CITY COUNCIL REGULAR MEETING MINUTES
DECEMBER 9, 2024
The City Council of Pearland, Texas convened in a meeting on Monday, December 9, 2024 at
the Pearland City Hall Council Chambers, 3519 Liberty Drive, Pearland, Texas. The following
represents the actions taken by City Council in the order they occurred during the meeting. All
motions are made by Council in consecutive order, as determined by the Mayor.
I. CALL TO ORDER
Mayor J. Kevin Cole called the meeting to order at 6:30 p.m.
II. INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF
AMERICA FLAG AND TEXAS FLAG
Mayor Pro-Tem Carbone gave the Invocation and Councilmember Thumann led the
Pledge of Allegiance to the United States of America Flag and the Texas Flag.
III. ROLL CALL AND CERTIFICATION OF QUORUM

IV. CITIZEN COMMENTS
Dina Abdelhalim, 2817 Lost Maples Dr., expressed concern regarding conflict in
Palestine and spoke in favor a ceasefire resolution.
David Lee, 2504 Longwood Dr., expressed his concern regarding the construction
project on Longwood Drive.
V. CONSENT AGENDA
A. Consideration and Possible Action - Approval of the minutes of the
Pearland City Council Workshop meeting held on November 11, 2024;
City Council Regular Meeting held on November 11, 2024; City Council
Workshop meeting held on November 18, 2024; and City Council Regular

B. Consideration and Possible Action - Excuse the absence of
Councilmember Chad Thumann from the November 11, 2024 and the
November 18, 2024 City Council Regular Meeting.
C. Consideration and Possible Action - Excuse the absence of
Councilmember Joseph Koza from the November 18, 2024 City Council
Regular Meeting.
D. Consideration and Possible Action - Resolution No. R2024-172 - A
Resolution of the City Council of the City of Pearland, Texas, rejecting
any and all bids for installation services associated with the Fiber
Backbone Project (Magnolia Blvd from Cullen Parkway to Business
Center Drive).
E. Consideration and Possible Action - Resolution No. R2024-250 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to enter into an Interlocal Agreement
with Brazoria County for traffic signal maintenance and operation.
F. Consideration and Possible Action - Resolution No. R2024-254 - A
Resolution of the City Council of the City of Pearland, Texas, awarding a
contract associated with the Community Development Block Grant
Program (B-24-MC-48-0400), for minor repairs and rehabilitation to single
family owner-occupied homes of low-moderate income Pearland
residents, to DSW Housing, in the estimated amount of $226,000.00.
G. Consideration and Possible Action - Resolution No. R2024-247 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
participation in an interlocal cooperative pricing arrangement for the
purchase of Fire Department Medical Equipment (monitors/defibrillators)
from Zoll Medical, in the amount of $57,755.80.
H. Consideration and Possible Action - Resolution No. R2024-243 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
a 3-year contract (1-year initial term with two 1-year renewals) for the
purchase of EMS tuition, uniforms, study materials and testing services,
to School Of EMS, in an amount not to exceed $85,000.00, for the period
of November 19, 2024, through November 18, 2025.
I. Consideration and Possible Action - Resolution No. R2024-252 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
participation in an interlocal pricing arrangement for the purchase of
Hardware Supplies and Materials from Pearland Lumber, in the estimated
amount of $70,000.00, for the period through fiscal year 2025.
J. Consideration and Possible Action - Resolution No. R2024-251 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
participation in an interlocal pricing arrangement for the purchase of
Hardware Supplies and Materials from O'Day Rental & Supply, in the
estimated amount of $70,000.00, for the period through fiscal year 2025.
K. Consideration and Possible Action - Resolution No. R2024-248 - A

Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to participate in an interlocal
cooperative pricing arrangement for the purchase of Hardware Supplies
and Materials from Lowe’s, in the estimated amount of $115,000.00, for
fiscal year 2025.
L. Consideration and Possible Action - Resolution No. R2024-253 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to participate in an interlocal
cooperative pricing arrangement for the purchase of City Supplies from
Amazon Capital Services, in the estimated amount of $100,000.00, for
fiscal year 2025.
M. Consideration and Possible Action - Resolution No. R2024-239 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
participation in an interlocal cooperative purchasing program for the
purchase of one (1) remount of a grappler truck on an existing chassis,
from Peterson Industries, in the amount of $134,638.04.
N. Consideration and Possible Action - Resolution No. R2024-246 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
participation in an interlocal cooperative purchasing program for the
purchase of manhole rehabilitation of SewperCoat with services from
National Works Inc. in the estimated amount of $380,000.00.
Councilmember Koza made the motion, seconded by Mayor Pro-Tem Carbone
to approve the Consent Agenda items A-N.
AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel.
NAYS: None.
The motion carried.
VI. MATTERS REMOVED FROM CONSENT AGENDA
There were no items removed from Consent Agenda.
VII. PUBLIC HEARING NO. 1
1. Public Hearing: A request by Faraz Hemani, applicant, on behalf of
Mission Park Pearland LP, represented by Terry Ward, owner, for
approval of a zone change for 6.6445 acres of land from General
Business (GB) District to General Commercial (GC) District, to wit:
Legal Description: Lot 1, Block 1, Mission Park, a subdivision of 6.6445
acres of land in the City of Pearland, Texas, according to the map or plat
recorded in County Clerk’s File No. 2020060324 in the Plat Records of
Brazoria County, Texas.
General Location: 2849 Cullen Parkway, Pearland, Texas.
Mayor Cole opened the Public Hearing.

Presentation was provided by Martin Griggs, Deputy Director of Community
Development.
Faraz Hermani, applicant, was present to answer questions from the Council.
There were no citizen comments.
Mayor Cole closed the Public Hearing.
VIII. NEW BUSINESS NO. 1
1. Consideration and Possible Action - First Reading of Ordinance No.
2000M-266 - An Ordinance of the City Council of the City of Pearland,
Texas, amending Ordinance No. 2000M, the zoning map of the City of
Pearland, Texas, for the purpose of changing the classification of certain
property; being Lot 1, Block 1, Mission Park, a subdivision of 6.6445
acres of land in the City of Pearland, Texas, according to the map or plat
recorded in County Clerk’s File No. 2020060324 in the Plat Records of
Brazoria County, Texas (located at 2849 Cullen Parkway, Pearland,
Texas). Zone Change Application No. ZONE 24-20, a request by Faraz
Hamani, applicant, on behalf of Mission Park Pearland LP, represented by
Terry Ward, owner, for approval of a zone change from General Business
(GB) District to General Commercial (GC) District; providing for an
amendment of the zoning district map; containing a savings clause, a
severability clause, and an effective date and other provisions related to
the subject.
Councilmember Chavarria made the motion, seconded by Councilmember
Cade to approve first reading of Ordinance No. 2000M-266.
AYES: Carbone, Koza, and Thumann.
NAYS: Chavarria, Byrom, Cade, and Patel.
The motion failed.
IX. NEW BUSINESS CONTINUED
2. Consideration and Possible Action - First Reading of Ordinance No. 1645
- An Ordinance extending the city limits of the City of Pearland, Texas, to
include certain land area within the limits and boundaries of the City and
annexing to the City of Pearland an area containing approximately 285.76
acres within boundaries the boundaries of Brazoria County Municipal
Utility District No. 16 (“District”), generally located west of Max Road and
north of FM 518; containing an effective date and other provisions related
to the subject; and providing a savings and severability clause.
Mayor Pro-Tem Carbone made the motion, seconded by Councilmember
Byrom to approve first reading of Ordinance No. 1645.

The motion carried.
3. Consideration and Possible Action - Second and Final Reading of
Ordinance No. 2000M-264 - An Ordinance of the City Council of the City
of Pearland, Texas, amending Ordinance No. 2000M, the zoning map of
the City of Pearland, Texas, for the purpose of changing the classification
of certain property; being all properties within the LNR Clear Creek
Spectrum Planned Development Zoning District adopted by Ord. 509-718,
Ord. 2000M-185, Ord. 2000M-231, Ord. 2000M-246, and Ord. 2000M-247
(generally located east and west of Kirby Drive, north of Fruge Road,
south of Sam Houston Parkway and within the following plats:
Endress+Hauser GC Regional Center Amending Plat No. 1, Lower Kirby
Logistics Park, Tool Flo Business Park, Urban Spectrum Replat No. 1,
Amerlux, MHI Amending Plat, and Project Heartbeat Campus Phase 2,
PL2 Building Parking Extension, RePlat PL2 Building Parking Extension
2.). Zone Change Application No. ZONE 24-17, a request by Millar
Development, LLC., applicant and owner of an approximately 4.9176-acre
tract of land at 11950 N. Spectrum, for approval of an amendment to the
required side setback for all corner lots in the LNR Clear Creek Spectrum
Planned Development Zoning District; providing for an amendment of the
zoning district map; containing a savings clause, a severability clause,
and an effective date and other provisions related to the subject.
Anne Stoker, Chief Operating Officer with Millar, was present to answer
questions from the Council.
Councilmember Byrom made the motion, seconded by Councilmember Cade
to approve Ordinance No. 2000M-264.
AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel.
NAYS: None.
The motion carried.
4. Consideration and Possible Action - First Reading of Ordinance No. 1643-
1 - An Ordinance of the City Council of the City of Pearland, Texas,
amending Ordinance No. 1643, the 2024-2025 Annual Budget Ordinance,
to facilitate the changes identified herein; providing a savings clause, a
severa-bility clause, a repealer clause, and an effective date.
Councilmember Cade made the motion, seconded by Councilmember
Thumann to approve first reading of Ordinance No. 1643-1.
AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel.
NAYS: None.
The motion carried.
5. Consideration and Possible Action - First Reading of Ordinance No.1358-
31 - An Ordinance of the City Council of the City of Pearland, Texas,

amending non-development usage and service fees; containing a
savings clause, a severability clause, a repealer clause, providing for
publication and an effective date.
Councilmember Thumann made the motion, seconded by Councilmember
Koza to approve first reading of Ordinance No. 1358-31.
AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel.
NAYS: None.
The motion carried.
X. OTHER BUSINESS
There were no other business items.
XI. MAYOR/COUNCIL ISSUES FOR CITY COUNCIL DISCUSSION
There were no issues to discuss.
XII. EXECUTIVE SESSION UNDER TEXAS GOVERNMENT CODE
Council adjourned into Executive Session at 7:13 p.m.
Section 551.071 - Consultation with City Attorney regarding confidential
legal advice associated with contractual matters.
Conducted.
Section 551.072- Deliberation regarding the Sale, Purchase, Lease or
Exchange of Real Property.
Conducted.
Council returned from Executive Session at 8:26 p.m.
XIII. NEW BUSINESS CONTINUED
6. Consideration and Possible Action - Regarding confidential legal advice
associated with contractual matters.
Mayor Pro-Tem Carbone made the motion, seconded by Councilmember Cade
to authorize staff to extend contingency period of a fourth amended
development agreements as discussed in Executive Session
AYES: Carbone, Koza, Chavarria, Byrom, Cade, and Patel.
NAYS: None.
The motion carried.
7. Consideration and Possible Action - Regarding the Sale, Purchase, Lease
or Exchange of Real Property.

XIV.ADJOURNMENT
Mayor Cole adjourned the meeting at 8:27 p.m.
