RESOLUTION NO. R2006-23
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO
ENTER INTO A UTILITY RELOCATION AGREEMENT WITH EQUISTAR
FOR THE RELOCATION OF A GAS TRANSMISSION LINE ASSOCIATED
WITH THE DIXIE FARM ROAD PROJECT.
BE IT RESOLVED BYTHE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS:
Section 1. That the City Manager or his designee is hereby authorized to execute
and the City Secretary to attest a Utility Relocation Agreement between the City of
Pearland and Equistar.

Pipeline Facility Adjustments - Revised Estimate
Mr. Reily:
Upon review of our first estimate provided to you on January 24,2005, Equistar
Chemicals, LP (Equistar) has identified that there was a logic error that caused
and error in our estimated Equistar labor charges. This document provides a
revised estimate with costs broken out by line and site for the adjustments that
will be required to Equistar's pipeline facilities in Harris County as a result of
the widening of Dixie Farm Road. Drawing 5125D-0002 has been provided to
Harris County to indicate the nature of the changes. The following estimates
detailing costs associated with each adjustment are attached for your use. Text
boxes have been added to each of the four proposed work sites to provide
descriptions of the proposed work.

Summary of Adjustments
Equistar's Cross Country System 6" and 8" pipelines cross Dixie Farm Road at
Highway Station 245+00 (approximately). Since both pipelines are cased at
this location, the casing on each pipeline will have to be extended on the south
side of the road to the new proposed highway right-of-way boundary.
Estimated costs for this adjustment are as follows (see attachments "6" Cross
Country Pipeline Casing Extension" and "8" Cross Country Pipeline Casing

Equistar's existing Chocolate Bayou System 6" and 8" pipelines run parallel
and adjacent to the existing Dixie Farm Road southern right-of-way boundary
between Highway Stations 198+50 and 232+00 (approximately). In order to
avoid a conflict with the proposed highway right-of-way boundary on the south
side of Dixie Farm Road, Equistar will relocate approximately 3,500 feet of the
Chocolate Bayou System 6" and 8" pipelines along a new alignment north of
Dixie Farm Road. Total estimated costs for this adjustment are as follows (see
attachments "6" Chocolate Bayou Pipeline Re-Route" and "8" Chocolate Bayou
Pipeline Re-Route" for details):

Due to the relocation of Equistar' s Chocolate Bayou System 6" and 8" pipelines
described in the previous paragraph, the new relocated pipelines will cross
Dixie Farm Road at Highway Station 243+50 (approximately). The new road
crossing will be installed by conventional boring methods. Estimated costs for
this adjustment are as follows (see attachments "6" Chocolate Bayou Pipeline

Equistar operates two below ground valves located on private property that is
south and east of the existing Dixie Farm Road right-of-way boundary. Due to
the proximity of the proposed expanded roadway to the valves, Equistar will
place concrete barriers around the valve site as a safety precaution to protect the
valves stems from damage resulting from potential traffic accidents. Estimated
costs for this adjustment are as follows (see attachments "6" Chocolate Bayou
