2024-06-10 City Council Regular Meeting MinutesPearland City Council Minutes June 10, 2024 CITY OF PEARLAND, TEXAS CITY COUNCIL REGULAR MEETING MINUTES JUNE 10, 2024 The City Council of Pearland, Texas convened in a meeting on Monday, June 10, 2024 at the Pearland City Hall Council Chambers, 3519 Liberty Drive, Pearland, Texas. The following represents the actions taken by City Council in the order they occurred during the meeting. All motions are made by Council in consecutive order, as determined by the Mayor. I.CALL TO ORDER Mayor J. Kevin Cole called the meeting to order at 6:30 p.m. II.INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF AMERICA FLAG AND TEXAS FLAG Mayor Pro-Tem Carbone gave the Invocation and Councilmember Thumann led the Pledge of Allegiance to the United States of America Flag and the Texas Flag. III.ROLL CALL AND CERTIFICATION OF QUORUM Mayor J. IV.CITIZEN COMMENTS Kenneth Carter, 3607 East Orange Street, expressed his concern regarding the radar trailer placement on City property. Joyce Ann Fugit, 8024 Serenity Drive, expressed her concern regarding the Tranquility Lake Estates cul-de-sac connected to Serenity Drive. Jimmy Davis, 5004 Colmesneil Street, expressed his concern regarding the new water billing software. Fran Goundry, 8020 Serenity Drive, expressed her concern regarding the Tranquility Lakes Estates cul-de-sac and rod iron gate connected to Serentity Drive. Consideration and Possible Action - Approval of the minutes of the Pearland City Council Special Meeting Canvassing held on May 13, 2024; the City Council Regular Meeting held on May 13, 2024; the City Council and Planning and Zoning Commission Joint Planned Development Workshop Meeting held on May 20, 2024; the City Council Workshop Meeting held on May 20, 2024; and the City Council Regular Meeting held on May 20, 2024. B. Consideration and Possible Action - Resolution No. R2024-109 - A Resolution of the City Council of the City of Pearland, Texas, designating Authorized Officials and Designated Signatories for various purposed related to the City’s Community Development Block Grant-Mitigation (CDBG-MIT) grant program, funded by the U.S. Department of Housing & Urban Development (HUD) through the Texas General Land Office, contract number 24-065-017-E174. C. Consideration and Possible Action - Resolution No. R2024-110 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to enter into a Subrecipient Agreement, in the amount of $77,000.00, with the Pearland Neighborhood Center for repairs and improvements to City-owned property located at 2335 N. Texas Avenue, to be funded by the Community Development Block Grant Program. D. Pulled for discussion. E. Consideration and Possible Action - Resolution No. R2024-107 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to participate in an interlocal cooperative pricing arrangement through the Texas Association of School Boards (TASB) Buy Board for the purchase of personal fire protection equipment, in the amount of $313,320.00, from Metro Fire Apparatus Specialists, Inc. Councilmember Koza made the motion, seconded by Mayor Pro-Tem Carbone to approve the Consent Agenda items A-E except for D. AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel. Consideration and Possible Action - Resolution No. R2024-105 - A Resolution of the City Council of the City of Pearland, Texas, authorizing an expenditure of the Pearland Economic Development Corporation, in the amount of $333,330.00, with TBG Partners for landscape architecture services associated with the Broadway Corridor Enhancements Phase II design. Councilmember Koza made the motion, seconded by Councilmember Byrom to approve Resolution No, R2024-105. Linda Kuhn, 2112 W. Marsala Drive, expressed her concern that the contract does not include native plants, which would be beneficial for the environment. AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel. NAYS: None. The motion carried. VII. PUBLIC HEARING NO. 1 1. Public Hearing: A request by CE Engineers & Development Consultants, Inc., applicant, on behalf of Hatfield Villas, LLC., owners, for approval of a zone change for 4.814 acres of land from General Commercial (GC) District to Single-Family Residential-4 (R-4) District, to wit: Legal Description: Lot 1, in Block 1, Final Plat of Choice Oaks Subdivision, a subdivision of 10.000 acres of land in the City of Pearland, Texas, according to the map or plat thereof, recorded in Volume 23, Page 221 of the Plat Records of Brazoria County, Texas. General Location: 2502 Hatfield Road, Pearland, Texas. Mayor Cole opened the Public Hearing Presentation was provided by Martin Griggs, Deputy Director of Community Development. Chen Wang, Engineer with CE Engineers & Development Consultants, Inc., the applicant was present to answer questions from the Council. Ed Travis, 6213 Jordan Drive, expressed his concern about the zone change. Mayor Cole closed the Public Hearing. VIII. NEW BUSINESS NO. 1 1. Consideration and Possible Action - First Reading of Ordinance No. 2000M-256 - An Ordinance of the City Council of the City of Pearland, Texas, amending Ordinance No. 2000M, the zoning map of the City of Page 3 of 8 DocuSign Envelope ID: 44364158-FDEC-4181-81D6-BACEC4A9081C Pearland City Council Minutes June 10, 2024 Pearland, Texas, for the purpose of changing the classification of certain property; being described as Lot 1, in Block 1, Final Plat of Choice Oaks Subdivision, a subdivision of 10.000 acres of land in the City of Pearland, Texas, according to the map or plat thereof, recorded in Volume 23, Page 221 of the Plat Records of Brazoria County, Texas (located at 2502 Hatfield Road, Pearland, Texas). Zone Change Application No. ZONE 24- 06, a request by CE Engineers & Development Consultants, Inc., applicant, on behalf of Hatfield Villas, LLC., owner, for approval of a zone change from General Commercial (GC) District to Single-Family Residential-4 (R-4) District; providing for an amendment of the zoning district map; containing a savings clause, a severability clause, and an effective date and other provisions related to the subject. Councilmember Chavarria made the motion, seconded by Councilmember Koza to approve the first reading of Ordinance No. 2000M-256. AYES: None. NAYS: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel. The motion failed. IX. PUBLIC HEARING NO. 2 2. Second Public Hearing - A second public hearing of the City Council of the City of Pearland on the proposed reallocation of unprogrammed Community Development Block Grant (CDBG) Annual Action Plan funding for HUD Program Years 2019, 2020, 2021, and 2022, for the purpose of matching Texas General Land Office Disaster Recovery funding for City of Pearland Capital Improvement Program (CIP) roadside ditch improvements in Brookland Acres Subdivision (DR2102) and along Garden Road/O'Day Road (DR2103) and Woody Road (DR2104). Mayor Cole opened the Public Hearing. Presentation was provided by Joel Hardy, Grants/Special Projects Administrator. There were no citizen comments. Mayor Cole closed the Public Hearing. X. NEW BUSINESS CONTINUED 2. Consideration and Possible Action - Resolution No. R2024-108 - A Resolution of the City Council of the City of Pearland, Texas, authorizing amendments and project reallocations in the City’s 2019, 2020, 2021 and 2022 of U.S. Housing and Urban Development Community Development Block Grant Annual Action Plans for submission for the U. S. Department of Housing and Urban Development. Consideration and Possible Action - Resolution No. R2024-91 - A Resolution of the City Council of the City of Pearland, Texas, accepting the City’s annual comprehensive financial report for fiscal year 2023 and the accompanying independent audit as presented by the accounting firm of Whitley Penn, LLP. This item was pulled from the agenda. 4. Consideration and Possible Action - First Reading of Ordinance No. 1634 - An Ordinance of the City Council of the City of Pearland, Texas, authorizing the issuance of the City of Pearland, Texas, permanent improvement bonds in one or more series; setting certain parameters for the bonds; authorizing a pricing officer to approve the amount, the interest rate, price, and terms thereof and certain other procedures and provisions relating thereto. Councilmember Thumann made the motion, seconded by Councilmember Cade to approve the first reading of Ordinance No. 1634. Presentation was provided by Trent Epperson, City Manager; Rachel Wynslow, Budget Officer; and John Robuck, Executive Vice President with BOK Financial Securities. AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel. NAYS: None. The motion carried. Action was taken on Agenda Item 5, but was later reconsidered. 6. Consideration and Possible Action - Resolution No. R2024-111 - A Resolution of the City Council of the City of Pearland, Texas, authorizing publication of notice of intention to issue certificates of obligation for the design, acquisition, construction and improvement of certain public works, authorizing distribution of a preliminary official statement relating to such series of certificates and authorizing certain other matters relating thereto. Councilmember Thumann made the motion, seconded by Councilmember Koza to postpone. Rick Witte, Partner with Jackson Walker, was present to answer questions from the Council. Councilmember Cade made the motion, seconded by Councilmember Byrom to approve Resolution No. R2024-113. AYES: Carbone, Koza, Chavarria, Byrom, Cade, and Thumann. NAYS: Patel. The motion carried. Mayor Pro-Tem Carbone made the motion, seconded by Councilmember Koza to reconsider Resolution No. R2024-113. AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel. NAYS: None. The motion carried. Mayor Pro-Tem Carbone made the motion, seconded by Councilmember Chavarria to amend the amount, not to exceed $26M and to amend the notice for 2024A to include the projects listed in 2024B. AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel. NAYS: None. The motion carried. Councilmember Cade made the motion, seconded by Councilmember Byrom to approve Resolution No. R2024-113, as amended. AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel. NAYS: None. Consideration and Possible Action - Resolution No. R2024-112 - A Resolution of the City Council of the City of Pearland, Texas, authorizing publication of notice of intention to issue certificates of obligation for the design, acquisition, construction and improvement of certain public works, authorizing distribution of a preliminary official statement relating to such series of certificates and authorizing certain other matters relating thereto. Consideration and Possible Action - Resolution No. R2024-101 - A Resolution of the City Council of the City of Pearland, Texas, authorizing participation in the Choice Partners Cooperative, for the purchase of construction services associated with the Fire Station Nos. 2 and No. 3 HVAC Repair Project, in the amount of $758,912.00, from CFI Mechanical, Inc. Councilmember Koza made the motion, seconded by Councilmember Thumann to approve Resolution No. R2024-101. AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel. NAYS: None. The motion carried. 9. Consideration and Possible Action - Resolution No. R2024-103 - A Resolution of the City Council of the City of Pearland, Texas, authorizing a design contract with Cobb-Fendley & Associates, Inc., associated with certain drainage improvements in the Hickory Creek, Garden Acres and Herridge-Miller Subdivisions, in the estimated amount of $1,190,053.00. Councilmember Chavarria made the motion, seconded by Mayor Pro-Tem Carbone to approve Resolution No. R2024-103. AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel. NAYS: None. The motion carried. 10. Consideration and Possible Action - Resolution No. R2024-106 - A Resolution of the City Council of the City of Pearland, Texas, awarding a 5-year unit supply contract (3-year initial term with two 1-year renewals) for the purchase of Debris Management Services to Ceres Environmental Services, Incorporated, in the estimated amount of $2,000,000.00, for the period of June 11, 2024 to March 31, 2027. Mayor Pro-Tem Carbone made the motion, seconded by Councilmember Koza to approve Resolution No. R2024-106. Don Stubblefield, Regional Client Services Manager with Ceres Environmental Services, was present to answer question from the Council. AYES: Carbone, Koza, Chavarria, Byrom, Cade, Thumann, and Patel. Councilmember Byrom made the motion, seconded by Councilmember Koza to approve Resolution No. R2024-104. AYES: Koza, Chavarria, Byrom, Cade, Thumann, and Patel. NAYS: None. The motion carried. XI.OTHER BUSINESS There were no other business items. XII.MAYOR/COUNCIL ISSUES FOR CITY COUNCIL DISCUSSION 1.Council Discussion - Regarding proposed amendments to the City's Tree Protection and Preservation Ordinance. Presentation provided by Vance Wyly, Director of Community Development. Linda Kuhn, 2112 W. Marsala Drive, expressed her concern regarding reducing tree mitigation requirements as trees provide benefits in our environment.
