R2025-15 A Resolution of the City Council of the City of Pearland, Texas, amending an Overpass Agreement with Burlington Northern Santa Fe Railway Company associated with the Bailey Road Expansion, in the additional amount of $87,971.00 (total contract $218,867.00). BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That certain Amended Overpass Agreement by and between the City of Pearland and Burlington Northern Santa Fe Railway Company, a copy of which is attached hereto as Exhibit “A” and made a part hereof for all purposes, is hereby authorized and approved. Section 2. That the City Manager or his designee is hereby authorized to execute and the City Secretary to attest an Amended Overpass Agreement with Burlington Northern Santa Fe Railway Company. The new overpass will cross the BNSF Mykawa Subdivision LS 7501 at MP 7.78. The Contractor began work in the BNSF right-of-way in March 2024. Work performed to date includes columns, caps, and crash wall installation for the overpass structure. Deck, roadway, sidewalk / bridge rail, and fencing construction will follow and is scheduled to be complete in January 2025 (based on the updated construction schedule dated June 6, 2024). LJA’s contract includes three months of construction management services at an approved monthly rate of $21,670 per month. LJA was able to extend the original budget to provide services for 4 months, through June 2024. Due to the anticipated construction schedule, LJA requests funding for an additional seven months of construction management services. The requested increase ($21,670 per month x 7 months = $151,690) will allow services to be provided through January 2025.
