CITY COUNCIL REGULAR MEETING MINUTES
OCTOBER 14, 2024
The City Council of Pearland, Texas convened in a meeting on Monday, October 14, 2024 at
the Pearland City Hall Council Chambers, 3519 Liberty Drive, Pearland, Texas. The following
represents the actions taken by City Council in the order they occurred during the meeting. All
motions are made by Council in consecutive order, as determined by the Mayor.
I.CALL TO ORDER
Mayor J. Kevin Cole called the meeting to order at 6:35 p.m.
II.INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF
AMERICA FLAG AND TEXAS FLAG
Mayor Pro-Tem Carbone gave the Invocation and Councilmember Byrom led the
Pledge of Allegiance to the United States of America Flag and the Texas Flag.

IV.CITIZEN COMMENTS
Jeff Cotten, 16423 Hickory Knoll Dr., with Pearland Professional Firefighters
Association expressed his concern regarding employee compensation.
Robert Jeter III, 7115 Little Willow Dr., expressed his concern regarding a City
employee.
Jimmy Davis, 5004 Colmesneil Dr., expressed his concern regarding the City's
transparency.
Adam Carroll, 12511 Britt Rd., with Pearland Police Officers Association expressed his
concern regarding employee compensation.
Leo Walker, 2911 Hamm, invited the public to attend the Pearland Veterans Day Walk

V. CONSENT AGENDA
A. Consideration and Possible Action - Approval of the minutes of the
Pearland City Council Special Meeting held on September 23, 2024; and
City Council Regular Meeting held on September 23, 2024.
B. Consideration and Possible Action - Resolution No. R2024-185.1 - A
Resolution of the City Council of the City of Pearland, Texas, amending
R2024-185 and nominating a candidate for a position on the board of
directors of the Harris Central Appraisal District.
C. Consideration and Possible Action - Resolution No. R2024-219 - A
Resolution of the City Council of the City of Pearland, Texas, appointing
two (2) representatives and two (2) alternates to the Houston-Galveston
Area Council 2025 General Assembly; appointing one (1) delegate and
one (1) alternate to the HGAC Board of Directors.
D. Consideration and Possible Action - Resolution No. R2024-206 - A
Resolution of the City Council of the City of Pearland, Texas, approving
Special Event Permit No. EVNT24-00069, to host the Brazoria County
Veterans Day Parade on November 11, 2024.
E. Consideration and Possible Action - Resolution No. R2024-201 - A
Resolution of the City Council of the City of Pearland, Texas, accepting
the City’s Investment Report for the quarter ending June 2024.
F. Consideration and Possible Action - Resolution No. R2024-220 - A
Resolution of the City Council of the City of Pearland, Texas, declaring
intention to reimburse project expenditures from proceeds of future tax-
exempt obligations.
G. Consideration and Possible Action - Resolution No. R2024-200 - A
Resolution of the City Council of the City of Pearland, Texas, rejecting
any and all bids for grounds maintenance (rough cut, open ditch and
grounds maintenance).
H. Consideration and Possible Action - Resolution No. R2024-202 - A
Resolution of the City Council of the City of Pearland, Texas, rejecting
any and all bids for construction services associated with the McLean
Water Production Facility Rehabilitation project.
I. Consideration and Possible Action - Resolution No. R2024-198 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to participate in an interlocal
cooperative pricing arrangement with The Interlocal Purchasing System,
for the purchase of Enclosed Pipe Cleaning and Inspection Services, in
the estimated amount of $100,000.00, from National Works for the period
of October 15, 2024 through October 14, 2025.
J. Consideration and Possible Action - Resolution No. R2024-203 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
a construction materials testing and special inspection services contract

with Terracon in the estimated amount of $123,090.00, for the Hillhouse
Road Annex (Phase II) Project.
K. Consideration and Possible Action - Resolution No. R2024-205 - A
Resolution of the City Council of the City of Pearland, Texas, awarding a
5-year (3-year initial term; two 1-year renewals) supply contract for the
purchase of Police Department Uniforms to Fernandez Investment Group,
Inc.; dba Cop Stop, in the annual estimated amount of $200,000.00, for
the period of October 15, 2024 through October 14, 2027.
L. Consideration and Possible Action - Resolution No. R2024-216 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to participate in an interlocal
cooperative pricing arrangement with the SAVVIK Buying Group
Cooperative for the purchase of emergency medical equipment
preventative maintenance and repair services, in an amount not to
exceed $52,298.33, from Stryker Medical.
M. Consideration and Possible Action - Resolution No. R2024-217 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to participate in an interlocal
cooperative pricing arrangement with The Buyboard Purchasing
Cooperative for the purchase of police vehicle equipment installation
services, in the amount of $181,122.09, from MAL Technologies
(Maltech).
N. Consideration and Possible Action - Resolution No. R2024-215 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to participate in an interlocal
cooperative pricing arrangement with The Buyboard Purchasing
Cooperative for the purchase of Lift Station Pump Installation Services,
in the estimated amount of $296,335.00, from Coastal Pump Services, Inc.
O. Consideration and Possible Action - Resolution No. R2024-209 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to participate in an interlocal
cooperative pricing arrangement with The Buyboard Purchasing
Cooperative for the purchase of Fire Department Medical Supplies (3-year
contract; 1-year initial term with 2 renewals), in the estimated annual
amount of $140,000.00, from Bound Tree Medical for the period of
November 23, 2024 through November 22, 2025.
P. Consideration and Possible Action - Resolution No. R2024-210 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to participate in an interlocal
cooperative pricing arrangement with The Buyboard Purchasing
Cooperative for the purchase of Fire Department Medical Supplies (3-year
contract; 1-year initial term with 2 renewals), in the estimated annual
amount of $140,000.00, from Life-Assist for the period of November 23,
2024 through November 22, 2025.
Q. Consideration and Possible Action - Resolution No. R2024-211 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing

the City Manager or his designee to participate in an interlocal
cooperative pricing arrangement with the SAVVIK Buying Group
Cooperative for the purchase of medical equipment and related services,
in the estimated amount of $75,000.00, from Zoll Medical for the period of
October 15, 2024 through October 16, 2025.
R. Consideration and Possible Action - Resolution No. R2024-212 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to participate in an interlocal
cooperative pricing arrangement with The Buyboard Purchasing
Cooperative for the purchase of Fire Department Uniforms (3-year
contract; 1-year initial term with 2 renewals), in the estimated annual
amount of $225,000.00, from Got You Covered Work Wear and Uniforms
for the period of November 23, 2024 through November 22, 2025.
S. Consideration and Possible Action - Resolution No. R2024-213 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to participate in an interlocal
cooperative pricing arrangement with the Houston-Galveston Area
council (“HGAC”) for the purchase of bunker gear cleaning, inspection
and repair services (3-year contract; 1-year initial term with 2 renewals),
in the estimated annual amount of $150,000.00, from Delta Industrial
Service and Supply for the period of October 15, 2024 through October
16, 2025.
T. Consideration and Possible Action - Resolution No. R2024-208 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
participation in an interlocal cooperative pricing arrangement through
The Buyboard Purchasing Cooperative for the purchase fitness
equipment (“Equipment”), from Advance Exercise, and authorizing
payment of the Equipment through a 3-year lease/purchase agreement
with American Capital in the total amount of $154,589.00.
U. Consideration and Possible Action - Resolution No. R2024-204 - A
Resolution of the City Council of the City of Pearland, Texas, renewing a
Software Maintenance Contract with Central Square Technologies, in the
amount of $321,109.39, for the period of October 1, 2024 through
September 30, 2025.
V. Consideration and Possible Action - Resolution No. R2024-207 - A
Resolution of the City Council of the City of Pearland, Texas, renewing a
software maintenance contract with Tyler Technologies, Inc., for software
maintenance services in the amount of $293.999.84.
Councilmember Koza made the motion, seconded by Councilmember Byrom
to approve the Consent Agenda items A-V.
AYES: Carbone, Koza, Chavarria, Byrom, Cade, and Thumann.

VI. MATTERS REMOVED FROM CONSENT AGENDA
There were no items removed from the Consent Agenda.
VII. PUBLIC HEARING NO. 1
1. Public Hearing: A request by the City of Pearland, applicant, for approval
of a proposed amendments to Chapter 4, Article 2, Division 3; Tree
Mitigation of the Unified Development Code (UDC), Ordinance No. 2000T
in accordance with Section 1.1.4.1 of the Unified Development Code.
Mayor Cole opened the Public Hearing.
Presentation was provided by Trent Epperson, City Manager and Vance Wyly,
Director of Community Development.
Lisa Diese, 2715 Pebble Creek Drive, expressed her concern regarding the
City's tree ordinance.
Nick Motamedi, 2323 Clear Lake City Blvd, Ste 180-199, expressed his
concern regarding the City's tree ordinance.
Mayor Cole closed the Public Hearing.
VIII. NEW BUSINESS NO. 1
1. Consideration and Possible Action - First Reading of Ordinance No. UDC
2000T-40 - An Ordinance of the City Council of the City of Pearland,
Texas, for the purpose of amending Chapter 4, Article 2, Division 3; Tree
Mitigation of the Unified Development Code (UDC), Ordinance No. 2000T
in accordance with Section 1.1.4.1 of the Unified Development Code; and
containing a savings clause, a severability clause, and an effective date
and other provisions related to the subject.
Councilmember Chavarria made the motion, seconded by Councilmember
Koza to approve the first reading of Ordinance No. UDC 2000T-40.
Mayor Pro-Tem Carbone made the motion, seconded by Councilmember
Thumann to amend first reading of Ordinance No. UDC2000T-40 to include the
following:
1. Inch for inch mitigation.
2. Authorize the Urban Forester to waive the fees.
3. Raise the tree mitigation fee from $200 per inch to $300 per inch.
4. Add a 4% mitigation cap based on the development evaluation.
5. Allow trees planted in residential developments to count toward
mitigation.

Councilmember Chavarria made the motion, seconded by Councilmember
Koza to approve the first reading of Ordinance No. UDC 2000T-40 as
amended.

IX. NEW BUSINESS CONTINUED
2. Consideration and Possible Action - Resolution No. R2024-214 - A
Resolution of the City Council of the City of Pearland, Texas, directing
staff to prepare a service plan for the proposed annexation of the
property contained within the boundaries of Brazoria County Municipal
Utility District No. 16 in the city’s extraterritorial jurisdiction.
Mayor Pro-Tem Carbone made the motion, seconded by Councilmember Koza
to approve Resolution No. R2024-214.
AYES: Carbone, Koza, Chavarria, Byrom, Cade, and Thumann.
NAYS: None.
The motion carried.
3. Consideration and Possible Action - Resolution No. R2024-197 - A
Resolution of the City Council of the City of Pearland, Texas, awarding a
3-year (1-year initial term; two 1-year renewals) service contract for
electric and mechanical services (maintenance and repairs of City
facilities) to Sustanite Support Services LLC (S3), in the annual estimated
amount of $1,100,000.00, for the period of October 15, 2024 through
October 14, 2027.
Councilmember Byrom made the motion, seconded by Councilmember
Thumann to approve Resolution No. R2024-197.
AYES: Koza, Chavarria, Byrom, Cade, and Thumann.
NAYS: Carbone.
The motion carried.
4. Consideration and Possible Action - Resolution No. R2024-218 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to participate in an interlocal
cooperative pricing arrangement with The Buyboard Purchasing System
for the purchase of one (1) fire tower ladder truck, in the estimated
amount of $2,613,729.00, from Siddons-Martin Emergency Group.
Councilmember Cade made the motion, seconded by Mayor Pro-Tem Carbone

Mayor Pro-Tem Carbone made the motion, seconded by Councilmember
Byrom to approve the reappointment of the Municipal Court Judge to a four-
year term, and adjust salary based as discussed in executive session.
AYES: Carbone, Koza, Chavarria, Byrom, Cade, and Thumann.
NAYS: None.

6. Consideration and Possible Action - Regarding the Sale, Purchase, Lease
or Exchange of Real Property.
