1978-07-10 CITY COUNCIL REGULAR MEETING MINUTESA 3 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON JULY 10, 1978 AT 7:30 P.M. IN THE CITY HALL, 2335 N. TEXAS AVENUE, PEARLAND TEXAS. The meeting was called to order with the following present: Mayor Councilman Councilman Councilwoman Councilman Councilman City Manager City Attorney City Secretary INVOCATION AND PLEDGE OF ALLEGIANCE: Tom Reid Harry Farley Dennis Frauenberger Fran Coppinger Carlton McComb Morris Wilson William E. Wolff Bobby J. Williams Dorothy L. Cook The invocation was given by Councilman Farley. The Pledge of Allegiance was led by Fire Chief Reagan. BID OPENINGS: BID NO. B78-9. Motion passed 5 to 0. BID NO. B78-10, ROAD BASE MATERIAL: VENDOR PRODUCT AMOUNT (Approx. 10,000 sq.yd.) Chennault Materials Crushed Concrete $ 6.50 .cu. yd. It was moved by Councilman Farley, seconded by Councilman McComb that the bids received for Bid No. B78-10 be received into the records and referred to Ron Wicker, Director of Planning and Transportation for tabulation and recommendation. Motion passed 5 to 0. COUNCIL ACTIVITY REPORTS: None DEPARTMENTAL REPORTS: City Manager Wolff reported on the open drainage ditch in Woodcreek Subdivision. He advised that the Drainage District Superintendent, Lloyd Yost, contends that proper maintenance of this ditch cannot be made with the right of way available. He did not feel that this ditch should be covered since its effectiveness of drainage would be greatly reduced. (Second Reading) It was moved by Councilman Frauenberger, seconded by Councilman Farley that Ordinance No. 246-49 be passed and approved on second and final reading. ORDINANCE NO. 246-50, AMENDMENT TO LAND USE ORDINANCE - C.H. 4 HELEN ALEXANDER ESTATE - APPLICATION NO. 58: Ordinance No. 246-50 was read in caption by Councilwoman Coppinger. (Second Reading) It was moved by Councilwoman Coppinger, seconded by Councilman McComb that Ordinance No. 246-50 be passed and approved on second and final reading. Said Ordinance reads in caption as follows: ORDINANCE NO. 246-50 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO. 246, KNOWN AS THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS; PROVIDING FOR AMENDMENT OF THE LAND USE DISTRICT MAP; PROVIDING AN EFFECTIVE DATE AND CONTAINING OTHER PRO- VISIONS RELATING TO THE SUBJECT. A discussion was held regarding the need for an easement along the side of this property so that the drainage ditch can be maintained properly. This ditch is a major drainage artery for Sherwood Subdivision, and the City Manager advised that each time the drainage ditch needs to be cleaned, the Drainage District has to contact the property owner for permission to perform this work. It was moved by Councilman Farley, seconded by Councilman Wilson that the motion for approval of Ordinance No. 246-50 be tabled until the next regular meeting. Motion passed 5 to 0. City Manager to contact the Alexander Estate regarding this matter. NEW BUSINESS: ORDINANCE NO. 380, AN ORDINANCE ANNEXING CERTAIN PROPERTY OWNED BY W.E.L. HARTMAN AND WIFE, LOUISE NARRY HARTMAN - 79.159 ACRES, ABSTRACT NO. 509: Ordinance No. 380 was read in caption by Councilman Farley. (First Reading) It was moved by Councilman Farley, seconded by Councilwoman Coppinger that Ordinance No. 380 be approved on first of two readings. Said Ordinance reads in caption as follows: ORDINANCE NO. 380 AN ORDINANCE ANNEXING CERTAIN PROPERTY AND TERRITORY TO THE CITY OF PEARLAND, TEXAS, AND EXTENDING THE CORPORATE LIMITS OF THE CITY OF PEARLAND TO INCLUDE AND EMBRACE SAID TERRITORY WHICH IS ADJACENT TO AND CONTIGUOUS WITH THE PRESENT CORPORATE LIMITS OF THE CITY OF PEARLAND AND IS NOT WITHIN THE CITY LIMITS OF ANY OTHER CITY AND LIES SOLELY WITHIN THE EXTRA- TERRITORIAL JURISDICTION OF THE CITY OF PEARLAND, SAID TERRITORY BEING HEREINAFTER FULLY DESCRIBED BY METES AND BOUNDS IN SECTION 1 OF THIS ORDINANCE; PRESCRIBING THE VOTING PRECINCTS FOR THE INHABITANTS WITHIN SAID ANNEXED TERRITORY; PLACING SUCH INHABITANTS ON EQUAL FOOTING WITH PRESENT INHABITANTS OF THE CITY OF PEARLAND; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATIONS, AND CON- TAINING OTHER PROVISIONS RELATING TO THE SUBJECT. ORDINANCE NO. 220-4, ORDINANCE AMENDING THE RATES FOR WATER SERVICE: Action on Ordinance No. 220-4 delayed until a later time. AWARD OF BIDS: BID NO. B78-9, RESCUE TRUCK FOR FIRE DEPARTMENT: The Equipment Committee of the Volunteer Fire Department will submit its recommendation at the next regular meeting of the City Council. BID NO. B78-10, ROAD BASE MATERIAL: Director of Planning and Transportation, Ron Wicker, recommended that the award of Bid no. B78-10 be made to the lowest bidder, Chennault Material Company for a price of $6.50 per cu. yd. of crushed concrete. It was moved by Councilman Frauenberger, seconded by Councilman Wilson that Bid No. B78-10 for road base materials be awarded to Chennault Material Company for $6.50 per cu. yd. of crushed concrete. Motion passed 5 to 0. ORDINANCE NO. 221-B, AN ORDINANCE REPEALING ALL AND SINGULAR SECTIONS 24-14 THROUGH 24-27, BOTH INCLUSIVE OF ARTICLE II, CHAPTER 24 OF THE CODE OF ORDINANCES STYLED POLICE RESERVE UNIT: Ordinance No. 221-B was read in full by Councilman McComb. (First Reading) It was moved by Councilman McComb, seconded by Councilman Farley that Ordinance No. 221-B be passed and approved on first of two readings. Mr. Wolff advised that the City could purchase this land from Mr. Cunningham for $1.00 per square foot. Mayor Reid absent from the Chair; Mayor Pro -Tem Farley presiding. It was moved by Councilman McComb, seconded by Councilman Wilson that the City Manager be authorized to purchase the Cunningham property for the extension of Mykawa Road for a price of $1.00 per square foot. Motion passed 5 to 0. OTHER BUSINESS: EXECUTIVE SESSION - TEXAS OPEN MEETING'S LAW, SECTION 2, SUBSECTION (e) and (g) LEGAL AND PERSONNEL. MEETING RECESSED AT 8:15 P.M. - RECONVENED AT 9:15 P.M.
