RESOLUTION NO. 2025-27
A Resolution of the City Council of the City of Pearland, Texas, authorizing the
power of eminent domain to acquire a sewer utility easement on certain
property for improvements to the Barry Rose Wastewater Reclamation
Facility; being all of that certain tract or parcel containing a 0.364-acre tract in
the Thomas J. Green Survey, Abstract No. 198 in Brazoria County, Texas. Said
0.364-acre tract is in a 172.0566-acre tract of land described in a deed to
Robert L. Alexander as recorded in Volume 1725, Page 120 in the Brazoria
County Deed Records, for construction and maintenance of sewer utility
improvements on certain real property described herein; authorizing the city
attorney, or his designee, and other city officials to take such actions as are
necessary to acquire said property, located within the city, by donation,
purchase, or by the exercise of the power of eminent domain.
WHEREAS, the City Council recognizes that a public convenience and necessity exists for
the location, construction, operation, and maintenance of sewer utility improvements on certain real
property described herein; and
WHEREAS, accordingly, the City Council hereby acknowledges that it is in the public's best
interest to acquire a sewer utility easement interest on certain real property; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. The City Council hereby finds and determines that a public convenience and
necessity exists for the construction of sewer utility improvements on certain real property located in
Brazoria County, Texas.
Section 2. The public convenience and necessity requires the acquisition of a sewer
utility easement by donation, purchase, condemnation, or otherwise, of certain real property located
within the City and situated in Brazoria County, more particularly described in Exhibits "A" and "B",
attached hereto and incorporated herein for all purposes.
Section 3. The City Attorney, or his designee, and other City officials are hereby
authorized and directed, on behalf of the City to take such actions as are necessary to acquire the
property interest, described in Exhibits "A" and "B", either by donation, purchase or the exercise of
the power of eminent domain.

METES AND BOUNDS DESCRIPTION of a 0.364-acre tract in the Thomas J. Green Survey,
Abstract No. 198 in Brazoria County, Texas. Said 0.364-acre tract is in a 172.0566-acre tract of
land described in a deed to Robert L. Alexander as recorded in Volume 1725, Page 120 in the
Brazoria County Deed Records and is more particularly described as follows:
BEGINNING at a 5/8-inch iron rod set for the northerly cut -back corner of the intersection of the
southeasterly right-of-way line of Hughes Road (width varies) with the northeasterly right-of-way
line of Pearland Parkway (based on a width of 130-feet) and has a Texas State Plane grid
coordinate of North 13,774,301.45', East 3,156,949.77';
THENCE, North 41 °30'50" East, along the southeasterly line of said Hughes Road for a
distance of 7.93 feet to a 5/8-inch iron rod set for the most northerly corner of the herein
described tract;
THENCE, South 48°23'55" East, along the easterly line of the herein described tract, 34.87 feet
northeasterly of and parallel to the northeasterly line of said Pearland Parkway, for a distance of
53.87 feet to a 5/8-inch iron rod set for an angle point;
THENCE, South 03°04'06" East, continuing along the easterly line of the herein described tract
for a distance of 20.91 feet to a 5/8-inch iron rod set for an angle point;
THENCE, South 48°23'55" East, continuing along the easterly line of the herein described tract,
20-feet northeast of and parallel to the northeasterly line of said Pearland Parkway, for a
distance of 334.31 feet to a 5/8-inch iron rod set for the point of curvature of a curve to the right;
THENCE, continuing along a line 20-feet northeast of and parallel to the northeasterly line of
said Pearland Parkway and with said curve to the right having a radius of 1,955.00 feet, an
included angle of 10°46' 11 ", (chord bears South 43°00'49" E, 366.94 feet), for an arc length of
367.48 feet to a 5/8-inch iron rod set in the southeasterly line of said 172.0566-acre tract, same
being the northwesterly line of the remainder of a 140.6899-acre tract of land described in a
deed to Carter Craig Crouch, et al as recorded in Clerk's File No. 98-003394 in the Brazoria
County Clerk's Office;
THENCE, South 41 °41'56' West, along the southeasterly line of said 172.0566-acre tract, same
being the northwesterly line of said remainder of 140.6899-acres, for a distance of 20.36 feet to
a 5/8-inch iron rod set in the northeasterly line of said Pearland Parkway for the southeasterly
corner of the herein described tract. Said point is in a curve to the left,
THENCE, along the northeasterly line of said Pearland Parkway and with said curve to the left
having a radius of 1,935.00 feet, an included angle of 10°52'53" (chord bears North 42°57'28"
West, 366.94 feet), for an arc length of 367.49 feet to a 5/8-inch iron rod found for the point of
tangency;
THENCE, North 48°23'55" West, continuing along the northeasterly line of said Pearland
Parkway for a distance of 367.87 feet to a 5/8-inch iron rod found for the southerly corner of the
aforementioned cut -back corner of the intersection of Hughes Road and Pearland Parkway;
THENCE, North 10°48'15" West, along the said cut -back corner of the intersection of Hughes
Road and Pearland Parkway for a distance of 44.17 feet to the POINT OF BEGINNING,
containing a computed area of 0.364-acre (15,846 square feet).
NOTE:
1. The bearings, distances and grid coordinate shown hereon are based on the Texas
Coordinate System of 1983, South Central Zone. Distances are surface. Scale
factor: 0.99987.
2. A separate Boundary Map has been prepared in connection with this metes and
bounds description.
