A Resolution of the City Council of the City of Pearland, Texas, ordering the
May 3, 2025 General Election to be canceled; declaring the unopposed
candidates for Councilmember, Position one (1); Councilmember Position
five (5); and Councilmember, Position six (6) are duly elected; and providing
for other related matters related thereto.
Whereas, on February 10, 2025, the City Council of the City of Pearland, Texas, adopted
Resolution No. 2025-26 ordering a General Election be held on May 3, 2025, for the purpose of
electing three (3) Councilmembers by position, from the City at large, for Councilmember, Position
one (1); Councilmember Position five (5); and Councilmember, Position six (6), for a term of three
(3) years; and
Whereas, the deadlines for filing applications for a place on the ballot, or for a place on
the list of write-in candidates, for the positions for which the general election was to be held have
all expired; and
Whereas, Section 2.053 of the Election Code provides that a municipality may cancel an
election for councilmembers if each candidate whose name is to appear on the ballot is
unopposed and no proposition is to appear on the ballot; and
Whereas, the City Secretary has certified to the City Council, in writing, that: a) Joseph
Koza is unopposed for election to Councilmember Position No. 1; b) Layni Cade is unopposed for
election to Councilmember Position No. 5; and c) Rick Fernandez is unopposed for election to
Councilmember Position No. 6.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. The facts and matters set forth in the preamble of this Resolution are
hereby found to be true and correct.
Section 2. The General Municipal Election scheduled for the 3rd day of May 2025, is
hereby cancelled.
Section 3. The following unopposed candidates have been certified as unopposed
and are declared elected:
Name of Candidate Office Sought
Joseph Koza Councilmember Position No. 1
Layni Cade Councilmember Position No. 5
Rick Fernandez Councilmember Position No. 6
Section 4. That a copy of this Resolution will be posted on Election Day at the polling
place that would have been used for the election, as required by the Election Code.
Section 5. That a certification of election will be issued to each candidate in the same
manner and at the same time as provided for a candidate elected at the election, as required by
the Election Code.
Section 6. The meeting at which this Resolution was approved was a regular meeting
of the City Council, and in all things, was conducted in strict compliance with the Texas Open

Meetings Act, Texas Government Code, Chapter 551.
Section 7. This Resolution shall become effective from and after its passage.
PASSED, APPROVED and ADOPTED this the 10th day of March, A.D., 2025.
