A Resolution of the City Council of the City of Pearland, Texas, authorizing the
power of eminent domain to acquire a sewer utility easement on certain
property for improvements to the Barry Rose Wastewater Reclamation
Facility; being all of that certain tract or parcel containing a 0.234-acre tract in
the Thomas J. Green Survey, Abstract No. 198 in Brazoria County, Texas. Said
0.234-acre tract is in the remainder of a 140.6899-acre tract of land described
in a deed to Carter Craig Crouch, et al as recorded in Clerk's File No. 98003394
in the Brazoria County Clerk's Office, for construction and maintenance of
sewer utility improvements on certain real property described herein;
authorizing the city attorney, or his designee, and other city officials to take
such actions as are necessary to acquire said property, located within the city,
by donation, purchase, or by the exercise of the power of eminent domain.

WHEREAS, the City Council recognizes that a public convenience and necessity exists for
the location, construction, operation, and maintenance of sewer utility improvements on certain real
property described herein; and
WHEREAS, accordingly, the City Council hereby acknowledges that it is in the public’s best
interest to acquire a sewer utility easement interest on certain real property; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. The City Council hereby finds and determines that a public convenience and
necessity exists for the construction of sewer utility improvements on certain real property located in
Brazoria County, Texas.
Section 2. The public convenience and necessity requires the acquisition of a sewer
utility easement by donation, purchase, condemnation, or otherwise, of certain real property located
within the City and situated in Brazoria County, more particularly described in Exhibits “A” and “B”,
attached hereto and incorporated herein for all purposes.
Section 3. The City Attorney, or his designee, and other City officials are hereby
authorized and directed, on behalf of the City to take such actions as are necessary to acquire the
property interest, described in Exhibits “A” and “B”, either by donation, purchase or the exercise of
the power of eminent domain.

COMMENCING at the southerly cut—back corner ofthe intersection of the southeasterly rightaofr
way line of Hughes Road (wrdth varies)with the northeasterly right-of—wayline of Pearland
Parkway (based on a width of 1307feet).Said point is a southwesterly corner of a remainder of a
172.0566—acre tract of land described in a deed to Robert L Alexander as recorded in Volume
1725,Page 120 in the Brazoria County Deed Records;
THENCE,South 48"23‘55"East,along the northeasterly line of said Pearland Parkway,same
being the southwesterly line of the remainder of said 172 0566-acre tract,for a distance of
367 87 feet to the point of curvature of a curve to the right,
THENCE,continuing along the northeasterly line of said Pearland Parkway,same being the
southwesterly line of the remainder of said 172.0566»acre tract,and With said curve to the right
having a radius of 1,935.00 feet,and included angle of 10°52‘53"(chord bears South 42°57’28"
East,366.94 feet),for an arc length of 367.49 feet to a 5/8-inch iron rod found for the POINT OF
BEGNNING and southerly corner of the remainder of said 172 05667acre tract.Said pornt is the
southwesterly corner of the aforementioned remainder of a 140 6899-acre tract having a Texas
State Plane grid coordinate of North 13,773,745.35',East 3,157,483.11’,
THENCE North 41°41‘56”East,along the northeasterly line of sard remainder of 140.6899
acres.same being the southeasterly line of the remainder of said 172,0566-acres,for a distance
of 20.36 feet to a 5/8-inoh iron rod set for the most northerly corner of the herein described tract.
Said point is in a curve to the right;
