (located at the
Northwest Corner of Main Street and Bailey Road, Pearland, Texas). Zone
Change Application No. ZONE 24-19, a request by Will Benson, applicant,
on behalf of JM Projects, LLC., owner, for approval of a zone change from
Heavy Industrial (M-2) District to General Commercial (GC) District;
providing for an amendment of the zoning district map; containing a
savings clause, a severability clause, and an effective date and other
provisions related to the subject.
Councilmember Koza made the motion, seconded by Councilmember Byrom to
approve the second and final reading of Ordinance No. 2000M-267.
AYES: Carbone, Koza, Chavarria, Byrom, and Cade.
NAYS: Patel.
The motion carried.

2.Consideration and Possible Action - First Reading of Ordinance No. 1591-
1 - An Ordinance of the City Council of the City of Pearland, Texas,
amending Water Conservation Plan and a Drought Contingency/Water
Emergency Response Plan (collectively, the “Plans”) for the City of
Pearland to promote responsible use of water and to provide for penalties
and/or the disconnection of water service for noncompliance with the
provisions of the Water Conservation and Drought Contingency/Water
Emergency Response Plan.
Councilmember Byrom made the motion, seconded by Councilmember Koza to
approve the first reading of Ordinance No. 1591-1.
AYES: Carbone, Koza, Chavarria, Byrom, Cade, and Patel.
NAYS: None.
The motion carried.
VIII.EXECUTIVE SESSION UNDER TEXAS GOVERNMENT CODE
Council adjourned into Executive Session at 6:48 p.m.
Section 551.087 - Deliberations Regarding Economic Development
Negotiations.
Conducted.
Council returned from Executive Session at 7:22 p.m.
IX.NEW BUSINESS CONTINUED
3.Consideration and Possible Action - Regarding Economic Development
Negotiations.
Councilmember Koza made the motion, seconded by Councilmember Byrom to
authorize the City Manager or his designee to execute an amendment to the
Development Agreement with Project #2300, as discussed in Executive
Session.
AYES: Carbone, Koza, Chavarria, Byrom, Cade, and Patel.
NAYS: None.
The motion carried.
X.OTHER BUSINESS
There were no other business items.
XI.MAYOR/COUNCIL ISSUES FOR CITY COUNCIL DISCUSSION
There were no issues to discuss.

XII.ADJOURNMENT
Mayor Pro-Tem Carbone adjourned the meeting at 7:23 p.m.
