A Resolution of the City Council of the City of Pearland, Texas, conveying a
fee simple parcel, drainage easements, and an access easement
(collectively, Property Interests) to Brazoria Drainage District No. 4 for
maintenance and construction of drainage facilities associated with Cowart
Creek.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That certain Property Interests attached hereto as Exhibit “A” and made a
part hereof for all purposes, are hereby conveyed to Brazoria Drainage District No. 4.
PASSED, APPROVED and ADOPTED this the 27th day of January, A.D., 2025.

2025009873TotalPages:7PP1111IlIllACCESSEASEMENTSTATEOFTEXAS§§KNOWALLMENBYTHESEPRESENTS:COUNTYOFBRAZORTA§THATJ14J,(hereinaftercalled“Grantor”),forandinconsiderationofthemutualbenefitstobederivedherefrom,bythesepresentsdoesherebygrantuntoBRAZORIADRAINAGEDISTRICTNO.4,abodypoliticandcorporateandapoliticalsubdivisionoftheStateofTexas(“Grantee”),aneasementupon,overandacrosstheproperty(the“EasementArea”)situatedinBrazoriaCounty,Texas,asdescribedinExhibit“A”whichisattachedheretoandbythisreferencearemadeaparthereof.TheeasementrightsandprivilegeshereingrantedshallbeusedonlyforthepurposesofingressandegresstotheGrantee’sdrainagefacilitiesadjacenttotheEasementArea.Thiseasementshallbesubjecttoandgovernedbythefollowingprovisions:(1)Theeasement,rightsandprivilegesgrantedhereinarenon-exclusive,andtheGrantorreservesandretainstherighttoconvey,platand/ordedicatesimilarrightsandeasements,aswellasothertypesofrightsandeasements,tosuchotherpersonsorentitiesasGrantormaydeemproper,providingsuchotherconveyancesdonotmateriallyaffecttheGrantee’suseoftheeasementconveyedherein.(2)Theeasement,rightsandprivilegeshereingrantedshalltenninatewhenoratsuchtimeasthepurposeshereofceasetoexist,areabandonedbyGrantee,orbecomeimpossibleofperformance.(3)Theeasement,rightsandprivilegeshereingrantedshallbesubjecttoallvalidandsubsistingencumbrances,conditions,covenants,restrictions,reservations,exceptions,rights-ofwayandeasementsofrecordasofthedatehereof,includingbuildingandzoningordinances,aswellasalllaws,94093-002461564v1

THAT CITY OF PEARLAND, a political subdivision (hereinafter referred to as
"Grantor") for and in consideration of the sum of ten and No/100 Dollars ($10.00) to it paid by
BRAZORIA DRAINAGE DISTRICT NO. 4, a body politic and corporate and a political
subdivision of the State of Texas (hereinafter referred to as "Grantee"), with a mailing address of
4813 West Broadway, Pearland, Texas 77581, and other good and valuable consideration, the
receipt and sufficiency of which is hereby acknowledged ("Consideration"), has GRANTED,
BARGAINED, SOLD and CONVEYED and by these presents does GRANT, BARGAIN, SELL
and CONVEY unto said Grantee, all of that certain lot, tract or parcel of land, lying and being
situated in the County of Brazoria and State of Texas being more fully described in Fxhibit "A"
attached hereto ("Property").
To Have and To Hold the Property, together with all and singular the rights and
appurtenances thereto in anywise belonging unto the said Grantee, Grantee's successors and
assigns forever; and Grantor does hereby bind itself, its successors and assigns, to Warrant and
Forever Defend, the Property unto Grantee, its legal representatives, successors and assigns,
against every person whomsoever lawfully claiming or to claim the same, or any part thereof.
Grantor hereby covenants and agrees that the Consideration constitutes the full, complete, and
final payment for (i) the Property acquired by Grantee herein and (ii) any and all injuries and
damages of whatever nature and character associated with Grantee's past, present, and future use
of the Property. Grantor hereby releases and forever discharges Grantee, its agents, employees,
successors, and assigns from any and all claims, damages, causes of action, and liability of any
nature and kind associated with Grantee's acquisition or use of the Property.
The conveyance of the Property is herein made subject to all restrictions,
easements, covenants, reservations and other encumbrances filed for record in the Official Real
Property Records of Brazoria County, Texas.
This Correction General Warranty Deed is executed pursuant to Section 5.029 of
the Texas Property Code to have the effect stated in Section 5.030 of the Texas Property Code to
change the legal description of the Property contained in Exhibit "A" attached to the General
Warranty Deed recorded under County Clerk's File No.2025009874 in the Official Public Records
of Brazoria County, Texas, to the legal description of the Property contained in Exhibit "A"
attached to this instrument to correct the error in the legal description contained in Exhibit "A" to
the General Warranty Deed which was attached to the General Warranty Deed in error. Each of
the Grantor and Grantee have executed this Correction General Warranty Deed and each of them
acknowledges that the legal description of the Property in the Exhibit "A" attached to this
Correction General Deed should be included in the General Warranty Deed instead of the legal
description of the Property contained in Exhibit "A" attached to the General Warranty Deed.
