HomeMy WebLinkAbout20250127 City Council Regular Meeting Minutes Pearland City Council Minutes January 27, 2025 CITY OF PEARLAND, TEXAS CITY COUNCIL REGULAR MEETING MINUTES JANUARY 27, 2025 The City Council of Pearland, Texas convened in a meeting on Monday, January 27, 2025 at the Pearland City Hall Council Chambers, 3519 Liberty Drive, Pearland, Texas. The following represents the actions taken by City Council in the order they occurred during the meeting. All motions are made by Council in consecutive order, as determined by the Mayor. I. CALL TO ORDER Mayor J. Kevin Cole called the meeting to order at 6:30 p.m. II. INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF AMERICA FLAG AND TEXAS FLAG Mayor Cole requested a moment of silence for Brazoria County Deputy Jesus Vargas and his family. Councilmember Byrom gave the Invocation and Councilmember Chavarria led the Pledge of Allegiance to the United States of America Flag and the Texas Flag. III. ROLL CALL AND CERTIFICATION OF QUORUM Mayor J. IV. RECOGNITION AND AWARDS 1. Presentation of the Recognized Best Practices Fire Department Award by the Texas Fire Chiefs Association. 2. Presentation of the Open Government & Compliance Transparency Star Award by the State of Texas Comptroller of Public Accounts. V. CITIZEN COMMENTS Bill Baldy, 3714 Wingtail Way, expressed his concern regarding potholes in his neighborhood. Consideration and Possible Action - Approval of the minutes of the Pearland City Council Regular Meeting held on January 13, 2025. B. Consideration and Possible Action - Resolution No. R2025-25 - A Resolution of the City Council of the City of Pearland, Texas, conveying a fee simple parcel, drainage easements, and an access easement (collectively, Property Interests) to Brazoria Drainage District No. 4 for maintenance and construction of drainage facilities associated with Cowart Creek. C. Consideration and Possible Action - Resolution No. R2025-19 - A Resolution of the City Council of the City of Pearland, Texas, authorizing participation in an interlocal cooperative purchasing program for the purchase of Security Entry and Surveillance Supply and installation services (Shadow Creek Ranch, Southdown and Garden Water Plants), from Convergint Technologies, LLC, in the estimated amount of $65,874.00. D. Pulled for discussion. E. Pulled for discussion. F. Consideration and Possible Action - Resolution No. R2025-6 - A Resolution of the City Council of the City of Pearland, Texas, renewing a contract renewal with Katarzyna (Kasia) Kimmel, MD/ MPH for EMS Medical Director services, in the estimated amount of $95,000.00, for the period of January 23, 2025 to January 22, 2026. G. Consideration and Possible Action - Resolution No. R2025-9 - A Resolution of the City Council of the City of Pearland, Texas, authorizing participation in an interlocal cooperative pricing arrangement for the purchase of Plumbing Supplies, HVAC Products, Janitorial Supplies and Building Supplies from Ferguson Enterprises, LLC, in the estimated amount of $80,000.00, for fiscal year 2025. Councilmember Koza made the motion, seconded by Councilmember Cade to approve the Consent Agenda items A - G, except for D and E. AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel. NAYS: None. The motion carried. VII. MATTERS REMOVED FROM CONSENT AGENDA D. Consideration and Possible Action - Resolution No. R2025-23 - A Resolution of the City Council of the City of Pearland, Texas, authorizing participation in an interlocal cooperative purchasing program for the purchase of one (1) fleet vehicle, from Chastang Ford, in the amount of $68,345.00. AYES: Byrom. NAYS: Carbone, Koza, Chavarria, Cade, Thumann, and Patel. The motion failed. E. Consideration and Possible Action - Resolution No. R2025-22 - A Resolution of the City Council of the City of Pearland, Texas, authorizing participation in an interlocal cooperative purchasing program for the purchase of fire alarm monitoring, fire safety inspection, and fire alarm repair services from Firetron, in the estimated amount of $151,325.00. Councilmember Koza made the motion, seconded by Councilmember Thumann to approve Resolution No. R2025-22. Mayor Pro-Tem Carbone made the motion, seconded by Councilmember Cade to postpone Resolution No. R2025-22 until February 10, 2025. AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel. NAYS: None. The motion carried. VIII. PUBLIC HEARING NO. 1 1. Public Hearing: A request by Will Benson, applicant, on behalf of JM Projects, LLC., owner, for approval of a zone change for 7.573 acres of land from Heavy Industrial (M-2) District to General Commercial (GC) District, to wit: Legal Description: Being a 7.573 acre (329,887 square feet) tract, out of Lot 15, lying west of State Highway #35, out of the L.W. Murdock Subdivision, Volume 29, Page 175, Brazoria County Deed Records, in the A.C.H. & B. Railroad Survey, Section II, Abstract 507, Brazoria County, Texas, said 7.583 acres being that same tract described in a deed recorded in Volume 1259, Page 139 of the Brazoria County Deed Records. General Location: Northwest Corner of Main Street and Bailey Road, Pearland, Texas. Mayor Cole opened the Public Hearing. Presentation was provided by Katya Copeland, Planning Manager. Will Benson, applicant, was present to answer questions from Council. There were no citizen comments. Consideration and Possible Action - First Reading of Ordinance No. 2000M-267 - An Ordinance of the City Council of the City of Pearland, Texas, amending Ordinance No. 2000M, the zoning map of the City of Pearland, Texas, for the purpose of changing the classification of certain property; being a 7.573 acre (329,887 square feet) tract, out of Lot 15, lying west of State Highway #35, out of the L.W. Murdock Subdivision, Volume 29, Page 175, Brazoria County Deed Records, in the A.C.H. & B. Railroad Survey, Section II, Abstract 507, Brazoria County, Texas, said 7.583 acres being that same tract described in a deed recorded in Volume 1259, Page 139 of the Brazoria County Deed Records (located at the Northwest Corner of Main Street and Bailey Road, Pearland, Texas). Zone Change Application No. ZONE 24-19, a request by Will Benson, applicant, on behalf of JM Projects, LLC., owner, for approval of a zone change from Heavy Industrial (M-2) District to General Commercial (GC) District; providing for an amendment of the zoning district map; containing a savings clause, a severability clause, and an effective date and other provisions related to the subject. Councilmember Chavarria made the motion, seconded by Councilmember Thumann to approve the first reading of Ordinance No. 2000M-267. AYES: Carbone, Koza, Chavarria, Byrom, Thumann, and Patel. NAYS: Cade. The motion carried. 2. Council Discussion - Regarding staff report on Winter Storm Enzo response. Presentation was provided by Ron Fraser, Deputy City Manager; and Eric Hammond, Incident Commander. 3. Council Discussion - Regarding the final report and presentation on the Pearland Transit Needs Assessment & Feasibility Study conducted by Houston-Galveston Area Council (H-GAC). Presentation was provided by Alan Rodenstein, H-GAC Project Manager. 4. Consideration and Possible Action - Resolution No. R2025-21 - A Resolution of the City Council of the City of Pearland, Texas, authorizing participation in an interlocal cooperative purchasing program for the purchase of supplies and services associated with critical process upgrades to the Reflection Bay Wastewater Treatment Plant, from Vector Controls and Automation Group, in the estimated amount of $3,526,137.51. AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel. NAYS: None. The motion carried. 5. Consideration and Possible Action - Resolution No. R2025-8 - A Resolution of the City Council of the City of Pearland, Texas, authorizing an Advanced Funding Agreement with the State of Texas, in the amount of $6,342,282.00, for the voluntary utility relocation contribution associated with the FM 518 Widening and Reconstruction Project (SH 288 to Old Chocolate Bayou); and authorizing the City Manager or his designee to enter into a Reimbursement Agreement between the City and the Pearland Economic Development Corporation (PEDC) as it relates to the Project. Councilmember Byrom made the motion, seconded by Mayor Pro-Tem Carbone to approve Resolution No. R2025-8. AYES: Carbone, Koza, Chavarria, Byrom, Thumann, and Patel. NAYS: Cade. The motion carried. X. OTHER BUSINESS There were no other business items. XI. MAYOR/COUNCIL ISSUES FOR CITY COUNCIL DISCUSSION There were no issues to discuss. XII. EXECUTIVE SESSION UNDER TEXAS GOVERNMENT CODE Council adjourned into Executive Session at 8:21 p.m. Section 551.072 - Deliberation Regarding the Sale, Lease, Purchase or Exchange of Real Property.
