1977-04-04 CITY COUNCIL SPECIAL MEETING MINUTES30 MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON APRIL 4, 1977, AT 7:30 P.M. IN THE CITY HALL, 2335 N. TEXAS AVENUE, PEARLAND, TEXAS. The meeting was called to order with the following present: Mayor Councilman Councilman Councilman Councilman Councilman Councilman Elect Councilman Elect City Manager City Secretary INVOCATION AND PLEDGE OF ALLEGIANCE: Carlton McComb Tom Reid Cecil W. Griffin Harry Farley Terry Gray Benny J. Frank Dennis Frauenberger Morris S. Wilson William E. Wolff Dorothy L. Cook The invocation was given by Councilman Farley. The Pledge of Allegiance was led by Councilman Frank. AUTHORIZATION TO BID LANDFILL IMPROVEMENTS: City Manager Wolff advised the City Council that the permit from the Texas Department of Health Resources for the operation of our landfill near Manvel stipulates that we install a man -proof fence around the entire tract which represents some 7,800 linear feet of fencing. The type of fence is to be a fence installed on six inch posts, nine feet apart with four feet of hog wire on the bottom and four strands of barb wire on top. The approximate cost of this fence would be $10,000.00 and the City Manager asked that the installation of this fence be placed out for bid since it is beyond the capabilities of our City forces. It was moved by Councilman Griffin, seconded by Councilman Frank that the City Manager be authorized to advertise for bids on construction of fencing and other related improvements pursuant to the specifications as provided by Bernard Johnson, Inc. with funding to be provided from bond funds. Motion passed 5 to 0. RESOLUTION NO. R77-13, A RESOLUTION SUPPORTING SOUTHWESTERN BELL TELEPHONE COMPANY'S DIRECTORY ASSISTANCE CHARGE IN PEARLAND: Mayor McComb advised that the directory assistance charge was approved by the Public Utility Commission of Texas and as a result approximately 950 of the people in the State never pay this additional charge and about 5% receive a bill for this service. In the City of Pearland .8% of the people are billed, in other words, less than 1% are billed for directory assistance. A Bill has been passed by the Senate outlawing this directory assistance charge and before a Hearing, one of the Commissioners of the Public Utility Commission testified that if this Bill passed the House and the Governor signed it, a $1.00 increase in everyone's telephone bill would likely occur. Mayor McComb advised that if the Resolution passed, it would be sent to Mr. Joe Hubenak, our representative, Mr. Bill Clayton, House Speaker, and the Governor. 31 Mayor McComb read proposed Resolution No. R77-13. It was moved by Councilman Reid, seconded by Councilman Farley that Resolution No. R77-13 be passed and approved on first and only reading. Abstaining - Councilman Terry Gray CANVASS OF CITY OFFICERS' ELECTION HELD ON APRIL 2, 1977: RESOLUTION NO. R77-14, A RESOLUTION AND ORDER DECLARING THE RESULTS OF CITY OFFICERS' REGULAR ELECTION: Resolution No. R77-14 was read in full by Councilman Reid as follows: RESOLUTION NO. R77-14 RESOLUTION AND ORDER DECLARING RESULTS OF CITY OFFICERS' REGULAR ELECTION, HELD IN THE CITY OF PEARLAND, TEXAS, ON APRIL 2, 1977. THE STATE OF TEXAS CITY OF PEARLAND On this the 4th day of April, 1977, the City Council of the City of Pearland, Texas convened in Special called session open to the public at the regular meeting place thereof with the following members present, to -wit: Mayor Councilman Councilman Councilman Councilman Councilman City Secretary Carlton McComb Tom Reid Cecil W. Griffin Harry Farley Terry Gray Benny J. Frank Dorothy L. Cook and the following absent: none constituting a quorum, and among other proceedings had were the following: Councilman Reid introduced a resolution and order and moved its adoption. The motion was seconded by Councilman Gray, and the motion carrying with it the adoption of the resolution and order prevailed by the following vote: AYES: Councilman Griffin, Councilman Farley, Councilman Reid, Councilman Gray, and Councilman Frank, NOES: none. The resolution is as follows: P11% There came on to be considered the returns of an election held on the 2nd day of April, 1977, for the purpose of electing the hereinafter named officials, and it appearing from said returns, duly and legally made, that there were cast at said election 1,210 valid and legal votes; that each of the candidates in said election received the following votes: FOR COUNCILMAN POSITION 1 NAME OF CANDIDATE TOTAL NUMBER OF VOTES RECEIVED George E. Wilson 608 32 THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: That said election was duly called; that notice of said election was given in accordance with law, and that said election was held in accordance with law, and that pursuant to valid ballots cast Dennis Frauenberger was duly elected City Councilman Position 1 of said City; and Morris S. Wilson was duly elected City Councilman Position 5 of said City, at said election, and said above named parties are hereby declared duly elected to said respective offices, subject to the taking of their oaths and filing bond as provided by the laws of the State of Texas. It is further found and determined that in accordance with the order of this governing body the City Secretary posted written notice of the date, place, and subject of this meeting on the bulletin board located in the City Hall, a place convenient and readily accessible to the general public, and said notice having been so posted and remaining posted continuously for at least 72 hours preceding the scheduled time of said meeting. A copy of the return of said posting shall be attached to the minutes of this meeting and shall be made a part thereof for all intents and purposes. APPOINTMENTS: Mayor McComb appointed Councilman Farley and Councilman Wilson to work with the City Manager to formulate a policy on the use of city vehicles, and bring back recommendations to City Council. Mayor McComb appointed Councilman Gray and Councilman Frauenberger to work on updating the subdivision ordinance. RESOLUTION NO. R77-15 AND RESOLUTION NO. R77-16, RESOLUTIONS OF APPRECIATION TO CECIL W. GRIFFIN AND BENNY J. FRANK: Resolution No. R77-15 was read in full by Councilman Farley. It was moved by Councilman Farley, seconded by Councilman Gray that R77-15 be passed and approved. RESOLUTION NO. R77-15 A RESOLUTION OF THANKS TO CECIL W. GRIFFIN COUNCILMAN - APRIL 1969 to APRIL 1977 MAYOR PRO -TEM - APRIL 1973 to APRIL 1976 Voting "Aye" - Councilman Frauenberger, Councilman Farley, Councilman Reid, Councilman Gray and Councilman Wilson. Voting "No" - None Motion passed 5 to 0. RESOLUTION NO. R77-16 A RESOLUTION OF THANKS TO BENNY J. FRANK COUNCILMAN - APRIL 1971 to APRIL 1977 Resolution No. R77-16 was read in full by Councilman Reid. It was moved by Councilman Reid, seconded by Councilman Wilson that Resolution No. R77-16 be passed and approved. Voting "Aye" - Councilman Wilson, Councilman Gray, Councilman Reid, Councilman Farley, and Councilman Frauenberger. Voting "No" - None Motion passed 5 to 0., Mayor McComb and Councilmen presented the Resolutions and plaques to Cecil W. Griffin and Benny J. Frank. ADJOURN: The meeting was adjourned at 8:00 P.M.
