Home My WebLink About2024-11-11 City Council Regular Meeting Minutes Pearland City Council Minutes November 11, 2024 CITY OF PEARLAND, TEXAS CITY COUNCIL REGULAR MEETING MINUTES NOVEMBER 11, 2024 The City Council of Pearland, Texas convened in a meeting on Monday, November 11, 2024 at the Pearland City Hall Council Chambers, 3519 Liberty Drive, Pearland, Texas. The following represents the actions taken by City Council in the order they occurred during the meeting. All motions are made by Council in consecutive order, as determined by the Mayor. I. CALL TO ORDER Mayor J. Kevin Cole called the meeting to order at 6:30 p.m. II. INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF AMERICA FLAG AND TEXAS FLAG Mayor J. Kevin Cole gave the Invocation and Harrison Franklin from Boy Scout Troop 464 of Pearland led the Pledge of Allegiance to the United States of America Flag and the Texas Flag. III. ROLL CALL AND CERTIFICATION OF QUORUM Mayor J. Kevin Cole Mayor Pro-Tem Tony Carbone Councilmember Joseph Koza Councilmember Mona Chavarria Councilmember Clint Byrom Councilmember Layni Cade Councilmember Rushi Patel City Manager Trent Epperson City Attorney Darrin Coker City Secretary Frances Aguilar All members were present except Councilmember Chad Thumann. IV. CITIZEN COMMENTS Jimmy Davis, 5009 Colmesneil St., expressed his concern regarding the City's customer service and utility billing. Trey Haskins, 3912 Spring Circle Dr. E, expressed his concern regarding the McLean Road reconstruction. V. CONSENT AGENDA A. Consideration and Possible Action - Approval of the minutes of the Pearland City Council Special meeting held on October 28, 2024; and City Council Regular Meeting held on October 28, 2024. B. Consideration and Possible Action - Resolution No. R2024-221 - A Resolution of the City Council of the City of Pearland, Texas, authorizing Docusign Envelope ID: AFAE9C65-AB7E-4C37-9517-3F283BE17F38 Pearland City Council Minutes November 11, 2024 participation in an interlocal cooperative purchasing program for the purchase of software maintenance renewals and hardware upgrades, in the estimated amount of $110,475.00, from Convergint Technologies LLC, for Fiscal Year 2025. C. Consideration and Possible Action - Resolution No. R2024-238 - A Resolution of the City Council of the City of Pearland, Texas, authorizing participation in an interlocal cooperative pricing arrangement for the purchase of phone related services from AT&T, in the estimated amount of $175,000.00 for fiscal year 2025. D. Consideration and Possible Action - Resolution No. R2024-230 - A Resolution of the City Council of the City of Pearland, Texas, authorizing a 3-year (1-year initial term with two (2) 1-year renewals) Software Maintenance Contract with Environmental Systems Research Institute (“ESRI”), in the estimated amount of $128,400.00 annually, for support of the City’s Geographic Information System (“GIS”). Councilmember Koza made the motion, seconded by Councilmember Byrom to approve the Consent Agenda items A-D. AYES: Carbone, Koza, Chavarria, Byrom, Cade, and Patel. NAYS: None. The motion carried. VI. MATTERS REMOVED FROM CONSENT AGENDA There were no items removed from Consent Agenda. VII. PUBLIC HEARING NO. 1 1. Public Hearing - Annexation and Incorporation of Brazoria County Municipal Utility District No. 16. Mayor Cole opened the Public Hearing. Presentation was provided by Joel Hardy, Grants/Special Projects Administrator. Tori Foresburg, President of Avalon Terrance HOA expressed her concern regarding the proposed annexation. William Frost, President of MUD 16 expressed his concern regarding the proposed annexation. Mayor Cole closed the Public Hearing. VIII. Consideration and Possible Action - Resolution No. R2024-233 - A Resolution of the City Council of the City of Pearland, Texas, authorizing a contract with Ardurra Group, Inc., for professional services associated with the Hughes Road Widening Project (Pearland Parkway to Pearland City Limit), in the estimated amount of $1,433,711.28. Councilmember Chavarria made the motion, seconded by Mayor Pro-Tem Carbone to approve Resolution No. R2024-233. AYES: Carbone, Koza, Chavarria, Byrom, Cade, and Patel. NAYS: None. The motion carried. 2. Consideration and Possible Action - Resolution No. R2024-237 - A Resolution of the City Council of the City of Pearland, Texas, authorizing an amended contract with Freese and Nichols, for professional construction administration services associated with the Barry Rose Water Reclamation Facility Project and the Longwood Water Reclamation Facility Decommissioning Project, in the additional amount of $3,485,698.00. David Mudd, Principal-in-Charge with Freese and Nichols was present to answer questions from the Council. Mayor Pro-Tem Carbone made the motion, seconded by Councilmember Koza to approve Resolution No. R2024-237. AYES: Carbone, Koza, Chavarria, Byrom, Cade, and Patel. NAYS: None. The motion carried. 3. Consideration and Possible Action - Resolution No. R2024-234 - A Resolution of the City Council of the City of Pearland, Texas, authorizing participation in an interlocal cooperative purchasing program for the purchase of one (1) replacement ambulance from Siddons Martin Emergency Group, in the estimated amount of $590,023.00. Councilmember Byrom made the motion, seconded by Councilmember Koza to approve Resolution No. R2024-234. AYES: Carbone, Koza, Chavarria, Byrom, Cade, and Patel. NAYS: None. The motion carried. 4. Consideration and Possible Action - Resolution No. R2024-231 - A Resolution of the City Council of the City of Pearland, Texas, amending the City Council Rules and Order of Business ("Rules") as guidelines for the organization and governance of the City Council. AYES: Carbone, Koza, Chavarria, Byrom, Cade, and Patel. NAYS: None. The motion carried. IX. OTHER BUSINESS There were no other business items. X. MAYOR/COUNCIL ISSUES FOR CITY COUNCIL DISCUSSION 1. Council Discussion - Discussion regarding employee compensation. Presentation was provided by Trent Epperson, City Manager; LaRae James, Human Resources Director; and Ron Fraser, Deputy City Manager. Scott McReynolds, Pearland, spoke on the behalf of the Pearland Police Officers Association (PPOA) expressed his concern regarding the City's employee compensation. 2. Council Discussion - Discussion regarding the selection process for the 2025 Charter Review Commission. Presentation was provided by Mayor J. Kevin Cole. XI. EXECUTIVE SESSION UNDER TEXAS GOVERNMENT CODE Council adjourned into Executive Session at 9:02 p.m. Section 551.074 - Personnel Matters - Discussion regarding the annual evaluation of the City Manager. Conducted Section 551.087 - Deliberations Regarding Economic Development Negotiations. Conducted. Council returned from Executive Session at 12:14 a.m. XII. NEW BUSINESS CONTINUED 5. Consideration and Possible Action - Regarding Economic Development Negotiations. Mayor Pro-Tem Carbone made the motion, seconded by Councilmember Cade to authorize the Pearland Economic Development Corporation to enter into a loan agreement with Prospect #2409. The motion carried. 6.Consideration and Possible Action - Regarding the annual evaluation of the City Manager. Mayor Pro-Tem Carbone made the motion, seconded by Councilmember Byrom to adjust the City Managers compensation as discussed in Executive Session. AYES: Carbone, Koza, Chavarria, Byrom, Cade, and Patel. NAYS: None. The motion carried.
